2026{8 approving a Variance to KIBC 17.175.040 by reducing off-street parking requirement
from four off-street parking space to two off-street parking spaces for Lot 4, Block 8, Kodiak

We are moving fonrrard with your Variance application. There is a scheduled public
hearlng before the KIB Planning and Zoning Commission on Wednesday, Oclober 15,
2025, meeting begins at 6:30 p.m. in the Assembly Chambers, located at 710 Mill Bay
Road, Kodiak, Alaska. Attendance to this meeting is highly encouraged.
One week prior to the regular meeting, on Wednesday, October 8,2025, at 6:30 p.m. in
the Assembly Chambers 710 Mill Bay Road, Kodiak, Alaska. The commission will hold a
packet review work session for the purpose of reviewing packet materials and staff
summaries of cases scheduled for lhe regular meeting.

Borough Code Section 17.175.040 htt kodiakisland. borou h.code 17.175.040 does notKIBC
specify parking requirements for museums. ln lieu of specific parking requirements, P&z is using a 1994
agreement with the Alubiq Museum as a template to require KMM to provide one on-site parking space
for every 300 square feet of museum building floor space. Additionally, the Borough requires one
parking space for every 1,000 square feet of storage space. (see attached Joe Grochmul 8119/2024
email, and January 21, 1994 Memorandum between KIB Planner Ouane Dvorak and Natives of Kodiak
Office Building and Museum)
The Kodiak History Museum has no parking requirement because it existed before the Borough enacted
a parking code.
The proposed variance would allow the museum to operate with two parking spaces on the property
and two off-site spaces using nearby public street parking.
Using the 1994 Alutiiq Museum template, the Borough is requiring three on-site parking spaces for
KMM's 654 square foot office space. One more space is required under 17.175.040 "storage buildings,"
for 520 square feet of combined storage space- a 280 square foot storage building on the property and
240 square feet of storage space in the attic of the main building. This totals four required on-site
parking spaces.

Respond to each of the following standards as they apply to your request (use additional sheets as

1. That there are exceptional physical circumstances or conditions applicable to the property or to its
intended use or development which do not apply generally to other properties in the same land
use district;
Unlike its residential neighbors, KMM plans to use the main building at 215 Mill Bay Rd. (664 square
feet) as museum administrative space, and the main building attic space (240 square feet ) and storage
building in the back yard (280 square feet) for a combined collections storage space of 520 square feet.
The maritime museum's exhibit space is currently an the downtown outdoor harbor area and
occasionaliy at the Kodiak History Museum temporary exhibit gallery. KMM is also working with the City
of Kodiak to create a future indoor exhibit space in the downtown area.
2. That the strict application ofthe provisions of thisftle would result in practical difficulties or
unnecessary hardship;
Creating four code-compliant spaces on the lot is physically impossible unless one or both existing
buildings are removed. Additionally, the cost of creating an engineering design, and constructing four
code-compliant parking spaces on the lot is beyond the means of the museum and would create
unnecessary hardsh ip.
Additional information:
KMM has been unable to find a surveyor in town who can provide an as-built survey, and the cost
involved for an out-of-town surveyor is beyond the current financial resources of KMM. Costs for
engineering design and construction of a code complaint four-space parking lot are similarly beyond the
means of the museum. Devotingthe time and administrative resourcesto raisingthe moneyand
constructing a fourspace parking lot would prevent the museum from meeting ats mission "to
recognize, preserve, and interpret Alaska's maritime history."

The variance would allow two on-site parking spaces and two off-site street parking spaces on nearby
public streets. Available parking on nearby streets is underutilized and occasional use of two street
parking spaces near the museum would not materially damage or prejudice other properties in the
vicinity or be detrimentalto the public's health, safety or general welfare.

The building at 215 Mill Bay Rd., will be used as administrative space with one staff person. Because the
museum's exhibit space is located off-site, we expect few visitors to arrive by car. We expect cruise ship
visitors seeking information to arrive by foot from the tourist bus stop at the ferry dock.

