ASSEMBLY MEMBERS' COMMENTS • Assembly Member Smiley thanked everyone for last night's joint work session with the School Board, noting it went very well. He highlighted improved coordination between the Engineering and Facilities staff and the School District's maintenance team, and expressed hope that the School District, the Borough, and the City of Kodiak will continue working closely together for the benefit of the community. • Assembly Member Ames echoed Assembly Member Smiley's comments, noting improved cooperation between the Borough and the Kodiak Island Borough School District Board of Education. He emphasized the importance of working together given the overlapping KIB And KIBSD maintenance responsibilities. • Assembly Member Woods expressed appreciation for the growing collaboration among entities, noting improved teamwork among staff and better interactions with the city. He stated this reflects a positive direction and supports a more efficient way of doing business. • Assembly Member Whiteside echoed comments on last night's work session with the Kodiak Island Borough School District Board of Education. Javier, MMC, Borough Clerk RECOMMENDATION: DISCUSSION: Deputy Clerk Lina Cruz began working for the Borough in April 2019 and that is when her journey to become a certified municipal clerk started. She received her Certified Municipal Clerk (CM) designation on February 28, 2023, and that initial certification was no small feat; it required a deep dive into extensive education programs which were designed to sharpen the skills needed to serve a municipality. And Lina didn't stop there. She embarked on a challenging journey of advanced continuing education and professional contributions. On January 20, 2026, all her hard work paid off when Lina received the esteemed Master Municipal Clerk (MMC) designation. The MMC represents more than just a new certificate or a few additional letters after her name. It is the highest professional certification level awarded by the International Institute of Municipal Clerks (IIMC), indicating that a clerk has truly mastered the intricate administrative skills essential for governance. Below are examples of motions that may be used: Move to voice non -protest to the State of Alaska Alcohol and Marijuana Control Office (AMCO) beverage dispensary liquor license transfer of controlling interest for Kodiak Hana Restaurant and direct the Clerk to notify AMCO of this decision. DISCUSSION: This application is for a beverage dispensary liquor license transfer of controlling interest for License No. 4325, Kodiak Hana Restaurant, located at 516 E. Marine Way. A transfer of controlling interest occurs when the controlling interest of the entity changes. In this case, ownership is changing from 100% ownership by Tornio Demura (Director, President) to 50% Tornio Demura and 50% Fumiko Demura (Secretary, Treasurer, Director). In addition, Goon Cho is being added as Vice President and Director. Assessing Senior Citizen (SC) / Disabled Veteran (DV) Exemptions (2026) Good cause exemption hearings have been scheduled to be heard by the Assembly on May 21, 2026. Notice of Value Appeals — March 2026 • Protests of Notice of Valuation began March 1 and will run through March 31. • Notice of Value postcards were mailed on February 27, 2026. Community Development Planning & Zoning Commission The Planning & Zoning Commission held a regular meeting on March 18, 2026, to review a request for a rezoning under Case No. 26-014 the rezoning of 2593 Metrokin Way from R2 to PL, which is a rezone case submitted by the City of Kodiak needed for the construction of Lift Station Five. Meeting with City of Kodiak Public Works Community Development staff met with staff of the City of Kodiak Public Works Department to discuss public water and sewer capacity. Staff discussed the capacity of each system regarding potential Borough land sales, the comprehensive plan, and upcoming case reviews such as the Kodiak Island Housing Authority subdivision on Selief Lane. Public Works staff stated there is sufficient capacity for new development; however, some areas will need to have sewer lines extended to serve those areas. The Lift Station 5 project will address reliability issues with the public sewer system and will prevent discharges of raw sewage in Mission Lake. Public Works staff did mention the age of each system and the need for continued maintenance and replacement of lines. In addition, the issue of Inflow and Infiltration (I&I) was discussed and its negative impact on the sewer system. Engineering and Facilities Solid Waste Contract Committee The SWCC meeting has been rescheduled for March 24 at 3:00 p.m. Staff finished the draft of the Request for Proposals and provided it to the SWCC Board on February 27. Community Clean-P Up Day The annual spring clean-up day is scheduled for May 2nd Fuel Spill Assistance Landfill Soil Remediation: Contract approval on tonight's agenda. Long Term Care: Staff received Assembly approval to move forward with the contract with NWFF for the field work to satisfy ADEC's requirements. Landfill Landfill Scale Maintenance- Phillips Scale was at the landfill last weekend to perform maintenance on the scale. There were two -issues that kept them from completing a full maintenance cycle. 