COMMENTS: The purpose of this request is to Iegallze the use of the single-famlly resLdence on the lot as a homeless shel, ter and to alIow one addltlonal- unrelated lndlvldual to reside in the house, beyond what is allowed by the Borough Code. Staff determined that an exceptlon for thls use is necessary because a shelter for the homeless is not deflned or listed as a permltted land use ln the B--Business Zonlng Dtstrict. In evaluatLng thls request and the standards necessary for an exceptlon, the Comrnission should also bear ln mind Sectlon 17.03.090: 17 .03 .090 Slnllar uli€s uray be permltted. Land uses other than those speclfically pernltted ln a distrlct may be alJowed if they are slmllar to those listed and are found by the planning commlssion, after a publlc hearing, not to be obnoxlous or detrlmental to the welfare of the comunity. FINDINGS OF FACT In order to llrant an exceptlon, the Cornmission nust find that the use proposed ln the appllcatlon meets al-l- of the followlng: That the use as proposed ln the appllcatlon, or under approprlate condLtl.ons or restrLctl.ons, will not (A) endanger the publlcrs health, safety or general welfare, (B) be lnconslstent wlth the general purposes and lntent of this tltle and (C) adversely lnpact other properties or uses ln the nelghborhood. It appears that the proposed use will enhance rather than endanger the publicrs health, safety, or general welfare. A sheLter for the homeless I A Case 88-030 4 May 18, 1988 P&Z o o ITEM VI-H rr111 provlde a dl.rect beneflt to the health, safety, and wel-fare of street people and provide lndlrect benefits to the cornmunlty at large by provldlng a safe and cLean envlronment for a shelter. The proposed use wiLl be conslstent wlth the general purposes and lntent of Title 17 and wlth the speciflc descriptlon and intent of Chapter 17.21, the B--Buslness Zoning Dlstrlct. First of all, the use characteristlcs of the proposed shelter are slmilar to a hotel and/or notel, which are permltted business uses. Therefore, the proposed use may be permltted as a simll-ar use pursuant to Section 17.03.090 because, as descrlbed ln (A) abover the use should not be detrlmental to the wel-fare of the conrmunity. Addltlonally, a number of permLtted uses 1n the B--Buslness Zonlng Dlstrict are much more lntensive activlties than the shel"ter as measured ln terms of traffic generation, noLse, parklng, hours of operation, etc. The proposed use should not adversely impact other propertles or uses ln the nelghborhood.
