Section 3: By this ordinance, pursuant to KIBC 17.205.075, the Borough Assembly changes the future land use map designation for the subject property from Public Use to Mixed Use/Commercial on the future land use map of the Kodiak Island Borough and shall become effective upon the effective date of this ordinance. Section 4: By this ordinance, the Borough Assembly adopts the following findings in support of its approval of this rezone. 1. The proposed rezone is needed to permit the property to be used for a childcare center for vacation homes; both uses are permitted within the proposed B — Business District. 2. The proposed rezone although not in conformance with the future land use map designation of public use in the 2008 comprehensive plan the proposed B — Business Zone is compatible to the surrounding area and the mixed use/commercial future land use map designation of the properties to the east of the subject property. 3. The 1984 Ouzinkie Comprehensive Plan document was used in the development of the 2008 comprehensive plan, that plan stated that residential areas, "... allow non -conflicting uses, such as government, churches, health services and neighborhood parks." Best planning practices consider childcare uses as compatible uses to residential areas. Effective Date: This ordinance takes effect upon adoption.