1) The jacks that were supposed to be there were not and 2) There was a large amount of ice underneath the scale. Despite the setbacks, the scale was calibrated. KFRC Industrial Pump Alaska (IPA) has installed pumps 3 & 4, however, the shafts have been found to be too short. IPA has submitted a plan and KIB will finish the review of the plan early next week when our projects staff is back in office. Small Projects Research Court Apartment Lift Station Repairs: Staff are still awaiting a part from Nodak to address some electrical control issues for pump #1. Port Lions School Emergency Fire Alarm Panel Replacement: Work began on -site on February 27. Projects Staff went out to conduct a site -visit on March 12. Harlequin Court Park Upgrades: Projects Staff attended the Parks & Rec Committee meeting on January 27 to discuss potential park upgrades. Harlequin Court Park was identified as park needing the next set of upgrades. Port Lions School Painting Protect: Staff visited the school to check on the progress of the Emergency Fire Alarm Panel Replacement Project and completed some testing to ensure that there was flashing behind the wood belly band going around the base of the school. The projected cost of $266,000 is expected to go down due to not having to replace the wood in the band. Annex Bldg. (old Red Cross) UST Removal: The ARB Board approved the drawings for this project. Staff will be preparing and invitation to bid to advertise. North Star Boiler Gun Replacement: Contractor is waiting for parts to arrive to schedule work. Landfill Used Oil Burner Replacement: Contractor has completed the removal of the old system and found that there was a leak in the expansion tank and that the heating unit fan in front of the garage is broken. Replacement parts have been ordered. Mill Bay Beach Stairs and Picnic Table Replacement: Permits were paid for and approved. The project will now begin the submittal phase and is still on schedule for May 30, 2026. DISCUSSION: In September of 2018, the Kodiak Island Borough (KIB) performed an underground tank removal for the Landfill Baling Facility. During excavation, soil contamination was discovered. The contaminated soil was screened and placed into one (1) cubic yard lined super sacks (71 total). In November of 2019, the KIB submitted a work plan to Alaska Department of Environmental Conservation (ADEC) proposing the landfarming method of treating the contaminated soil on -site. In September 2023, the KIB submitted their first addendum to the work plan to ADEC, which was approved. Due to budget constraints and leadership changes, in January 2026, the KIB submitted an additional Addendum to the ADEC to include updates to the landfarming operations. The addendum was approved by ADEC on January 22, 2026. Staff developed and advertised an invitation to bid on January 28, 2026, which was advertised for the designated three weeks per KIB Code 3.30.040, and bids were due March 3, 2026. There was a mandatory pre -bid meeting held on February 20, 2026, and there were ten (10) bidders or subcontractors of bidders in attendance. At the bid opening staff received three (3) bid packages. Following the review of the bid packages, three (3) were determined to be responsible, and Brechan Construction was determined to be the lowest cost responsible bidder. Kodiak Island Borough Invitation to Bid Date: January 28, 2026 Project: Landfill Soil Remediation Project Number: 26008/ Contract Number: FY2026-45 This project includes, but is not necessarily limited to: The Kodiak Island Borough (KIB) is seeking a qualified environmental firm or contractor to provide land preparation, material placement, monitoring, and Alaska Department of Environmental Conservation (ADEC) reporting for landfarming activities associated with 71 supersacks of contaminated soil, each averaging approximately 2,500-2,600 pounds. The scope of this project is based on the Land Farm Work Plan for contaminated soil at the Kodiak Island Borough Landfill and the Addendum dated January 21, 2026 (attached). The intent of this project is to screen the contaminated material to remove rock measuring 2 inches or larger from the supersacks. This material has been approved by ADEC for use as landfill cover. The remaining contaminated soil shall be placed and managed in a land farm constructed in accordance with the "Land Farm Construction" section of the attached Addendum. Land farm construction is to be substantially complete by May 15, 2026. The selected bidder will be responsible for screening the material, constructing the land farm, performing the initial PID screening, and conducting subsequent biannual PID screenings in accordance with the corrective actions outlined in the Addendum. Only responsive Bids from responsible Bidders will be considered. A Bid submitted by a Bidder determined to be not responsible may be rejected. Nothing contained in this section deprives the Borough of its discretion in determining the lowest responsible bidder. Before a Bid is considered for award, a Bidder may be requested to submit information documenting its ability and competency to perform the work, according to general standards of responsibility and any special standards which may apply. It is Bidder's responsibility to submit sufficient, relevant, and adequate information. Borough will make its determination of responsibility and has no obligation to request clarification or supplementary information. 