4. That the grandng of the variance will not be contrary to the obiectives of the comprehensive plan;
The proposed variance would align with the Borough's 2008 Updated Comprehensive Plan Soal (page
309) to "Enhance the Visitor lndustry's role as a significant component of the Kodiak Region'! economy,"
to "support efforts to the development of a Maritime/Fisheries Museum." 0enying the variance would
prevent or signi6cantly delay that goal from being achieved.

information by September 5h at 5 p.m. at the latest. lf CDD does not receive the new
applicatron by that date, your case will be pushed back to November.
lf for some reason you don't think you can get me the new request by the above-
mentioned date, let us know and we can postpone this case to a date uncertain.
Meaning when you get back to complete and submit the new variance application, we

l've been out fishing and just revisited these emails and see that the date for

Borough Code Section 17.175.040 httos://kodiakisland.boroueh.codes/KIBC/17.175.040 does not
specify parking requirements for museums. ln lieu of specific parking requirements, P&Z is using a 1994
agreement with the Alutiiq Museum as a template to require KMM to provide one on-site parking space
for every 300 square feet of museum building floor space. (See attached Joe Grochmul 8/19/2024 email,
and January 21, 1994 Memorandum between KIB Planner Duane Dvorak and Natives of Kodiak Office
Building and Museum)
The Kodiak History Museum has no parking requirement, apparently because it existed before the
Borough enacted a parking code.
Using the 1994 Alutiiq Museum template, the Borough is requiring four on-site parking spaces for KMM's

square foot storage building space on the property. This totals five required on-site parking spaces.
A variance would allow the museum to operate immediately with three existing parkinB spaces on the
property and two off-site spaces, using nearby public street parking.

Unlike its neighbors, KMM plans to use the main building at 215 Mill Bay Rd as museum administrative

Addltlonal information:
The building at 215 Mill Bay Rd., will be used as administrative space with one staff person. Because the
museum's exhibit space is located off-site, we expect few visitors to arrive by car. We expect cruise ship
visitors seeking information to arrive by foot from the tourist bus stop at the ferry dock.
The maritime museum's exhibit space is currently in the downtown outdoor harbor area and
occasionally at the Kodiak History Museum temporary exhibit gallery. KMM is also working with the City
of Kodiak to create a future indoor exhibit space in the downtown area.
2. That the strict application of the provisions of this title would result in practical difficultbs or
unnecessary hardship;
Meeting a five-space on-site parking requirement would involve hiring a surveyor to provide an as-built
survey to determine lot lines and setbacks, an engineering design, and construction of a code compliant
parking lot. The expense and effort of such a project is beyond the means of the museum.
Additional information:
KMM has been unable to find a surveyor in town who can provide an as-built survey, and the cost
involved for an out of town surveyor is beyond the current financial resources of KMM. Costs for an
engineering design and construction are similarly beyond the means ofthe museum. Devoting the time
and administrative resources to raise the money and construct a parking lot would prevent the museum
from accomplishing other proiects related to its mission.
KMM also plans to use the outdoor space behind the main building at 215 Mill Bay Rd. to store a small
but historically important wooden fishing boat. A parking lot in the backyard would prevent the museum
from storing this vessel.
The variance would require three on-site spaces, which are also required on neighboring residential
properties, (Borough code 17.175.040) and allow two off-site parking spaces in public parking in nearby
streets. The variance would not detract from other properties in the vicinity, or be detrimental to the
public's health, safety or general welfare.
4. That the tranting of the variance will not be contrary to the obiectives of the comprehensive plan;
The proposed variance would align with the Borough's Comprehensive Plan goal to "Enhance the Visitor
lndustvs role as a significant component of the Kodiak Region's economy," by "Support(ing) efforts to
the development of a Maritime/Fisheries Museum." Denying the variance would prevent or significantly
delay that goal from being achieved.

