1989-39 Authorizing the Disposal of Borough Land for Less than Fair Market Value to the Alaska Power Authority for Public Purposes.f: Resource Manager Introduced: June 1, 1989 Adopted: June 1, 1989 KODIAK ISLAND BOROUGH HEs0L TLON N0. 89-39-R A RESOLUTION OF THE KODIAK ISLAND BOROUG i ASSE2 MY AUTHORIZING THE DISPOSAL OF BOROUGH LANDS FOR LESS THAN FAIR MARKET VALUE TO THE ALASKA POWER 'AUTHORITY FOR PUBLIC PURPOSES. j WHEREAS, Section 18.20.030 of the Borough code requires the review and recmnendation by resolution of each disposal of Borough real property by the .Planning and Zoning Ccmdssion; and WHEREAS, Section 18.20.170 defined "disposal" as any transfer of real 'property; and WHEREAS, Section 18.20.100 allows for real property disposal at less than fair market value to a public entity upon a finding by the Assembly, that the (disposal will allow the use of the land for a public purpose beneficial to the ,Borough; and WHEREAS, 47.52 acres located within Section 1 and 12, Township 29 South, Range 23 West, Seward Meridian is needed to consolidate the ownership authority over the improvements associated with the Terror Lake Power Project; and WHEREAS, the Planning and Zoning Commission has held an advertised and 'noticed public meeting on the disposal and recamends approval of the transfer. NOW, THERffX)RE, BE IT RESOLVED, that the Kodiak Island Borough Assenbly finds that 47.52 acres of Borough land within Sections 1 and 12, Township 29 South, Range 23 West, Seward Meridian is surplus to the Borough's needs and authorizes the Mayor to negotiate a less than fair market value disposal to the Alaska Power Authority for uses associated with the operation of the Terror Lake Powerhouse subject to the following conditions: (1) The Kodiak Island Borough shall retain an easement across the lands to be disposed to ensure adequate access between the ruining Borough parcels. (2) The following note shall be placed on the plat: "The Kodiak Island Borough reserves the right to utilize the areas below the powerhouse and near available water sources for future aquaculture and fishing enhancement projects." . (3) If it is determined by the Borough that the land described herein, are not used for uses' hot supporting the Terror Lake Hydroelectric Project, said land shall revert to the grantor.
