RESOLUTION N0. 86-59-R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY ACCEPTING TRANSFER
OF A PORTION OF U. S. SURVEY 3915 FROM THE CITY OF KODIAK AS A BALER AND
ASBESTOS DISPOSAL SITE.
WHEREAS, the Kodiak Island Borough has constructed an asbestos
disposal site on ■ portion of U. S. Survey 3916. and
j WHEREAS, the Assembly has voted to locate the garbage baler facility
at the existing sanitary landfill, and
WHEREAS, the but baler site at the landfill is also located on a
Portion of U. S. Survey 3916, and
WHEREAS, the City of Kodiak has voted to transfer title of the

necessary portion of U. S. Survey 3915 to the Kodiak Island Borough subject to
I. the City being allowed to use a portion of the site for disposal of
asbestos from municipal buildings, and 2. ■ temporary easement across said
tract for Access to the solid waste disposal site until such time as the Kodiak
Island Borough assumes full1garbage powers.
NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough Assembly
that the Kodiak Island Borough Assembly hereby accepts the transfer of the
designated portion of U. S. Survey 3916 subject to the condition$ that
1- the City of Kodiak will be allowed to use a portion of this land for
disposal of asbestos in accordance with all requirements for asbestos
disposal and at the expense of the City of Kodiak, and
2. A temporary easement across said tract is granted for access to the
solid waste disposal site until such time as the baler facility is
operational and the Kodiak Island Borough assumes garbage power.
AND BE IT FURTHER RESOLVED that the Kodiak Island Borough Mayor is
hereby authorized to have the necessary survey work completed and deeds
prepared to effect the transfer.
