RESOLUTION NO. 85-26-R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY AWARDING
THE CONTRACT FOR CONSTRUCTION OF SERVICE DISTRICT NO. 1 SEWER AND
WATER IMPROVEMENTS, PROJECT NO. 84-1.
WHEREAS, Invitations for Bids for Service District No. 1 Sewer and Water
Improvements, Project No. 84-1, were published on January 3, 10, 17, and 24, 1985 as
required by Kodiak Island Borough Code Section 3.16.040A, and

WHEREAS, bids were opened at 3:00 p.m. on Thursday, February 21, 1985, and
WHEREAS, the low three bidders were as follows:
The Massart Company $625,260
Brechan Enterprises, Inc. $686,777
Felton Construction Company $758,627.50
WHEREAS, The Massart Company qualified their bid by indicating that they would
not accept award of Project No. 84-1 unless they were also awarded Project No. 84-2,
WHEREAS, the Borough Attorney has declared that the bid from The Massart
Company is nonresponsive to the invitation because the municipality is not allowed to
accept a combination bid when invitations for two separate proposals have been adver-
tised, and
WHEREAS, the Borough Engineer and the Service District No. 1 Advisory Board
concur with the recommendation of the Borough Attorney, and recommend that the
contract be awarded to Brechan Enterprises, Inc.:
NOW, THEREFORE BE IT RESOLVED by the Kodiak Island Borough Assembly that
the bid submitted by The Massart Company is declared to be nonresponsive because the
municipality is not allowed to accept a combination bid when invitations for two separate
projects have been advertised, and
BE IT FURTHER RESOLVED by the Kodiak Island Borough Assembly that the
contract for Service District No. 1 Sewer and Water Improvements, Project No. 84-1, be
awarded to Brechan Enterprises, Inc. in the amount of $686,777.00.
