KODIAK ISLAND BOROUGH
ORDINANCE NO. FY2027-07
AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH REZONING
CLIFF POINT ESTATES OCEANFRONT ADDITION 3 BLOCK 5 LOTS 1 THROUGH 5, BLOCK
2 LOTS 1 THROUGH 3, 7A AND 8A, BLOCK 4 LOTS 3 THROUGH 5, BLOCK 3 LOTS 1
THROUGH 3, 4A, 5A, 7 AND 8 FROM RR2 RURAL RESIDENTIAL TWO TO C
CONSERVATION (ZONING WILL CORRESPOND TO LOTS CREATED BY PRELIMINARY
SUBDIVISIONS S27-001, S27-002, S27-003, AND S27-004)
WHEREAS, as a second-class borough, the Kodiak Island Borough exercises planning,
platting, and land use regulations on an area wide basis pursuant to A.S. Chapter 29.40; and
WHEREAS, the borough adopted, by ordinance, a comprehensive plan identified in KIBC
17.10.030, most recently amended by Ordinance No. FY2020-06 (the 2008 Comprehensive
Plan); and
WHEREAS, KIBC Section 17.205.010 provides that "Whenever the public necessity,
convenience, general welfare or good zoning practice requires, the assembly may, by ordinance
and after report thereon by the Commission and public hearing as required by law, amend,
supplement, modify, repeal or otherwise change these regulations and the boundaries of the
districts"; and
WHEREAS, Oceanfront Kodiak LLC requested a rezone of Cliff Point Estates Oceanfront
Addition 3 Block 5 Lots 1 through 5, Block 2 Lots 1 through 3, 7A and 8A, Block 4 Lots 3 through
5, Block 3 Lots 1 through 3, 4A, 5A, 7, and 8. Rezoning will correspond to new lots created by
subdivision cases S27-001, S27-002, S27-003, and S27-004; and
WHEREAS, the Commission finds that the subject properties are located within the
conservation land use designation of the future land use map. The future land use map
designation is directly related to the C Conservation District; therefore, the proposed rezoning is
in general conformance to the land use chapter of the comprehensive plan; and
WHEREAS, the Commission finds that the rezone request is in the public necessity,
convenience, general welfare and good zoning practice since the subdivision is in an area without
public water and sewer and is served by a private road, which was developed through a previous
subdivision approved by the Planning and Zoning Commission pursuant to KIBC 16.40.080. Large
lot residential development is common in rural areas without access to public facilities such as
public water and sewer; and
WHEREAS, the Commission finds that large lot residential is a common type of residential
development within communities, especially within rural areas that do not have access to public
utilities like public water and sewer. Therefore, this rezone request generally conforms to the
comprehensive plan's housing goal and policies; and
WHEREAS, at an advertised public hearing, consistent with KIBC 17.205.040, the Commission
considered the merits of the rezone request on July 15, 2026, and recommends approval of the
rezone request based upon findings, satisfying the requirements for Commission review in KIBC
Chapter 17.205 before sending the proposed rezone to the Assembly for consideration; and
WHEREAS, the Commission recommended approval of the rezone request in accordance with
KIBC Chapter 17.205 to the Assembly for review.
