1985-02 Affirming the Decision of the Planning and Zoning Commission Concerning the Vacation and Replat of Lots 16, 17, and 18, USS 3101.j KODIAK ISLAND BOROUGH RESOLUTION NO. 85-2-R A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY AFFIRMING THE DECISION OF THE PLANNING AND ZONING COMMISSION CONCERNING THE VACATION AND REPLAT OF LOTS 16, 17 AND 18, U. S. SURVEY 3101. WHEREAS, the Kodiak Island Borough Assembly is the Board of Adjus for the Kodiak Island Borough as specified in Kodiak Island Borough Code Secti 17.80, and WHEREAS, a decision of the Planning and Zoning Commission concerning a vacation and replat of lots 16, 17 and 18, U. S. Survey 3101 has been appeal by the owner of record Anthony J. Perez under Kodiak Island Borough Code Secti 16.32, and WHEREAS, the Kodiak Island Borough Planning and Zoning Commission granted preliminary approval for the vacation and replat of lots 16, 17 and 18, U. S. Survey 3101 to Lots 1 through 15, Block 1, U. S. Survey 3101 subject to six conditions, and WHEREAS, Anthony J. Perez is appealing the six conditions determined by the Commission. NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island Borough Assembl�,, sitting as the Board of Adjustment, affirms the decision of the Planning and Zoning Commission for four of the six conditions for the following reasons: Condition 1: The title block necessary are changes to provide a standard 9 Y platting of the subdivision, and Condition 2: The renaming of the street is required by KIB Code Sections 16.16.020D.1 and 16.20.010, and Condition 4: Relocation of the roadway so that the right-of-way coincides wit the boundary of lot 15A and the existing sewer manhole is on thel extended centerline of the portion of the roadway which crosses lots 16, 17 and 18 is necessary to align the roads properly for future roadway development and completion, and Condition 6: Roadway and utility construction plans need to be submitted and reviewed by the Borough Engineer to assure compatible, problem free hook-ups to the Borough utility system. AND BE IT FURTHER RESOLVED that the Kodiak Island Borough Assembly sitting as the Board of Adjustment reverses the decision of the Planning and Zoning Commission for two of the six conditions for the following reasons: L_ j Condition 3: The name Tona is of Norwegian origination and, given the fact th Norwegians were early settlers of Kodiak Island, is a historical name within the requirements of KIB Code Section 16.16.020D.1, a Condition 5: Roadway easement for an unplatted roadway is not necessary for t development of this subdivision and not needed until the roadway is platted and designed for construction.
