SUBJECT: Proclamation Recognizing April As Second Chance Month

RECOMMENDATION:
Mayor Griffin to proclaim the month of April 2026 as Second Chance Month.
DISCUSSION:
April has been designated as Second Chance Month every year since 2017. This
proclamation aims to highlight the reentry difficulties encountered by millions of
Americans with criminal records. By adopting this proclamation, the Kodiak Island
Borough would join a rising national initiative and convey a strong message of hope to
those striving to reconstruct their lives. It also recognizes the commitment of local
organizations, volunteers, and partners who diligently support reentry efforts and
enhance community safety.

DECLARING APRIL AS SECOND CHANCE MONTH
WHEREAS, Across the nation, Second Chance Month serves as a vital
opportunity to highlight the challenges faced by individuals returning to their
communities after incarceration and to promote pathways that support successful
reintegration; and
WHEREAS, Second Chance Month recognizes the dignity, potential, and
humanity of individuals returning from incarceration; and
WHEREAS, Every year, countless individuals finish their sentences and strive to
reconstruct their lives. Many come back filled with determination and hope, but
they face considerable obstacles —restricted access to housing, jobs, education,
transportation, and vital services —that can impede their progress.
WHEREAS, Here in the Kodiak Island Borough, these challenges are often
magnified by geographic isolation, limited resources, and the high cost of living;
and
NOW, THEREFORE, I, Jared Griffin, Mayor of the Kodiak Island Borough, do
hereby proclaim the month of April 2026 as Second Chance Month in Kodiak
and recognize the dignity, potential, and humanity of individuals returning from
incarceration, and further acknowledge the dedication of local organizations,
volunteers, and partners who work tirelessly to support reentry and strengthen
community safety.

SUBJECT: Ordinance No. FY2026-20, Rezoning Ouzinkie Block 3 Lot 2 (2209 Second
Street) From R1 Single Family Residential District To B Business District

RECOMMENDATION:
Move to adopt Ordinance No. FY2026-20.
DISCUSSION:
The Planning & Zoning Commission held a public hearing on this rezone request on February
18, 2026. The Commission voted 5 to 0 with one member absent and one vacant position to
forward a recommendation of approval to the Borough Assembly.
The Native Village of Ouzinkie submitted the rezone application for the subject property to
allow the existing structure on the property to be converted to a childcare center on the first
floor and two vacation home units on the second floor. The B Business District is needed to
permit the residential units and the childcare center. The future land use map designation for
this subject parcel is for public use; however, the PL Public Use Land District does not allow
residential units. Community Development staff reviewed the request and determined that the
proposed rezone would meet the requirements of Title 17 and the 2008 Comprehensive Plan
for the following reasons.
1. The proposed rezone is needed to permit the property to be used for both the childcare
center and vacation home uses; the B Business District is the most appropriate zoning district
to permit both uses.
2. The proposed rezone does not conform with the future land use map designation of public
use; the proposed B Business District is compatible with the surrounding area and the mixed-
use/commercial future land use map designation immediately to the east of the subject
parcel.
3. The 1984 Ouzinkie Comprehensive Plan document was used in the development of the
2008 Comprehensive Plan; this plan recommends that residential areas should allow non -
conflicting uses, such as government, churches, health services, and neighborhood parks.
The proposed uses for the subject parcel are considered non -conflicting or compatible uses in
accordance with best planning practices.
Since this rezone includes a change to the future land use map designation for the subject
parcel, the proposed rezone ordinance includes a section that would change the future land
use map designation from public use to mixed-use/commercial.

On March 20, 2026, the Borough Clerk's Office sent out 71 public hearing notifications. Any
forms that are returned will be distributed to the Assembly.

AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH REZONING
OUZINKIE BLOCK 3 LOT 2 (2209 SECOND STREET) FROM RI —SINGLE FAMILY
RESIDENTIAL DISTRICT TO B—BUSINESS DISTRICT
WHEREAS, as a second-class borough, the Kodiak Island Borough exercises planning,
platting, and land use regulations on an area -wide basis pursuant to A.S. Chapter 29.40; and
WHEREAS, the 1984 Ouzinkie Comprehensive Plan was included in the development of the
2008 Comprehensive Plan; and
WHEREAS, the borough adopted, by ordinance, a comprehensive plan identified in KIBC
17.10.030, most recently amended by Ordinance FY2020-06 (the 2008 Comprehensive Plan);
and
WHEREAS, KIBC 17.205.010 provides that "Whenever the public necessity, convenience,
general welfare or good zoning practice requires, the assembly may, by ordinance and after report
thereon by the commission and public hearing as required by law, amend, supplement, modify,
repeal or otherwise change these regulations and the boundaries of the districts"; and
WHEREAS, the Native Village of Ouzinkie submitted the rezone request in order to convert the
existing building on the subject property to a childcare center on the first floor and two vacation
home units on the second floor; and
WHEREAS, the Planning & Zoning Commission at a public hearing on February 18, 2026,
approved Resolution No. FY2026-015, recommending approval of the rezone request from R1—
Single Family Residential to B-Business District; and
WHEREAS, after reviewing the facts and circumstances, the testimony, and the
recommendation of the Planning & Zoning Commission, the Kodiak Island Borough Assembly
finds, pursuant to Kodiak Island Borough Code 17.205.060, the public necessity, convenience,
general welfare, and good zoning practices support approval of the rezone request; and
WHEREAS, KIBC17.205.075(A) calls for an ordinance approving a rezoning such as this, which
is not consistent with the assigned comprehensive plan future land use designation, to include a
change to the comprehensive plan future land use designation that is consistent with the new
zoning; and
WHEREAS, KIBC17.205.075(C) calls for a rezoning ordinance to include a section which
specifies the newly assigned comprehensive plan future land use designation of the rezoned
parcel.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that:
Section 1: This ordinance is not of a general and permanent nature and shall not become a part
of the Kodiak Island Borough Code of Ordinances.

Family Residential to B — Business District.
Section 3: By this ordinance, pursuant to KIBC 17.205.075, the Borough Assembly changes the
future land use map designation for the subject property from Public Use to Mixed
Use/Commercial on the future land use map of the Kodiak Island Borough and shall
become effective upon the effective date of this ordinance.
Section 4: By this ordinance, the Borough Assembly adopts the following findings in support of
its approval of this rezone.
The proposed rezone is needed to permit the property to be used for a childcare
center for vacation homes; both uses are permitted within the proposed B —
Business District.
The proposed rezone although not in conformance with the future land use map
designation of public use in the 2008 comprehensive plan the proposed B —
Business Zone is compatible to the surrounding area and the mixed
use/commercial future land use map designation of the properties to the east of
the subject property.
The 1984 Ouzinkie Comprehensive Plan document was used in the development
of the 2008 comprehensive plan, that plan stated that residential areas, "... allow
non -conflicting uses, such as government, churches, health services and
neighborhood parks." Best planning practices consider childcare uses as
compatible uses to residential areas.
Effective Date: This ordinance takes effect upon adoption.

45 2008 Comprehensive Plan for the City of Ouzinkie; and

47 WHEREAS, at an advertised public hearing, consistent with KIBC 17.205.040, the Commission
48 considered the merits of the rezone request on February 18, 2026, and recommends approval of
49 the rezone request based upon findings, satisfying the requirements for Commission review in
50 KIBC Chapter 17.205 before sending the proposed rezone to the Assembly for consideration.

52 NOW, THEREFORE, IN CONSIDERATION OF THE ABOVE FINDINGS, IT IS RESOLVED BY
53 THE PLANNING & ZONING COMMISSION OF THE KODIAK ISLAND BOROUGH AS

56 Section 1: The rezone request for Ouzinkie Block 3 Lot 2 from R1 — Single Family Residential
57 District to B — Business District is hereby recommended for approval by the Kodiak Island Borough
58 Planning & Zoning Commission to the Borough Assembly.

60 Section 2: Pursuant to KIBC 17.205.075, the Commission recommends to the Borough Assembly
61 that the future land use designation for the subject property be changed from Public Use to Mixed
62 Use/Commercial on the official zoning map and the future land use map of the Kodiak Island
63 Borough and shall become effective upon the effective date of this ordinance.

65 Section 3: The approval of this resolution by the Planning & Zoning Commission is based on the
66 following Findings of Fact in support of its approval of this rezone.

4871 (648 G Street) From R1 Single Family Residential District To PL Public
Use Lands District

