RESOLUTION NO. 89-32-R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY
AUTHORIZING THE ASSIGNMENT OF A MATERIAL SALES
CONTRACT IN WOMENS BAY
�IWHEREAS, the Kodiak Island Borough has made available for lease
borough gravel resources to foster competition and lower the price of rock
,products; and
iWHEREAS, the Kodiak Island Borough and Felton Construction
itCompany have entered into Materials Sales Contracts on Tracts 81 and B2,
Bells Flats Alaska Subdivision; and
WHEREAS, the contract permits Felton Construction Company to
remove rock according to a development plan at a royalty rate established
yearly by borough ordinance; and
'I WHEREAS, Felton Construction Company requests the right to
'.' exercise their right of assignment to Aleutian Materials, Inc.; and
'I WHEREAS, it is to the benefit of the borough to continue the
competition for rock products as well as completion of the development plan
i for the site;

NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island
I Borough Assembly authorizes the assignment of Material Sales Contracts of
it Tract 81 and B2, Bells Fiats Alaska Subdivision in accordance with the
provisions of the present contracts and subject to the following conditions:
'i 1. Felton Construction and Aleutian Materials, Inc., acknowledges in
;I writing that the borough is not releasing Felton Construction
Company from its continuing liability to the borough; and
2. Felton Construction and Aleutian Materials, Inc. acknowledge in
writing that the borough is not releasing or waiving any of its
rights, including 'its right to declare a default arising from any
past, present or future contractual obligations.