It was a pleasure speaking with you eadier Following up on our conversation, l'm writing to share how our department
reached its conclusion regarding parking requirements for the proposed Kodiak Maritime Museum.
Section 17.175 ofthe Kodiak lsland Borough Code does not specify parking requirements for museums, although seclion
17.175.040 b. states that "ltlhe off-street parking requirement for a use not specified in this seclion shall be the
requirement for the use specified in this seclion whose parking demand characleristics the community development
department delermines lo be most similar to those of the unspecified use.' To define the requirements for the Maritime
Museum, we used the parking requirements that the department previously set for the Alutiiq Museum. Using this
precedent, vye determined that the parking requirement would be one space for every 300 square foet of museum space
and one space for every 1,000 squale feet defined as b€ing storage^,r,/arehouse space. I have attached a document from
the Alutiiq Museum's case that lays out its requirements.
As you're aware, Gerry or an eligible, authorized representative can apply for a variance to ad.iust these terms if hen the
proposed rezone is approved. lf an authorized representative were to take such a course of ac{ion, you would follow the
procedure laid oul in KIBC 17.195. Specifically, the authorized agent would complete and submit an application for a
variance (see attached) to our department along with the required fee. Once the application has been received and
signed off on by Community Development, staff will review it and place it on the next eligible Planning and Zoning
Commission agenda. This process would then roll out in a manner similar to Gerry's rezoning case: our department would
send out public comment forms to all neighbors within 500 feet of the sub.iecl parc,els, Gerry would display a new "notice
of public meeting' sign, there would be a Work Session hearing, and finally there would be a Regular Meeting where a
decision would be voted on and made by the Planning Commission. At the Planning and Zoning Commission meeting,
they will use the criteria laid out in KIBC '17.195.050 as to determine whether to approve or deny the request.

Museum.
After reviewing the letter and plans submitted on Jan. 18, 1994, stalf has
determined that a I parldng space per 3OO square foot gross floor area
calculation is acceptable for the designated museum and related spaces in the
proposed ollice building. A letter tndicatlng this as the established standard
in the Municipality of Anchorage is adequate documentation to determine
that this standard will also provlde for adequate parking tn Kodiak. This
standard is similar to the ofllce and retail parldng crlculation ln Borough
Code and a stall determination of similar padidng demand is permttted by
Section f7.576.O1O.8 KIBC. Staff notes that tils calculauon is consistent
with the parking requlrement for the bulk of the structure which is idendfied
for ofllce use.
Stalf has also determined that the designated storage areas are similar in use
and parking demand to a warehouse designation under Section L7.57.O4O of
the Borough Code. Anticipated trtp and parldng generation, uulity demands,
phystcal space needs, etc., clearly set these a.reas apa.rt from the use of the
other areas of the structure. The appllcant has indlcated that these areas will
be climate controUed to permit the storage of artifacts and exhibit items, as
well as long term storage of archival material. The New Illustrated Book of
Development Definitions deflnes a warehouse use as follows:
"A building used primarily for the storage of goods and materials" In
further discussion, the book disungluishes between long-term storage
and short-term storage saying that short term storage faclllues that are
operated by a specific commercial establishment do not fall under the
commonly accepeted deflnition of warehouse.

This determinadon places certain limltadons on the use of the storage space
idenUfled on the building plans submitted on Jan. f8, f994, for the Natives of
Kodiak Professional Oflice Buildtng. Areas ldentifled as storage will only be
permitted for storage use unless addidonal parldng is provided to support
alternauve uses. Storage areas may not be used as support areas for the
oflice or retail functlons established elsewhere in the structure. This means
that no storage space can be allocated for ongoing work functions or the
stationing of personnel for uses that would be classified differently for parking
purposes. Some examples of how the storage space can and cannot be used
are as follows:
l) The space can be used for arttfact storage.
The space cannot be used for the storage ofgift shop inventory as
this supports the retait use of the structure.
The space can be used for long term storage of archival material
and "dead" files.
The space cannot be used for the storage of active files that
require rou ne access.
These examples are for lllustradve purposes only and should not be
construed to be a complete list of permitted and prohibited uses.
It should also be noted that the storage area cannot be easily reclassilled for
parldng purposes if the applicant wishes to expand the museum, olllce or
other use inslde the structure. The present parldng plan shows only I extra
parking space and expansion or change ofuses that would require addiUonal
parking would only be permitted if adequate addiUonal parldng is provided.
Since the applicant has been made aware from the outset how these
limitauons will apply to the proposed project, staJf will issue the zoning
compliance urith t parldng space per IOOO square feet of storage area as
identifled on the parldng plan recelved Jan. 18, f994.