RECOMMENDATION:
Move to adopt Ordinance No. FY2026-21.
DISCUSSION:
The Planning & Zoning Commission held a public hearing on the proposed rezoning on
February 18, 2026. The Commission voted 5 to 0 with one member absent and one vacant
position to recommend approval to the Borough Assembly.
The Native Village of Ouzinkie submitted the rezone application in order to complete the
newly constructed building on the subject property. This proposed PL District would permit the
building to be used for public service uses such as a wellness center, community education
assistance, and counseling services. The building will not be used for residential purposes.
The future land use map designation for this property is industrial. This property was once a
part of the old airport property. The 2008 Comprehensive Plan designated the old airport site
for industrial. A new airport was developed years later, which left the old airport site unused.
The subject property was created recently to allow for the construction of the new building on
the site. Therefore, the current industrial designation would not be appropriate for the subject
property. In fact, the subject property does appear to be compatible with other uses to the
west, which include other public service uses. Community Development staff reviewed the
rezone request and developed the following findings in support of the rezone request.
1. The proposed use of the structure on the subject parcel is for public use, such as a
wellness center and community center. These land uses require the rezoning to the
PL District.
2. The future land use map designation for the subject property should be changed from
industrial to public use because the subject property was subdivided from the old
airport property, and the existing structure and proposed uses are in conformance with
the public use designation and with other public use designated properties across F
Street.
3. The proposed rezone is in conformance with the 2008 Comprehensive Plan because
the policies within the local government chapter of the plan for Ouzinkie promote
public health and wellness initiatives for the community.
The proposed rezone ordinance includes a section that would change the future land use
map designation of the subject parcel from Industrial to Public Use.

OUZINKIE TRACT C BLOCK 1 PARCEL 1 USS 4871 (648 G STREET) FROM 1111—SINGLE
FAMILY RESIDENTIAL DISTRICT TO PL—PUBLIC USE LANDS DISTRICT
WHEREAS, as a second-class borough, the Kodiak Island Borough exercises planning,
platting, and land use regulations on an area -wide basis pursuant to A.S. Chapter 29.40; and
WHEREAS, the 1984 Ouzinkie Comprehensive Plan was included in the development of the
2008 Comprehensive Plan; and
WHEREAS, the borough adopted, by ordinance, a comprehensive plan identified in KIBC
17.10.030, most recently amended by Ordinance No. FY2020-06 (the 2008 Comprehensive
Plan); and
WHEREAS, KIBC 17.205.010 provides that "Whenever the public necessity, convenience,
general welfare or good zoning practice requires, the assembly may, by ordinance and after report
thereon by the commission and public hearing as required by law, amend, supplement, modify,
repeal or otherwise change these regulations and the boundaries of the districts"; and
WHEREAS, the Native Village of Ouzinkie submitted the rezone request in order to complete
the existing building on the subject property and to allow it to be used for a multi -use building that
includes a wellness center and other community service uses; and
WHEREAS, the Planning & Zoning Commission at a public hearing on February 18, 2026,
approved Resolution No. FY2026-016, recommending approval of the rezone request from R1—
Single Family Residential to PL—Public Use Lands District; and
WHEREAS, after reviewing the facts and circumstances, the testimony, the recommendation
of the Planning & Zoning Commission, the Kodiak Island Borough Assembly finds, pursuant to
Kodiak Island Borough Code 17.205.060, the public necessity, convenience, general welfare, and
good zoning practices support approval of the rezone request; and
WHEREAS, KIBC 17.205.075(A) calls for an ordinance approving a rezoning such as this,
which is not consistent with the assigned comprehensive plan future land use designation, to
include a change to the comprehensive plan future land use designation that is consistent with
the new zoning; and
WHEREAS, KIBC 17.205.075(C) calls for a rezoning ordinance to include a section which
specifies the newly assigned comprehensive plan future land use designation of the rezoned
parcel.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that:
Section 1: This ordinance is not of a general and permanent nature and shall not become a part
of the Kodiak Island Borough Code of Ordinances.

Section 3: By this ordinance, pursuant to KIBC 17.205.075, the Borough Assembly changes the
future land use map designation for the subject property from Public Use to Mixed
Use/Commercial on the comprehensive plan future land use map of the Kodiak Island
Borough and shall become effective upon the effective date of this ordinance.
Section 4: By this ordinance, the Borough Assembly adopts the following findings in support of
its approval of this rezone.
The proposed use of the structure on the subject parcel is for public use such as
a wellness center and community center. These land uses require the rezone to
Public Use Land (PL) District.

