WHEREAS, Alaska Statutes 29.33.090 empowers the Borough to enact a Zoning Ordinance and provide for its administration, enforcement and amendments, and WHEREAS, the Kodiak lsland Borough has purusant thereto adopted Title 17, of its Code of Ordinances and Resolutions which provides for planning and zoning provisions and procedures, and WHEREAS, according to the Comprehensive Planning and Zoning Map adopted by the Kodiak lsland Borough, that Lots 17A and l7B, 18A and l88, and 19, Block 1, Townsite Addition has been zoned R-3, and WHEREAS, a petitiorr has been received from Lawrence Jo Shaw requesting the same be rezoned from R-3 to Business to allow for future development, WHEREAS, the Petition was considered and approved by the Planning and Zoning Commission on November 16, 1976, and said body has recommen the reclassification of said property from R-3 to Business NOW, THEREFORE, BE lT ORDAINED by the Borough Assembly of the Kodiak lsland Borough that the property described as: Lots 17A and 178, l8A and l8B, and 19, Block 1, Townsite Addition Be and the same are hereby reclassified as Business and that notice of this ordinance be given by publication in the KODIAK MIRROR, seven (71 days prior to the second reading and that a public hearing be held thereon on the date of the second reading and that this Ordinance become effective a D nl a oo at the time of adoption. VII ZONING ITEMS A. Vacation of Unnamed Street between Lots 34 6 38, Block 2 6 Blot l, Block 3,Miller Point AK Subdivision (Joe Majdic). Mr. Denslow stated there appears to be adequate access to the adjoining Borough property. The Borough attorneyrecently issued an opinion of the action taken by the Borough Assembly regardingan exception to the property in question. Mr. Busch moved to grant vacation of unnamed street between Lots 3A E 38, Block 2 and Lot l, Block 3, Mitler PointAK Subdivision. Mr. Heglin seconded. Motion passed by a vote of 5 to I withMr. Williams casting a NO vote. B. Rezone R-I to R-2 Lots 15 E 16, Block 40, East Addition (Royal K. pelekai). Mr. Heglin stated the property is surrounded by R-l property; as a consequence,this would constitute spot zoning. Mr. Hayden explained that Mr. Pelekai couldbuild a one-family structure on each of the substandard lots if he applied for andreceived approval of a variance from setback requirements or he could build aone-family dwelling across the property line between the two lots. Mr. Williams stated the lots described are between 2t,000 and22'000 square feet; ordinance for a dwelling requires 3s,ooo to 40,000 squarefeet for water a'nd sewerage in an arep such as this. Although these are businesslots they would require water and septic.systems and it is doubtful 21,000 to22,000 square feet would be adequate. Mr. Hickman stated that with the gravetsubbase he felt the lot size would be sufficient. Mr. Ogg recommended furtherconsultation with the state sanitarian and the borough "ngin"u.. Mr.Ogg movedto table the request until further information is received iegarding sanitation,sewerage and water supply. Seconded by.Mr. Busch. Moiion carried by aunanimous roll catl vote. Mr. Haydendefined R-l and R-2 zoning for the information of the audience. Mr. RobertShepherd spoke in favor of the rezoning because of the critical housing situationin Kodiak. Asa Beehler reiterated his request and statements as presented inhis letter to the Borough dated October 13, 1976. Chairman Hayden closed thepublic hearing and opened the meeting. Mr. Ogg asked what the position of thecomprehensive plan is on the matter at the present time. Mr. Denslow stated itwas mapped high density which means higher than R-l but does not specify zoningclassifications. Mr.Ogg asked what effect it would have an traffic.
