The conditions of approval for this conditional use will ensure that the value, spirit, character, and integrity of the surrounding area are maintained to the maximum extent possible. 2. The conditional use fulfills all C-Conservation zoning district requirements. Compliance with those requirements and the conditions of approval will be further ensured during issuance of zoning compliance for the project 3. This request is an effort by the Borough to improve landfill customer safety and service by locating the building next to the existing landfill scales. The applicant is the Kodiak lsland Borough and the agent is Dave Conrad, KIB Construction lnspector and Engineer. The location is 1203 Monashka Bay Road and the zoning is l-lndustria!. COMMISSIONER PAINTER MOVED to grant a variance, per KIBC 17.105.040.4.2 and 17.195, to allow an 8' x 20' accessory building (landfill customer service and support building) to encroach 34' into the required l-lndustrial zoning 50'front yard setback on Lot 1A, Kodiak lsland Borough Landfill Subdivision, and to adopt the findings of fact listed in the staff report dated September 7 , 2016 as "Findings of Fact" for 17-010. Maker stated this is the borough;s effort to improve landfill customer safety and service. The existing customer service building is next to the baler building and the scales are near the front property line. By relocating the building next to the scales, it will allow customers to drive in onto the scale for their full weight, unload, drive back onto the scales to get their empty weight and obtain their ticket without having to transit across the heavy traffic area to improve safety. Staff recommends approval of this request. Open public hearing: Dave Conrad, agent, encouraged the commission to move this forward. This is a result of taking advantage of software purchased for the update to the billing for the landfill. lt will streamline, especially the commercial carriers that are on and off the property continuously as they won't have to get out of their vehicles to walk across. There are times when it is very congested when it's wet and icy. lt would be a safety advantage to the public and time spent there. Close public hearing: Brief discussion. The longstanding location of the existing bailer building, scales, and traffic flow for landfill operations require that the landfill customer service and support building be placed near the scales to provide optimal public customer service in a safe efficient manner. 2. The strict application of the l-lndustrial zoning district 50' front yard setback requirement would not allow the building to be placed a manner that would maximize public benefit. 3. Granting of the variance will not result in material damage or prejudice to other properties in the vicinity. Placing the building within the setback will have a minimal impact on site aesthetics. That minimal impact is more than compensated for by the resultant improvements to public safety, generalwelfare, and customer service. 4. Granting of the variance is consistent with various objectives of the adopted Comprehensive Plan. 5. The special conditions from which relief is being sought are caused by the longstanding location of the existing bailer building, scales, and traffic flow for landfill operations, not the applicant. 6. The granting of this variance will allow construction of an accessory building on an l- lndustrial zoned parcel. Accessory Buildings are listed as a permitted use in that zoning district. ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY G. CASE 517-002. The applicant is the Kodiak lsland Borough and the agent is the KIB Resource Management Officer. The location is 593 lsland Lake Road and the zoning is PL-Public Use Lands. (rezone to R2-Two-Family Residential pending final approval by the Borough Assembly) COMMISSIONER BALDWIN MOVED to postpone Case 517-002 to the November 16, 2016 Planning and Zoning Commission regular meeting. Maker stated this is a borough owned lot that follows the recent Land Disposal request. lt is retaining a2 acre portion and subdividing a 1 acre portion. lt will be offered at a future land sale. Staff recommends postponement to allow for a drainage plan to be done and submitted by the Resource Management Officer per commission direction at the work session. ln response to COMMISSIONER PAINTER'S inquiry of will the new plat change the original covenant language or will it be a legal problem for the owners later on because we've changed that language regardless of us moving around properties, we could have moved it to where there's a lot of slope, etc. and not retain a portion but she believes we're supposed to save this, the covenant says to save Lot 1A-4E. Maker stated the recording of this plat is, that covenant is like vacating a portion of an easement, it would be considered similar, you would say easement vacated this plat and specifically in the plat notes it says the original plat of Lot 1A-4, Plat 93-12 has a covenant designating all of Lot 1A-1 and 1A-4 for parks and recreational purpose and it specifically states this plat amends the covenant as it pertains to Lot 1A-4 only, Lot 1A-4E created this survey will remain designated for parks and recreational purpose. Lots 1A-4A, 48, 4C, and 4D created this survey are not designated for parks and recreation by this plat. Once this is recorded it is a legal document and that plat