5.0 NON -RESPONSIVE BIDS. Only responsive Bids will be considered. Bids may be considered non -responsive and may be rejected. Some of the reasons a Bid may be rejected for being non- responsive are: a. If a Bid is received by the Borough after the Deadline for Bids. b. If the Bid is on a form other than that furnished by the Borough, or legible copies thereof, or if the form is altered or any part thereof is detached; or if the Bid is improperly signed. c. If there are unauthorized additions, conditional or alternate Bids, or irregularities of any kind which may tend to make the bid incomplete, indefinite, ambiguous as to its meaning, or in conflict with the Borough's Bid document. d. If the Bidder adds any unauthorized conditions, limitations, or provisions reserving the right to accept or reject any award, or to enter into a contract pursuant to an award. This does not exclude a Bid limiting the maximum gross amount of awards acceptable to any one Bidder at any one Bid opening, provided that any selection of awards will be made by the Borough. e. If the Bid does not contain a Unit Price for each pay item listed, except in the case of authorized alternate pay items. f. If the Bidder has not acknowledged receipt of each Addendum. g. (If required) If the Bidder fails to furnish an acceptable Bid guaranty with the Bid. h. If a Bid modification does not conform to Article 10.0 of this Section. 6.0 BIDDER'S EXAMINATION OF CONTRACT DOCUMENTS. It is the responsibility of each Bidder before submitting a Bid: a. To examine thoroughly the Contract Documents, and other related data identified in the Bidding documents (including "technical data" referred to below): 1. To consider federal, state, and local laws and regulations that may affect cost, progress, or performance of the work, 2. To study and carefully correlate the Bidder's observations with the Contract Documents, and other related data; and b. To notify the Borough of all conflicts, errors, or discrepancies in or between the Contract Documents and such other related data. c. The submission of a Bid will constitute an incontrovertible representation by the Bidder that the Bidder has complied with every requirement of Article 6.0, "Bidder's Examination of Contract Documents " herein, that without exception the Bid is premised upon performing the work required by the Contract Documents and such means, methods, techniques, sequences, or procedures of construction as may be indicated in or required by the Contract Documents, and that the Contract Documents are sufficient in scope and detail to indicate and convey understanding of all terms and conditions for performance of the work. Bids and bidding information shall be submitted on the Bid Form/Schedule and other documents provided and as stipulated in the ITB. b. All blanks on the Bid Form/Schedule shall be filled out. c. All requested Alternates shall be bid. If no change in the Base Bid is required, enter 110." d. The Bidder shall make no stipulations on the bid form nor qualify the Bid in any other manner. e. All documents requiring a signature shall be signed by the person or persons legally authorized to bind the Bidder to a contract. A Bid by a corporation shall further give the state of incorporation and have the corporate seal affixed. A Bid submitted by an agent shall have the current power of attorney attached certifying the agent's authority to bind the Bidder. 8.0 SUBMISSION OF BIDS. All information required for bidding shall be submitted in accordance with the ITB. The Bidder shall assume full responsibility for timely delivery at the location designated for receipt of Bids. Oral, telephonic, telegraphic, facsimile or other transmitted bids will not be considered. Alteration of bids by facsimile may be permitted as provided in section 10.0(c). 9.0 DISCREPANCIES IN BIDS. In the event there is more than one Pay Item in a Bid Schedule, the Bidder shall furnish a price for all Pay Items in the schedule, and failure to do so may render the Bid non- responsive and cause its rejection. In the event there are Unit Price Pay Items in a Bid Schedule and the "amount" indicated for a Unit Price Bid Item does not equal the product of the Unit Price and quantity, the Unit Price shall govern and the amount will be corrected accordingly, and the Bidder shall be bound by said correction. In the event there is more than one Pay Item in a Bid Schedule and the total indicated for the schedule does not agree with the sum of the prices Bid on the individual items, the prices Bid on the individual items shall govern and the total for the schedule will be corrected accordingly, and the Bidder shall be bound by said correction. 10.0 BID MODIFICATIONS AND UNAUTHORIZED ALTERNATIVE BIDS. a. A Bid may not be modified, withdrawn, or canceled by the Bidder for 90 days following the time and date designated for the receipt of Bids, and each Bidder so agrees in submitting a Bid. b. Prior to the date and time designated for receipt of Bids, a Bid submitted may be modified or withdrawn by the Bidder. c. See the Bid Modification form which must be used to modify a bid after it has been submitted. The bid modification form may be delivered in person, by mail, by fax (907-486-9394) or email to EFprojectskkodiakak.us. The Bid Modification form must be received by the Contact Person no later than the deadline for bids. Modifications will be time and date stamped which will establish the official time of receipt of the Modification. The Modification must not reveal the bid price but should be in the form of an addition or subtraction or other modification so that final prices will not be known until the sealed bid is opened. Submittal by the bidder of any form other than the Bid Modification form included in this section may deem the modification unacceptable and be cause for the bid to be rejected. d. Withdrawn Bids may be resubmitted up to the date and time designated for the receipt of Bids provided that they are then fully in conformance with these Instructions to Bidders. Page 54 of 163 AGENDA ITEM #14.A.1. 