A RESOLUTION ESTABLISHING PROCEDURES FOR AN APPEAL
BY FELTON CONSTRUCTION

WHEREAS, the Kodiak Island Borough and Felton Construction
lentered a contract for hospital site deveropment on November 23, 1987, and

I� WHEREAS, Felton Construction has filed an additional work claim,

WHEREAS, the contract provides for review of such claims by the
assembly but does not provide the procedure;
NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough
IlAssembly that the following procedures are established for the purpose of
Ing an appeal by Felton Construction:
I. The appeal hearing shall be held on January 19, 1989, at the
meeting of the Kodiak Island Borough Assembly.
1 2. Felton Construction Company may submit oral argument in
Isupport of its appeal limited to ten minutes; Borough staff or counsel may
submit oral argument supporting the decision of the contracting officer
limited to ten minutes; and the appellant may submit a reply argument limited
Ito five minutes.
3. The assembly will decide the appeal upon the appeal record
and the written and oral arguments presented.