note will replace the old covenant. Open public hearing: Duane Dvorak, Resource Management Officer stated he concurs with staffs recommendation. There should be adequate time to get a drainage plan by November. Before we do anything we need a plan approved by the commission that we can put out for bid, it woud be a specific scope of work. We are trying to get these lots together for land sale. We are projecting the land sale to be in April 2017 and it does put some time constraint on things but still doable. Don Swanson stated a few things came to light about this rezone and subdivision that he talked about at the last meeting. There is a drainage issue on those lots. He lives adjacent to the corner, the closest resident to those lots to be developed. Granting of the variance will not result in material damage or prejudice to other properties in the vicinity. Placing the building within the setback will have a minimal impact on site aesthetics. Granting of the variance is consistent with various objectives of the adopted Comprehensive Plan. 5. The special conditions from which relief is being sought are caused by the longstanding location of the existing bailer building, scales, and traffic flow for landfill operations, not the applicant. 6. The granting of this variance will allow construction of an accessory building on an l- lndustrial zoned parcel. Accessory Buildings are listed as a permitted use in that zoning district. Aoolicant Resoonse The special conditions from which relief is being sought are caused by the longstanding location of the existing bailer building, scales, and traffic flow for landfill operations. Staff Analvsis Staff concurs. The bailer building was construc{ed in 1986. Although that building meets setback requirements, the placement of the building, combined with landfill operations and traffic flow, does not accommodate a conforming alternative that maximizes public benefit. 6. That granting the variance will not permit a prohibited land use in the districl involved. Aoolicant Resoonse Granting of the variance will allow placement of an accessory building that supports the existing permitted sanitary landfill use. Staff Analvsis Accessory buildings are listed as a permitted use in l-lndustrial zoning. Therefore, the granting of this variance will not permit a prohibited use. CONCLUSION Staff has determined that this request meets all the conditions necessary, as reflecled in the findings of fact, for a variance to be approved under Chapter 1 7.1 95 (Variances) of the Borough Code. Placing the building to meet setback requirements would negatively impact public safety by increasing customer pedestrian traffic in a high heavy vehicle traffic flor area. The strict application of the l-lndustrial zoning distrid 50' front yard setback requirement would not allow the building to be placed a manner that would maximize public benefit. 3. That the granting of the variance will not result in material damage or prejudice to other properties in the vicinity nor be detrimental to the public's health, safety or general welfare. Apolicant Response Granting of the variance will not result in material damage or prejudice to other properties in the vicinity. Granting the variance will improve public safety and general welfare by allowing the building to be placed in a manner that will reduce customer pedestrian traffic in an area that experiences high levels of heavy vehicle traffic in support of landfill operations. Staff Analvsis Staff concurs. Placing the building within the setback will have a minimal impact on site aesthetics. That minimal impact is more than compensated for by the resultant improvements to public safety, general welfare, and customer service. 4. That the granting of the variance will not be contrary to the objeclives of the comprehensive plan. Aoolicant Response Granting of the variance would not be contrary to the objectives of the adopted Comprehensive Plan. Staff Analvsis Staff concurs. Granting this variance will not negatively impact the rights of the surrounding property owners. This, combined with the public benefits gained by placing the building within the required setback, is consistent with the following Comprehensive Plan land use goal: o Goal Regulate and manage land uses to balance the ights of private property owners with community values and objectives. Granting the variance will allow the building to be placed in a manner that will enhanc,e landfill operations. Denial. lf the cpmmission finds, after consideration of the investigator's report and receipt of testimony at the public hearing, that it cannot make all of the required findings in subsection A of this section it shall deny the variance. STAFF ANALYSIS This is a request for a variance to allow a new 8' x 20' Kodiak lsland Borough Landfill customer service and support building (accessory building) to encroach into the required front yard setback. The request is an effort by the Borough to improve landfill customer safety and service. The existing customer service building is located next to the bailer building and the scales are situated near the front property line across from the bailer building. That configuration requires customers to walk through, drive through, or park in the landfill's heaviest traffic flow area (between the scales and the entrance to the bailer building). ln an effort to reduce such activities in that high