RESOLUTION N0. 66-66-R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY SETTLING THE
ACCESS DISPUTE WITH TOM MENDEL IN THE AMOUNT OF 66,S00.00.
WHEREAS. the Kodiak Island Borough completed construction of the
Bayview Drive--Monaehka Circle Road in early 1986, and
WHEREAS, TOM Mendel OWNS Lot 13, Block 1 of the Monaehka Bay Alaska
Subdivision Which fronts on the MONashka Circle Road, and
WHEREAS, at the time of purchasing easements Tom Handal claims that
the Kodiak Island Borough contract land consultant Who negotiated the easement
Purchases assured him of driveway access to his lot, and
WHEREAS, the road construction left A 5 foot embankment at the edge
of the road onto the lot, and
WHEREAS, this embankment increases the dost of driveway construction
by 67,400 to 69,600 according to construction bid prices, and
WHEREAS, Tom Mendel has agreed to settle the dispute for 66,800.
NOW, THEREFORE. BE IT RESOLVED by the Kodiak Island Borough Assembly
that the Mayor is directed to issue 6 check to Tom Mendel in the amount of
66,800 conditioned upon a release of further obligation by the Kodiak Island
Borough, and
BE IT FURTHER RESOLVED that funds to support this settlement anail
be drawn from the Kodiak Island Undesignated Projects Fund.
