A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY ENCOURAGING'
THE ALASKA LEGISLATURE TO MAKE CHANGES TO A.S. 29.40.090 ALLOWING
j' BOROUGHS TO ESTABLISH A WORKABLE ABBREVIATED PLAT PROCESS.
WHEREAS, the Alaska Municipal Code revision adopted by the First Session of the
Fourteenth Legislature mandated that all Municipalities establish an abbreviated plat
procedure; and
WHEREAS, A.S. 29.40.090(aX3) limits the use of the abbreviated plat procedure to
those cases which do "not contain or require a dedication of a street, right-of-way, or
other area;" and
WHEREAS, it has been the experience of the Kodiak Island Borough that virtually
any subdivision which creates additional lots also involves the dedication of utility ease-
ments in order to serve the newly created lots;
NOW, THEREFORE BE IT RESOLVED by the Kodiak Island Borough Assembly that
the Second Session of the Fifteenth Alaska Legislature make the following change to
A.S. 29.40.090(a U
Section 29.40.090. Abbreviated Plats and Waivers. (a) Notwithstanding
other provisions of this chapter, the Assembly shall by ordinance establish
an abbreviated plat procedure for a plat that will ... (3) not contain or
require a dedication of a street, right-of-way, or other area, except that
simple utilitv easements may be required .. .
