AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH REZONING
OUZINKIE TRACT C BLOCK 1 PARCEL 1 USS 4871 (648 G STREET) FROM R1—SINGLE
FAMILY RESIDENTIAL DISTRICT TO PL—PUBLIC USE LANDS DISTRICT
WHEREAS, as a second-class borough, the Kodiak Island Borough exercises planning,
platting, and land use regulations on an area -wide basis pursuant to A.S. Chapter 29.40; and
WHEREAS, the 1984 Ouzinkie Comprehensive Plan was included in the development of the
2008 Comprehensive Plan; and
WHEREAS, the borough adopted, by ordinance, a comprehensive plan identified in KIBC
17.10.030, most recently amended by Ordinance No. FY2020-06 (the 2008 Comprehensive
Plan); and
WHEREAS, KIBC 17.205.010 provides that "Whenever the public necessity, convenience,
general welfare or good zoning practice requires, the assembly may, by ordinance and after report
thereon by the commission and public hearing as required by law, amend, supplement, modify,
repeal or otherwise change these regulations and the boundaries of the districts"; and
WHEREAS, the Native Village of Ouzinkie submitted the rezone request in order to complete
the existing building on the subject property and to allow it to be used for a multi -use building that
includes a wellness center and other community service uses; and
WHEREAS, the Planning & Zoning Commission at a public hearing on February 18, 2026,
approved Resolution No. FY2026-016, recommending approval of the rezone request from R1—
Single Family Residential to PL—Public Use Lands District; and
WHEREAS, after reviewing the facts and circumstances, the testimony, the recommendation
of the Planning & Zoning Commission, the Kodiak Island Borough Assembly finds, pursuant to
Kodiak Island Borough Code 17.205.060, the public necessity, convenience, general welfare, and
good zoning practices support approval of the rezone request; and
WHEREAS, KIBC 17.205.075(A) calls for an ordinance approving a rezoning such as this,
which is not consistent with the assigned comprehensive plan future land use designation, to
include a change to the comprehensive plan future land use designation that is consistent with
the new zoning; and
WHEREAS, KIBC 17.205.075(C) calls for a rezoning ordinance to include a section which
specifies the newly assigned comprehensive plan future land use designation of the rezoned
parcel.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that:
Section 1: This ordinance is not of a general and permanent nature and shall not become a part
of the Kodiak Island Borough Code of Ordinances.

Section 2: Ouzinkie Block 3 Lot 2 (2209 Second Street) is hereby rezoned from R1—Single Family
Residential to B — Business District.
Section 3: By this ordinance, pursuant to KIBC 17.205.075, the Borough Assembly changes the
future land use map designation for the subject property from Public Use to Mixed
Use/Commercial on the comprehensive plan future land use map of the Kodiak Island
Borough and shall become effective upon the effective date of this ordinance.
Section 4: By this ordinance, the Borough Assembly adopts the following findings in support of
its approval of this rezone.
1. The proposed use of the structure on the subject parcel is for public use such as
a wellness center and community center. These land uses require the rezone to
Public Use Land (PL) District.
2. The future land use map designation for the subject property should be changed
from industrial to public use because the subject property was subdivided from the
old airport property and the existing structure and proposed uses are in line with
the public use designation and the public use designation of this property is
compatible with other public use designated properties across F Street.
3. The proposed rezone is in conformance with the 2008 Comprehensive Plan
because it meets policies within the local government chapter of the plan for the
City of Ouzinkie to promote public health and wellness initiatives.
Effective Date: This ordinance takes effect upon adoption.