Ouzinkie to promote public health and wellness initiatives; and

WHEREAS, at an advertised public hearing, consistent with KIBC 17.205.040, the Commission
considered the merits of the rezone request on February 18, 2026, and recommends approval of
the rezone request based upon findings, satisfying the requirements for Commission review in
KIBC Chapter 17.205 before sending the proposed rezone to the Assembly for consideration.
NOW, THEREFORE, IN CONSIDERATION OF THE ABOVE FINDINGS, IT IS RESOLVED BY
THE PLANNING & ZONING COMMISSION OF THE KODIAK ISLAND BOROUGH AS
FOLLOWS:
Section 1: The rezone request for Ouzinkie Tract C Block 1 Parcel 1 USS 4871 from R1 — Single
Family Residential District to PL — Public Use Lands District is hereby recommended for approval
by the Kodiak Island Borough Planning & Zoning Commission to the Borough Assembly.
Section 2: Pursuant to KIBC 17.205.075, the Commission recommends to the Borough Assembly
that the future land use designation for the subject property be changed from Industrial to Public
Use on the official zoning map and the future land use map of the Kodiak Island Borough and
shall become effective upon the effective date of this ordinance.
Section 3: The approval of this resolution by the Planning & Zoning Commission is based on the
following Findings of Fact in support of its approval of this rezone.
1. The proposed use of the structure on the subject parcel is for public use such
as a wellness center and community center. These land uses require the
rezone to Public Use Land (PL) District.
2. The future land use map designation for the subject property should be
changed from industrial to public use because the subject property was
subdivided from the old airport property and the existing structure and
proposed uses are in line with the public use designation and the public use
designation of this property is compatible with other public use designated
properties across F Street.
3. The proposed rezone is in conformance with the 2008 Comprehensive Plan
because it meets policies within the local government chapter of the plan for

SUBJECT: Ordinance No. FY2026-22, Rezoning Ouzinkie Block 14 Lot 7 (3525 Third
Street) From R2 Two Family Residential District to PL Public Use Lands
District

RECOMMENDATION:
Move to adopt Ordinance No. FY2026-22.
DISCUSSION:
The Planning & Zoning Commission held a public hearing on the proposed rezoning on
February 18, 2026. The Commission voted 5 to 0 with one member absent and one vacant
position to recommend approval of the rezoning to the Borough Assembly. The Native Village
of Ouzinkie submitted the rezoning application to bring the uses of the existing building into
compliance with the zoning code. The future land use map of the 2008 Comprehensive Plan
designates the subject parcel for public use. Therefore, the proposed rezoning to the PL
District is in conformance with the future land use map.
Community Development staff reviewed the rezoning request and developed the following
findings in support of the rezoning.
The rezone would not adversely impact the aesthetic and character of the surrounding
parcels because to the North and East are non-residential uses.
1. The rezone is consistent with the 2008 Comprehensive Plan because the proposal is
in conformance with the future land use map designation.
2. The rezone is consistent with the 1984 City of Ouzinkie Comprehensive Development
Plan because the proposal is in conformance with the development goal, "to upgrade
the living environment in the community to allow the provision of a higher level of basic
community services and infrastructure, such as housing, community facilities, and..."
The proposed rezone would support this goal since the existing building is currently
used as a community facility.

be accessed from the following link: Case 26-013. On March 20, 2026, the Borough Clerk's
Office sent out 71 public hearing notifications. Any forms that are returned will be distributed
to the Assembly.

AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH REZONING
OUZINKIE BLOCK 14 LOT 7 (3525 THIRD STREET) FROM R2—TWO-FAMILY RESIDENTIAL
DISTRICT TO PL—PUBLIC USE LANDS DISTRICT
WHEREAS, as a second-class borough, the Kodiak Island Borough exercises planning,
platting, and land use regulations on an area -wide basis pursuant to A.S. Chapter 29.40; and
WHEREAS, the 1984 Ouzinkie Comprehensive Plan was included in the development of the
2008 Comprehensive Plan; and
WHEREAS, the borough adopted, by ordinance, a comprehensive plan identified in KIBC
17.10.030, most recently amended by Ordinance No. FY2020-06 (the 2008 Comprehensive
Plan); and
WHEREAS, KIBC 17.205.010 provides that "Whenever the public necessity, convenience,
general welfare or good zoning practice requires, the assembly may, by ordinance and after report
thereon by the commission and public hearing as required by law, amend, supplement, modify,
repeal or otherwise change these regulations and the boundaries of the districts"; and
WHEREAS, the Native Village of Ouzinkie submitted the rezone request in order to permit the
current uses of the existing building on the property; and
WHEREAS, the Planning & Zoning Commission at a public hearing on February 18, 2026,
approved Resolution No. FY2026-17, recommending approval of the rezone request from R2—
Two- Family Residential to PL—Public Use Lands District; and
WHEREAS, after reviewing the facts and circumstances, the testimony, the recommendation
of the Planning & Zoning Commission, the Kodiak Island Borough Assembly finds, pursuant to
KIBC17.205.060, the public necessity, convenience, general welfare, and good zoning practices
support approval of the rezone request; and
WHEREAS, the proposed PL District is in conformance with the comprehensive plan future land
use map designation of public use; therefore, the requested rezoning is in conformance with the
2008 comprehensive plan.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that:
Section 1: This ordinance is not of a general and permanent nature and shall not become a part
of the Kodiak Island Borough Code of Ordinances.

