RESOLUTION NO. 85-8-R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY DECLARING CERTAIN
LAND AVAILABLE FOR LEASE FOR A RADIO STATION.
WHEREAS, the Kodiak Island Borough has a 8.69 acre tract of land
known as the Hospital Subdivision Tract which has a portion of U. S. Survey 351
Lot 2, Block 1 that is not being used by the Kodiak Island Hospital at this
time, and
WHEREAS, the Kodiak Island Borough has received a request to lease a
150 foot triangular corner of the unused portion as the site for a radio stati
transmitter and tower with antenna, and
WHEREAS, the Federal Aviation Administration and local pilots foresee
no interference to Kodiak flight patterns caused by a radio tower at this
location, and
WHEREAS, the Kodiak Island Hospital foresees no interference with
hospital operations caused by a radio tower at this location, and
WHEREAS, Kodiak Island Borough Code 3'8.40.050 determines the method
of establishing the rental rate based on the;fair market value of the land, and
WHEREAS, Kodiak Island Borough Code Sections 18.40.010, 18.40.020
and 18.20.120 provide for bidding on leases in excess to $500 per year.
NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island Borough declare
he 150 foot triangle of land on the/horth Corner of U. S. Survey 3511, Lot 2,
lock 1 to be available for lease a`s the site of a radio transmitter and tower
th antenna subject to the following conditions:
1. Approval of the Planning & Zoning Commission for a conditional use
permit for the radio transmitter and tower.
2. Approval of the Planning & Zoning Commission for a variance for a
tower in excess of 50 feet.
3. Approval and guaranty of a license by the Federal Communications
Commission for,'a radio station to the leasee.
4. The leasee provides a survey by a licensed surveyor of the land to
to be leased.
AND BE IT/ FURTHER RESOLVED that a public outcry auction for this
lease will be he�.d during the public hearings at the regular Assembly meeting
of February 7, 985.
