I have had the opportunity to review the administrative filewhich your forwarded to me in this natter and to order a titlereport in preparation for litigation. I have aLso drafted aComplaint for filing with the superior court to initiate anaction against Mr. LeDoux for an injunction to restrain the useof his property pending the construction of a parklng lot andreceipt of the proper certificate of occupancy.
While you were ar^ray, I called and talked $/ith Bob Scholzebriefly about the problems which rnay arise vrith the certificateof occupancy claim. It nay be advisable for us to pursue theparking Lot issue independently, and to urge the buildinginspector to develop the certificate of occupancy issue a bitprior to any Legal action by the Borough or the City of Kodiak.

I lnformed hlm that failure to foltow through on the parkingplan he had subrnltted on f J.le, and on which, conditionally,the variance was granted, left him in vlolatlon and couldultimately result ln the buslness use of that bullding belng
