Re: Zoning Compliance Application — Clarification of Residential Use
Dear Community Development Staff,
Please accept the attached zoning compliance materials for the referenced properties. I am including this brief
clarification regarding the language used in the application describing the use of the residential units.
The structures identified in the applications are residential dwelling units used for residential occupancy. The
descriptions provided in the application intentionally reflect the underlying residential nature of the properties.
Depending on circumstances, the units may be occupied by tenants or guests for varying durations. The duration
of occupancy does not change the fundamental residential use of the structures. In Kodiak Island Borough,
rentals for fewer than 30 consecutive days are considered transient accommodations for tax purposes, while
longer occupancies are treated as standard residential tenancies.
Because occupancy duration may vary over time, the application language reflects the residential use of the
dwellings rather than assigning a single tenancy category to the structures themselves.
For clarity, the properties included in the application are described as follows:
• 3155 Spruce Cape — Remaining an owner -occupied primary residence with an attached accessory dwelling
unit (ADU), both used for residential occupancy.
• 4197 Shoreline Circle - Five -unit property — Existing multifamily residential building containing five
dwelling units used for residential occupancy.
• 2889 Pruitt Lane Cabin — Existing residential cabin dwelling.
No change in the fundamental residential use of these structures is proposed. For clarity, the applications
submitted are intended to document the existing and continuing residential use of the properties. These
submissions reflect the current residential configuration and occupancy of the structures. The properties
remain residential in nature, and the applications are being provided in response to the Borough's
request for zoning compliance documentation.
