RESOLUTION NO. 85-112-R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY, SEATED AS THE
BOARD OF ADJUSTMENT, REVERSING A DECISION OF THE PLANNING AND ZONING COMMIS-
SION WHICH DENIED FINAL APPROVAL TO THE SUBDIVISION OF LOT 3 BLOCK 7, WOODLAND
ACRES SUBDIVISION, 5TH ADDITION.
WHEREAS, Rick Brush submitted the subdivision of Lot 3 Block 7,
Woodland Acres Subdivision, 5th Addition to the Planning and Zoning Commission
on August 19, 1985 for consideration as Case S-85-048 and
WHEREAS, the Planning and Zoning Commission conducted an advertised
and noticed public hearing at its September 18, 1985, regular meeting and
denied final approval of the subdivision, and
WHEREAS, the Planning Zoning Commission adopted findings of fact at
the regular meeting on September 18, 1985 supporting denial of the subdivi-
sion, and
WHEREAS, the Kodiak Island Borough Assembly, seated as the Board of
Adjustment at its December 5, 1985 meeting, conducted an advertised and
li noticed public hearing on the appeal request.
NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough Assembly,
seated as the Board of Adjustment, that the September 18, 1985 Planning and
!,.Zoning Commission decision denying the subdivision of Lot 3 Block 7, Woodland
Acres Subdivision, 5th Addition is reversed, for the following reasons:
1. That the lots being created by the proposed subdivision meet all the
requirements of Title 16 and Title 17 of the Kodiak Island Borough
Code.
2. That the development design of the original subdivision (Woodland
Acres, 5th Addition) should not be the basis for determining the
design of other possible lots in the subdivision.
BE IT FURTHER RESOLVED that the final plat should include the note
"Streams and natural drainage courses shall not be blocked or impeded".