11.0 RIGHT OF REJECTION Bidders must comply with all the terns of the ITB, the Borough Code, State Procurement Code (AS 36.30), and all applicable local, state, and federal laws, codes, and regulations. The procurement officer may reject any bid that does not comply with all the material and substantial terms, conditions, and performance requirements of the ITB. Bidders may not qualify the bid nor restrict the rights of the state. If a bidder does so, the procurement officer may determine the bid to be a non -responsive counteroffer and the bid may be rejected. Minor informalities that may be waived by the Engineering & Facilities Director are as follows: a. Do not affect responsiveness, b. Are merely a matter of form or format, c. Do not change the relative standing or otherwise prejudice other bidders, d. Do not change the meaning or scope of the ITB, e. Are trivial, negligible, or immaterial in nature, f. Do not reflect a material change in the work, or g. Do not constitute a substantial reservation against a requirement or provision. The Borough reserves the right to refrain from making an award if it is determined to be in the Borough's best interest. 12.0 BID PROTESTS In the event protest(s) are received, the Borough Manager shall address the protest as provided in the procurement ITB and the Borough Code, as applicable. The protest period shall follow the requirements outlined in this section. In accordance with the Borough's General Conditions 3.1.5 the Protest period will begin on the date of the Notice of Intent to Award. A formal written protest shall be filed by an aggrieved bidder within ten (10) calendar days of the date on Notice of Intent to Award. Late protests shall not be considered. The written protest shall, at a minimum, include the following: • Name, address, and phone number of protesting contractor; • Authorized signature of the protesting contractor, or the contractor's representative; • Identification of the proposed award; • A detailed statement of the legal and factual grounds of the protest; • Copies of all relevant documents. Protests will be evaluated by the Borough Manager within fifteen (15) calendar days of receipt of the protest. The decision of the Borough Manager shall be final. Page 55 of 163 AGENDA ITEM #14.A.1. 13.0 KODIAK ISLAND BOROUGH NOT RESPONSIBLE FOR PREPARATION COSTS The Borough will not pay any costs associated with preparation, submittal, presentation, or evaluation of any bid. Award of a contract, if it is awarded, will be on the basis of materials and equipment described in the Drawings or specified in the Technical Specifications and will be made to the lowest responsive, responsible Bidder whose Bid complies with all the requirements prescribed. Unless otherwise specified, any such award will be made within the period stated in the Notice Inviting Bids that the Bids are to remain open. Unless otherwise indicated, a single award will be made for all the Bid items in an individual Bid Schedule. If the Borough has elected to advertise this Project with a Base Bid and Alternates, the Borough may elect to award the contract for the Base Bid, or the Base Bid in combination with one or more Alternates selected by the Borough. In either case, award shall be made to the responsive, responsible bidder offering the lowest total Bid for the work to be awarded. The Borough reserves the right to cancel the procurement without liability to the bidder, except return of the bid security, at any time before the Agreement has been fully signed by all parties, including the Borough. 15.0 DISCLOSURE OF BID CONTENTS This section governs the ownership, return, and disclosure of any offer or other record a bidder submits in response to this ITB. (Herein, any reference to "Record" includes all such records and the offer; any reference to "Law" includes any federal or State of Alaska (State) law, including any court or administrative order or rule.) a. All Records belong to the Borough. b. The Borough has sole discretion regarding whether to return any Record. In exercising this discretion, the Borough will comply with all Laws. c. Unless a notice of intent to award is issued, the Borough will, to the extent permitted by Law, consider all Records confidential and not subject to the Alaska Public Records Act (APRA). d. If, and when a notice of intent to award is issued, the Borough will consider nonconfidential any Record unless, at the time of submission, the bidder undertook the following protective measures: i. Marked information confidential; ii. For any information marked confidential, identified the authority that makes that specific information confidential; and iii. Committed, in writing, to explain in detail, including with affidavits and briefs, why each authority applies in any court or administrative proceeding in which any nondisclosure is challenged. If the bidder undertook each protective measure, the Borough will withhold the information marked confidential to the following extent: i. The Borough agrees that the Law protects the information; and ii. If the nondisclosure is challenged, the bidder fulfills its commitment to explain, including with affidavits and briefs, how each authority applies to the information marked confidential. g. The Borough will only notify a bidder of a request for the Record and of a planned release if the bidder undertook each protective measure, but the Borough disagrees that the marked information is protected. In no event shall the Borough be liable for any materials furnished or used, or for any work or labor done, unless the materials, work, or labor are required by the Contract or on written order furnished by the Borough. Any such work or materials which may be done or furnished by the Contractor without written order first being given shall be at the Contractor's own risk, cost, and expense and the Contractor hereby covenants and agrees to make no claim for compensation for work or materials done or furnished without such written order. 