No such nonconformlng use sha1l be enlarged, increased, or
extended to occupy a greater area of land than was occupLed at
the effective date of adoptlon or amendment of the ordinancescodlfled ln this title.
COMMENTS:
The purpose of this request Ls to allow a 7 foot by 12 foot additlon ontothe existlng slngle-fanlly residence. The exlstl-ng resldence is a
nonconforning land use because the property is located ln the B--Buslness
Zonlng District whlch does not permlt single-famLly resldences. The
nonconformlng uses sectlon of the Borough Code (Section 17.36.060) does notpermit the expanslon of such uses, hence thls request.
In order for the CornmLssion to grant a variance, all of the followlng
condltlons must be satlsfled:
1. Exceptional physical circumstances or conditlons appllcable to theproperty or lntended use of development, whlch generally do not applyto other propertles ln the same land use dlstrlct.
In this case, the unlque condl,tlon applicable to the lntended use ofthe property ls the existing residential l-and use. Although zoned
B--Buslness, there has been a sLngle-fanlJ-y residence on the propertyfor many years. Other nearby lots al-so have resLdentLal Land uses and

In this case, actions of the appllcant have not caused the conditlons
frour which rellef is belng sought by a varlance. The exlstl-ng house
was bullt ln 1953; the property was zoned business ln 1976. Also, the
varlance request will be decided prlor to constructlon of the
addltlon.
6. That the granting of the variance wlll not permlt a prohlblted land
use ln the district involved.
Slngle-famlly resLdences are not a permltted land use ln the
B--Business Zonlng Distrlct. Strict applicatlon of thls sectlon of
the zoning ordlnance would not Justlfy a varlance for addltlons to the
existing resldence. Moreover, Tltle 29, Alaska Statutes, also
speclfies that variances shaIl not be granted for a land use that isprohibited in the zoni.ng distrlct. Therefore, based on a l-lteralinterpretatlon of this conditlon, the varlance request should properLy
be denled.
However, based on an evaluatlon of the exlstlng land uses ln the area,
the proprlety of the buslness zonlng of the property must be
questloned. The area was zoned to Business in 1976 (Ordlnance
76-23-0) and the prinary reason given for the rezone was for future
development.

Based on the above, the Comrnunity Development Department feels that
the area ls clearly a long establlshed residentlal area and ls llkelyto remaln such for the foreseeable future. Also based on the above,staff feels that lt would not be detrlmental to the surroundlng areaif the varlance were granted. If the Conmlsslon agrees, the followlngflnding could be made ln support of condltlon six:
Slngle-fanlly resLdences, provided they occupy less than 50percent of a commerclal structure, are condltlonally permltted lnthe B--Business Zonlng Dlstrlct.
RECOMMENDATION:
Staff flnds that thls reques t does meet all the condltlons necessary for a
variance to be granted under Chapter 17.66 (Variance) of the Borough Code.
APPROPRIATE MOTION:
Should the Cormrlsslon agree wlth the staff recommendation, the approprlate
motion is:
Move to grant a variance from Sectlon 17.36.060(A) of the Borough Codeto permit a nonconforming land use to be enlarged and extended to