WHEREAS, as a second-class borough, the Kodiak Island Borough exercises planning,

WHEREAS, the Commission finds that the rezoning, would not adversely impact the aesthetic
and character of the surrounding parcels and their uses because the lots located to the North and
East of the subject parcel have non-residential uses and
WHEREAS, the Commission finds that rezoning this parcel, is consistent with the development
goal that states, "to upgrade the living environment in the community to allow the provision of a
higher level of basic community services and infrastructure, such as housing, community facilities,
and...", as stated within the 1984 Ouzinkie Development Plan; and
WHEREAS, the Commission finds that the rezone, is consistent with the 2008 Comprehensive
Plan because the Future Land Use Map designates this property as public use; and
WHEREAS, at an advertised public hearing, consistent with KIBC 17.205.040, the Commission
considered the merits of the rezone request on February 18, 2026, and recommends approval of

KIBC Chapter 17.205 before sending the proposed rezone to the Assembly for consideration.
NOW, THEREFORE, IN CONSIDERATION OF THE ABOVE FINDINGS, IT IS RESOLVED BY
THE PLANNING & ZONING COMMISSION OF THE KODIAK ISLAND BOROUGH AS
FOLLOWS:
Section 1: The rezone request for Ouzinkie Block 14, Lot 7, from R2 — Two -Family Residential
District to PL — Public Use Lands District, is hereby recommended for approval by the Kodiak
Island Borough Planning & Zoning Commission to the Borough Assembly.
Section 2: The approval of this resolution by the Planning & Zoning Commission is based on the
following Findings of Fact in support of its approval of this rezone.
1. The character or aesthetic would not be adversely affected by the rezone
because to the North and East are non-residential uses.
2. The rezone is consistent with the development goal that states, "to upgrade
the living environment in the community to allow the provision of a higher
level of basic community services and infrastructure, such as housing,
community facilities, and...", as stated within the 1984 Ouzinkie Development

Finance Department
2025 Tax Foreclosures
Staff will be filing for a Judgement and Decree of Foreclosure with the courts on or
about April 13th. Once signed, the Judgement will put a lien on real properties until the
delinquent taxes are paid. Since additional interest and fees continue to accrue, please
call the finance department at 907-486-9324 for payoff amounts.
Property Assessment and Taxation Implementation Project
Staff will continue entering and verifying information in both the new and legacy tax
collection systems. This dual entry is planned through June to ensure accurate payment
postings, proper levy processing, and the accurate production of tax statements.
Information Technology
Systems Administration
The IT department has completed the setup of a public facing Laserfiche Forms server and
has begun working with the Clerks team to create a publicly available form. We have also
begun the installation and configuration of a test ProxMox virtualization cluster to evaluate
its suitability as a replacement for the current KIB Vmware systems due to licensing costs
increases.
Cybersecurity and Risk Mitigation
IT has been providing Koniag Cyber our systems documentation in preparation for the KIB
Cybersecurity Infrastructure project. We have also remediated vulnerability in our DMZ, as
well as been reviewing the results of vulnerability scans of our network.
GIs
GIS has created multiple notification maps for the Clerks and Community Development
about Rezones, fulfilled an Engineering and Facilities request for a map of the Bay View

service area, and has assisted Community Development with questions they had about
data for their Comprehensive Plan.
Assessingi
Liquor License Investigations
Assessing staff are investigating the Safeway license renewal for the Clerk's Office
Senior Citizen (SC) / Disabled Veteran (DV) Exemptions (2026)
Good cause exemption hearings have been scheduled to be heard by the Assembly on
May 21, 2026.
"Escaped" Properties
Assessing found properties with zero values for a specific area of improvement. Code
allows for Assessing to make corrections for errors or omissions in the roll before the
BOE hearing. Those properties were recalculated and re -noticed. Those specific
properties will have an extended appeal date of April 17, 2026, with a special BOE
session convening, if required.
Notice of Value Appeals — March 2026
• As of March 31 -
o Approximately 1050 calls and/or in person visits were handled by staff.
0 160 Notice of Value "values" were updated without need to go to the BOE.
0 29 requests for application to appeal to the BOE were made.
0 26 appeals were timely filed. (25 of them were calls/in person visits that
occurred for the first time on March 31). This includes two properties that
were considered escaped, that we are trying to include in the May 5th BOE
hearing.
Exemption Appeals
The Alutiiq Heritage Foundation - Trial scheduled for July 27-29, 2026.
AHF filed for and was granted an extension on their reply until April 29.
KIB will have 10 days after they file to request oral arguments.
2025 decision reconsideration on hold by Assessor until the above
2024 Superior Court decision is complete
Tyler Conversion
Assessing, IT, Finance and Tyler representatives met to discuss the terms for updating
software to address software issues and next steps for go live. This is considered a
change order by Tyler. Tyler staff is looking into updating the terms on two issues KIB
staff asked for. Tyler will present an updated plan by the middle of next week.

