RESOLUTION NO. 85-10-R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY APPROVING
AN AGREEMENT GRANTING FIRST RIGHT OF REFUSAL TO PURCHASE BOROUGH
LAND IN EXCHANGE FOR A CONSTRUCTION EASEMENT ACROSS LOT 22, BLOCK 1
MONASHKA BAY ALASKA SUBDIVISION, TO FACILITATE CONSTRUCTION OF BAY
VIEW DRIVE.
WHEREAS, the Kodiak Island Borough desires to obtain a construction easement
on approximately 1,243 square feet of Lot 22, Block 1, Monashka Bay Alaska Subdivision,
for the construction of Bay View Drive, and
WHEREAS, the owners of Lot 22, Block 1 would rather obtain an option to
purchase additional land than receive monetary compensation for the construction
easement, and
WHEREAS, a portion of Lot 10, Block 2, Monashka Bay Alaska Subdivision, lying
to the east of the revised Bay View Drive roadway alignment is smaller than necessary
for development as an individual building site without public water and sewer.
NOW, THEREFORE BE IT RESOLVED by the Kodiak Island Borough Assembly
that the Mayor is authorized to execute the Road Easement and Purchase Option
Agreement with Reed E. Oswalt and Marcia Oswalt.
