RESOLUTION NO. 85-35-R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY OPPOSING SENATE
LL NO. 213 CONCERNING BONDING AND CHANGE ORDERS ON CONSTRUCTION PROJECTS.
WHEREAS, Senate Bill No. 213 has been introduced requiring cash
rmance bonds and cash payment bonds to be furnished by the contractor for
construction, alteration or repair of a capital project that is funded

WHEREAS, requiring such bonds to be posted will only increase the

WHEREAS, adequate retainage language can be included in construction

WHEREAS, this proposed law also would require any and all change
to be bid on a competitive basis, and
WHEREAS, stopping work on projects each time for three or four
in order to bid a change order totally destroys contract management and
performance and will greatly increase costs of projects or require blind
nce to erroneous plans in order to stay on construction schedules, and
WHEREAS, current law, if used, allows excellent contract management
by municipalities.
NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough Assembly
t Senate Bill No. 213 should fail to pass out of committee and not be

BE IT FURTHER RESOLVED, that copies of this resolution be sent to the