Community Development
Planning & Zoning Commission Work Session
The Planning & Zoning Commission will hold a work session on April 8, 2026, at 6:30
PM in the Assembly Chambers. This meeting will continue to discuss public hearing
notices. In addition, the Commission will do a packet review that will focus on the
proposed Angayuk Subdivision, a 25-lot subdivision proposed by the Kodiak Island
Housing Authority off of Selief Lane.
Code Enforcement Officer
Casey Anderson, the new code enforcement officer, started work on April 1, 2026. His
first month on the job will focus on training and getting up to speed on the duties of the
position.
Liquor License Investigations
CDD staff are investigating the Safeway license renewal for the Clerk's Office.
Engineering and Facilities
Solid Waste Contract Committee
Staff are revising a draft to proposed to the SWCC at the next meeting which is
scheduled for April 14th at 3:OOpm in the KIB Conference Room
Community Clean -Up Day
The annual spring clean-up day is scheduled for May 2nd.
Multi -Facility Elevator Modernization
PKIMC Elevator parts have all arrived on -island. Staff are anticipating work to begin the
week of April 13th.
Community Pool
• The Assembly approved the contract for the small-scale deconstructive testing
and repairs in the lifeguard office. The contract has been signed and staff will
begin scheduling as time allows.
• Evaluation of water levels: Staff are still working with the City and the School
District to conduct additional testing to see if the pool has any structural issues.
Fuel Spill Assistance
Landfill Soil Remediation: Approved and awaiting signed contracts.

Long Term Care: Staff received Assembly approval to move forward with the contract
with NWFF for the field work to satisfy ADEC's requirements.
Karluk: 3-TierAlaska is beginning to schedule trips. Staff are anticipating more
movement in May or June.
KFRC
Industrial Pump Alaska (IPA) has installed pumps 3 & 4, however, the shafts have been
found to be too short. IPA and KIB have discussed a plan for how to remedy the length
issue. IPA will be submitting a change order for the additional materials required to
extend the pumps.
Small Projects
Picnic Table Replacement: The contract has been signed, and a meeting was held to
begin coordinating with the contractor.
Harlequin Court Park Upgrades: Projects Staff attended the Parks & Rec Committee
meeting on January 27 to discuss potential park upgrades. Harlequin Court Park was
identified as park needing the next set of upgrades.
Port Lions School Painting Project: Staff have received and will present updated
information regarding the paint that ARB Board requested.
Annex Bldg. (old Red Cross) UST Removal: The ARB Board approved the drawings for
this project. Staff will be preparing and invitations to bid to advertise.
North Star Boiler Gun Replacement: Parts have arrived, and work will be scheduled to
start soon.
Landfill Used Oil Burner Replacement: The new unit and expansion tank have been fully
installed and inspected.
Mill Bay Beach Stairs and Picnic Table Replacement: Submittal phase is underway.
Additional design review was required, and the contractor submitted a new shop
drawing set. Staff approved and are now waiting for the ordering of materials.
Leachate Treatment Plant Citric Acid Dosing Skid Replacement
The replacement of the Skid will require additional work from electrical, plumbing, and
mechanical contractors. Projects Staff are reaching out to the Borough's contract
service providers to see if they will be able to assist.

DISCUSSION:
This is an annual resolution which certifies the Native Village of Karluk as an unincorporated
community of the Kodiak Island Borough and confirms they meet the Community Assistance
Program eligibility criteria established under AS 29.60.865 - AS 29.60.879 and 3 AAC
180.110.
The Assembly is certifying two of the State's programs criteria: a minimum population of 25
and that at least three of seven listed services are provided to residents. Documentation for
those two items are attached.
• The Department of Commerce, Community, and Economic Development (DCCED)
statement that they have determined the population of The Native Village of Karluk at
31 residents, and
• A signed Requirement and Certification Application from the Karluk IRA Tribal Council
indicating they provide three of the seven listed services.
ALTERNATIVES:
FISCAL IMPACT:
$0 fiscal impact to the Borough since this is pass through money from the the State of Alaska;
however, this will be an estimated $15,789 payment to the Native Village of Karluk.