3. Payment under this Contract shall not exceed Sixty -One Thousand Five Hundred dollars ($61,500.00). The Parties acknowledge that funds for the payment of this contract are subject to the availability of funds lawfully appropriated for that purpose. 4. The Contractor further covenants and agrees that all materials shall be furnished and delivered and all work and labor shall be done and performed, for the Land Farm Construction, to the satisfaction of the Borough, on or before: May 15, 2026 [The Borough's signature below shall constitute notice to proceed.] Initial PID screening will occur immediately and at the intervals outlined in the Special Conditions (SC 3, Time of Completion). Provided, however, that upon receipt of written notice from the Contractor of the existence of causes over which the Contractor has no control and which must delay furnishing of materials or the completion of the work, the Contracting Officer may, at his or her discretion, extend the period specified for the furnishing of materials or the completion of the work, and in such case the Contractor shall become liable for liquidated damages for delays commencing from the date on which the extended period expires. 5. The bonds given by the Contractor are a Bid Bond 5% of the proposed bid cost, Performance and Payment Bonds to be issued after contract is executed. 6. The Contractor further covenants and agrees that the entire construction will be done under the administration of and to the complete satisfaction of the Borough subject to the inspection at all times and approval by any regulatory agency, and in accordance with the laws of the State of Alaska and the Borough. 7. For purposes of this Contract, Contracting Officer means Borough Manager or any other person designated by the Borough Manager. 8. The Contractor is an independent contractor and not an employee or agent of the Borough. 9. Kodiak Island Borough Special Conditions SC 01 General Statement The Special conditions set forth conditions and requirements unique to this Project and are supplemental to, and supersede, the Borough's "General Conditions." SC 02 Scope of Work The Scope of Work of the Base Bid of this Contract shall include providing all labor, materials, tools, equipment, transportation, supervision and facilities necessary to: Base Bid 1. Project Basis and General Requirements • Project is based on the Land Farm Work Plan for Contaminated Soil at the Kodiak Island Borough Landfill and the Addendum dated January 21, 2026. Work includes landfarming activities associated with 71 supersacks of contaminated soil, each averaging approximately 2,500 pounds. All activities shall comply with applicable ADEC regulations, approvals, and guidance documents. 2. Material Screening • Screen contaminated material from the supersacks to remove rock measuring 2 inches or larger. • Segregate screened rock approved by ADEC for use as landfill cover. 3. SC 07 Hazardous Waste Generation Every effort to minimize or eliminate the generations of hazardous waste shall be used by the Contractor in the performance of the work of this Contract. Unless there is no substitute, no hazardous material shall be used in the performance of the work of this Contract. SC 08 Site Preservation, Restoration, Cleanup and Environmental Reporting The Contractor shall be solely responsible for damage to public or private property caused by their operations. The Contractor shall take all precautions necessary to control dust. The Contractor shall notify the Borough of any claims of damage and shall clean and restore any property so damaged at the sole expense of the Contractor. All spills or releases of any hazardous substance shall be reported to the appropriate governmental agency as well as notice to the Borough. Contractor shall be responsible for all associated cleanup costs and fines. At all times during the work, keep the premises clean and orderly. The RFQ was posted on the Kodiak Island Borough website on February 9. Because the estimated project cost falls below the threshold requiring newspaper publication, staff were not obligated to advertise the RFQ in print. A mandatory pre -bid meeting was held on February 17, followed by the quote opening on February 25. Staff received only one (1) quote submission and determined that it was responsive. AIM Maintenance submitted the only quote and is thus determined to be the lowest -cost responsive quote. Payment under this Contract shall not exceed Nine Thousand Two Hundred dollars ($9,200.00). The Parties acknowledge that funds for the payment of this contract are subject to the availability of funds lawfully appropriated for that purpose. 