A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH APPROVING
CERTAIN UNINCORPORATED COMMUNITIES AND THEIR RESPECTIVE NATIVE VILLAGE
COUNCIL AND/OR INCORPORATED NONPROFIT ENTITY FOR PARTICIPATION IN THE
FY2027 COMMUNITY ASSISTANCE PROGRAM
WHEREAS, AS 29.60.865 and 3 AAC 180.010 require the assembly of a borough or unified
municipality to adopt a resolution identifying those unincorporated communities located within
their municipal boundaries that the assembly determines meet the Community Assistance
Program eligibility criteria established under AS 29.60.865, AS 29.60.879, and 3 AAC 180.110;
and
WHEREAS, the unincorporated community has either a Native village council or incorporated
nonprofit entity that will agree to receive and spend the Community Assistance payment for the
public benefit of the unincorporated community; and
WHEREAS, the unincorporated community has 25 or more residents residing as a social unit;
and
WHEREAS, at least three of the following services; fire protection, emergency medical, water
and sewer, solid waste management, public road or ice road maintenance, public health, and
search and rescue; are generally available to all residents of the unincorporated community and
each of the three services, in any combination, are provided by one or more qualifying Native
village council or incorporated nonprofit entity or are substantially paid for by the residents of the
unincorporated community through taxes, charges, or assessments levied or authorized by the
borough or unified municipality.
NOW, THEREFORE, BE IT RESOLVED THAT the Assembly, by this resolution, hereby certifies
that the following unincorporated communities and their respective Native village council or
incorporated nonprofit entity are eligible for funding under the FY27 Community Assistance
Program.

Eligibility Requirements for Unincorporated Communities Located
Within Boroughs and Unified Municipalities
Alaska Statutes AS 29.60.865 - .879 and Alaska Administrative Code 3 AAC 180.010
Sec. 29.60.865. Eligibility requirements for reserves and communities.
(a) The department, with advice from the Department of Law, shall determine whether there is in each community
or reserve an incorporated nonprofit entity or a Native village council that will agree to receive and spend the
community assistance payment. If there is more than one qualified entity in a reserve or community in the unorganized
borough, the department shall pay the money to the entity that the department finds most qualified to receive and
spend the money on behalf of the reserve or community. The department may not make a community assistance
payment to a Native village council unless the council waives immunity from suit for claims arising out of activities of the
council related to the payment. A waiver of immunity from suit under this section must be on a form provided by the
Department of Law. If there is no qualified incorporated nonprofit entity or Native village council in a reserve or
community that is willing to receive the community assistance payment and use the payment on behalf of that reserve
or community, the payment for that reserve or community may not be paid. Neither this section nor any action taken
under it enlarges or diminishes the governmental authority or jurisdiction of a Native village council.
(b) The department may make a community assistance payment on behalf of a community in a borough or unified
municipality only to the municipality for payment by the municipality to an incorporated nonprofit entity or Native
village council that has been approved by the assembly and meets the requirements of (a) of this section. The
department shall have written evidence of the assembly approval. If there is more than one qualified entity in a
community in a borough or unified municipality, one of the entities may receive the entire payment, or the payment
may be shared between two or more of the qualified entities, as determined by the assembly.
(c) A community in a borough or unified municipality is eligible for a community assistance payment only if at least
three of the following services are generally available to all residents of the community and each of the three services, in
any combination, are provided by one or more qualifying incorporated nonprofit entities or a Native village council or
are substantially paid for by the residents of the community through taxes, charges, or assessments levied or authorized
by the borough or unified municipality:
(1) fire protection;
(2) emergency medical;
(3) water and sewer;
(4) solid waste management;
(5) public road or ice road maintenance;
(6) public health;
(7) search and rescue.
Sec. 29.60.879. Definitions.
In AS 29.60.850 - 29.60.879
(1) "community" means a place in the unorganized borough, in a borough, or in a unified municipality that is not
incorporated as a municipality, that is not a reserve, and in which 25 or more individuals reside as a social unit;
(2) "reserve" means a place that is organized under federal law as an Indian reserve that existed before enactment of 43
U.S.C. 1618(a) and is continued in existence under that subsection.

(b) In addition to making the certification and agreement on the form provided under (a) of this section,
a borough or unified municipality that will receive community assistance payments on behalf of communities
in the borough or unified municipality must
(1) submit to the department a resolution adopted by the assembly that clearly identifies
(A) the communities that the borough or unified municipality has determined
meet the eligibility criteria under AS 29.60.865, 29.60.879, and 3 AAC 180.110; and
(B) the village councilor incorporated nonprofit entity located within each
community listed under (A) of this paragraph that the borough or unified municipality has approved
as the recipient of the community assistance payment; and
(2) certify that at least three of the services required under AS 29.60.865 (c) are generally
available to all residents of the community.
(c) In addition to making the certification and agreement on the form provided under (a) of this section
and receiving any identification required under (b) of this section, a reserve or village council must submit to
the department a waiver of sovereign immunity in accordance with AS 29.60.865(a) and 3 AAC 180.130.

WHEREAS, staff requests the transfer of $92,934 from the General Fund fund balance to the
General Fund - Non Profit Funding department for additional nonprofit funding as approved by
Resolution FY2026-05; and
WHEREAS, staff requests the transfer of $120,000 from the Buildings & Grounds Fund to the
Capital Projects Fund — Annex Building UST Removal Project in order to comply with the State of
Alaska Department of Environmental Conservation for the removal of the underground storage
tank; and
WHEREAS, the Monashka Bay Road Service board requests the transfer of $50,000 from fund
balance for planned spring maintenance/construction projects; and
WHEREAS, staff requests the return of $785,750.09 from the Capital Projects Fund — Kodiak
Fisheries Research Center Decontamination Project to the Kodiak Fisheries Research Center
Fund (KFRC) due to a change in the scope of the project; and

SUBJECT: Ordinance No. FY2026-23, Accepting And Appropriating Funds From The
2020 Prince William Sound Pink And Coho Salmon Fisheries Disaster Relief
Distribution

RECOMMENDATION:
Move to advance Ordinance No. FY2026-23 to public hearing at the next regular meeting of
the Assembly.
DISCUSSION:
When a federal fishery disaster is declared, direct federal financial assistance may be
provided to fishing communities in the form of grants, direct payments, cooperative
agreements, loans, or contracts to help offset the economic loss associated with the event(s)
that led to the declared disaster. On May 9, 2023, the U.S. Secretary of Commerce made a
disaster determination for the Alaska Copper River/Prince William Sound Fishery. The
National Oceanic and Atmospheric Administration (NOAA) allocated $15,730,357 to address
losses to the affected management areas. The State of Alaska, in consultation with
stakeholders and NOAA's National Marine Fisheries Service, drafted a spend plan and
forwarded that plan to the Pacific States Marine Fisheries Commission (PSMFC), the
administrator of the federal grant for disaster funds.
Approximately $463,000 will be distributed pro rata to municipalities and boroughs based on
each community's demonstrated loss relative to the total loss of all eligible communities. The
Kodiak Island Borough has been notified that we are eligible for a payment of $11,595.50.
ALTERNATIVES:
Amend, postpone or fail the motion.
FISCAL IMPACT:
$11,595.50 increase to the Fisheries Economic Development fund.
OTHER INFORMATION:
KIBC 3.25.040(C) Grant funds which are unlimited as to use, or subject only to general
limitations, shall be appropriated by ordinance, which shall include an appropriate budget
amendment.

unlimited as to use or subject only to general limitations, be appropriated by ordinance and include
an appropriate budget amendment.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that:
Section 1: This ordinance is not of a general and permanent nature and shall not become a part

Section 2: The Kodiak Island Borough accepts the funds granted through the Pacific States

account for this $11,595.50 one-time payment.

disaster relief related to the 2020 Prince William Sound Pink and Coho Salmon disaster and are encouraged to

Your community is eligible to receive a one-time payment of $11,595.50
Eligibility criteria for community funds:
1. Pink and or Coho salmon from Prince William Sound must have been landed in the community in 2020,
based on the port of landing reported in ADF&G Fish Ticket data.
2. The estimated gross revenue value for those species landed in 2020 must be less than the five-year
average from 2015 to 2019.
Direct payments are being made to municipalities and boroughs based on the port of landing for Pink and
Coho salmon deliveries. These local governments rely on revenue from salmon landings and related fishery
activity. The state Fishery Business Tax is 3% on shore -based landings and is shared 50/50 between the state
and the municipality or borough where the landing occurs.
If landings occur within both a municipality and a borough, the local share is split 50/50 between them. Some
municipalities and boroughs also levy a local raw fish tax ranging from 2% to 3.5%, depending on location and
species.
—$463,000 will be distributed pro rata based on each eligible community's demonstrated loss relative to the
total loss of all eligible communities. If landings occurred in a community represented by both a municipality
and a borough, funds will be split 50/50 between them, consistent with the state Fishery Business Tax
methodology.