4. The Contractor further covenants and agrees that all materials shall be furnished and delivered and all work and labor shall be done and performed, in every respect, to the satisfaction of the Borough, on or before: May 1, 2026. [The Borough's signature below shall constitute notice to proceed.] It is expressly understood and agreed that in case of the failure on the part of the Contractor, for any reason, except with the written consent of the Borough, to complete the furnishing and delivery of materials and the doing and performance of the work before the aforesaid date, the Borough shall have the right to deduct from any money due or which may become due the Contractor, or if no money shall be due, the Borough shall have the right to recover Liquidated Damages as described in the Special Conditions for each calendar day elapsing between the time stipulated for achieving substantial completion of an individual phase and the actual date of completion of that phase in accordance with the terms hereof; such deduction to be made, or sum to be recovered, not as a penalty but as liquidated damages. For purposes of this Contract, Contracting Officer means the Borough Manager, or any other person designated by the Borough Manager. 7. DISCUSSION: The Planning & Zoning Commission held a public hearing on this rezone request on February 18, 2026. The Commission voted 5 to 0 with one member absent and one vacant position to forward a recommendation of approval to the Borough Assembly. The Native Village of Ouzinkie submitted the rezone application for the subject property to allow the existing structure on the property to be converted to a childcare center on the first floor and two vacation home units on the second floor. The B Business District is needed to permit the residential units and the childcare center. The future land use map designation for this subject parcel is for public use; however, the PL Public Use Land District does not allow residential units. Community Development staff reviewed the request and determined that the proposed rezone would meet the requirements of Title 17 and the 2008 Comprehensive Plan for the following reasons. 1. The proposed rezone is needed to permit the property to be used for both the childcare center and vacation home uses; the B Business District is the most appropriate zoning district to permit both uses. 2. The proposed rezone does not conform with the future land use map designation of public use; the proposed B Business District is compatible with the surrounding area and the mixed- use/commercial future land use map designation immediately to the east of the subject parcel. 3. The 1984 Ouzinkie Comprehensive Plan document was used in the development of the 2008 Comprehensive Plan; this plan recommends that residential areas should allow non - conflicting uses, such as government, churches, health services, and neighborhood parks. The proposed uses for the subject parcel are considered non -conflicting or compatible uses in accordance with best planning practices. KODIAK ISLAND BOROUGH STAFF REPORT MARCH 19, 2026 ASSEMBLY REGULAR MEETING SUBJECT: Ordinance No. FY2026-21, Rezoning Ouzinkie Tract C Block 1 Parcel 1 USS 4871 (648 G Street) From R1 Single Family Residential District To PL Public Use Lands District ORIGINATOR: Chris French, CDD Director RECOMMENDATION: Move to advance Ordinance No. FY2026-21 to public hearing at the next regular meeting of the Assembly. DISCUSSION: The Planning & Zoning Commission held a public hearing on the proposed rezoning on February 18, 2026. The Commission voted 5 to 0 with one member absent and one vacant position to recommend approval to the Borough Assembly. The Native Village of Ouzinkie submitted the rezone application in order to complete the newly constructed building on the subject property. This proposed PL District would permit the building to be used for public service uses such as a wellness center, community education assistance, and counseling services. The building will not be used for residential purposes. The future land use map designation for this property is industrial. This property was once a part of the old airport property. The 2008 Comprehensive Plan designated the old airport site for industrial. A new airport was developed years later, which left the old airport site unused. The subject property was created recently to allow for the construction of the new building on the site. Therefore, the current industrial designation would not be appropriate for the subject property. In fact, the subject property does appear to be compatible with other uses to the west, which include other public service uses. Community Development staff reviewed the rezone request and developed the following findings in support of the rezone request. 1. The proposed use of the structure on the subject parcel is for public use, such as a wellness center and community center. These land uses require the rezoning to the PL District. 2. The future land use map designation for the subject property should be changed from industrial to public use because the subject property was subdivided from the old airport property, and the existing structure and proposed uses are in conformance with the public use designation and with other public use designated properties across F Street. 3. The proposed rezone is in conformance with the 2008 Comprehensive Plan because the policies within the local government chapter of the plan for Ouzinkie promote public health and wellness initiatives for the community. The proposed rezone ordinance includes a section that would change the future land use map designation of the subject parcel from Industrial to Public Use.