traffic flow area, the Borough is requesting a variance that will allow the new building, which will contain updated software and cameras, to be placed next to the scales. This will allow customers to drive onto the scales for a loaded weight, drive from the scales to the appropriate landfill section to unload, drive back onto the scales for an unloaded weight, receive their bill, and exit the landfill in their vehicle. This new operational flow will significantly reduce pedestrian and stop and go vehicle traffic in the congested area, resulting in improved public safety, general welfare, and customer service. To assist the Commission in their decision on this case, the below listing of the variance approval criteria followed by the applicant's response and staff analysis is provided. VARTANCE APPROVAL CRTTERTA (K!BC 17.19s.0s0.4.1-6) 1. That there are exceptional physical circumstances or conditions applicable to the property or to its intended use or development which do not apply generally to other properties in the same land use district. Applicant Response The longstanding location of the existing bailer building, scales, and traffic flow for landfill operations require that the scale office building be placed near the scale to provide optimal public customer service in a safe efficient manner. Placement of the building near the scales will result in a 34' encroachment into the required 50' front yard setback for l- lndustrial zoned properties that face a State highway. Staff Staff concurs. The exceptional physical circumstances and conditions are directly related to the long standing configuration of existing buildings and traffic flow related to landfill operations. For the industrial zone, in promoting the general purpose of this title, the specific intentions of this chapter are: A. To encourage the construction of and the continued use of the land for business and industrial purposes; B. To prohibit all residential uses of the land not associated with industries and any other land use which would substantially interfere with the development, continuation or expansion of industry in the zone; C. To concentrate the industrial and business uses within designated areas to protect residential districts from noxious or noisy operations; and D. To encourage the discontinuance of existing uses that would not be permitted as new uses under the provisions of this chapter. 1 7. 1 05.040 Yards (l-lndustrial District). A. Front Yards. 1. There shall be a front yard of not less than 30 feet. 2.The front yard, when facing a state highway, shall be not less than 50 feet. KIBC 17.195.010 Authoritv and ourpose (Variances). The commission shall review and act upon applications for variances. Variances are provided for by this chapter for the purpose of relaxing zoning district requirements in special circumstances. At the time of construction, the parent parcel was zoned C-Conservation. The building was constructed 29' from the front property line, which satisfied the 25'front yard setback requirement for C-Conservation zoning. On March 7,2013, the parcel was rezoned to l-lndustrial by KIB Ordinance No. FY 2013-13 (P&Z Case No. 13-012). Accordingly, the requirements of KIBC 17.105 (l-lndustrial District) applied to any further development of the parcel as of that date. Subsequently, any existing legal structures that could not be built under l-lndustrial zoning requirements became legal nonconforming structures. Such structures are allowed to continue without a variance, provided the requirements of the following Borough Code are satisfied: 1 7. 1 40. 040 N onconform i no structu re s. A. PUBLIC HEARING NOTICE lf additional variances were required, new public hearing notice would also be required per the following Borough Code: KIBC 17.195.040 (Public heaino and notice) The commission shall hold a public heaing on each properly submitted application for a vaiance within 50 working days after the date of the next available meeting agenda deadline. The applicant shall be notified of the date of such heaing. The community development depaftment shall send to each owner of property within a minimum distance of 300 feet of the exteior boundary of the lot or parcel of land described in the application, notice of the time and place of the public heaing, a description of the propefty involved, its streef address, and the actbn requested by the applicant. For the purposes of this chapter, 'propefty ownef' means that land owner shown on the latest fax assessment roll. Notice shall also be provided in accordance with state law by legal publication in local newspapers. The only requested action listed in the public hearing notice for Case No. 17-010 was a variance for a new 8' x 20' accessory building to encroach into the required front yard setback. Per the above code, that notice is appropriate for a public hearing and action on the requested variance or a lesser variance, but not for additional variances that were not listed. Accordingly, an additional public hearing notice that specifically lists those variances would be required prior to the Commission holding a public hearing and taking action on such variances. That case specifically requests a variance to allow an 8'x 20' accessory building (landfill customer service and support building) to encroach 34' into the required l- lndustrial zoning 50' front yard setback on Lot 1A, Kodiak lsland Borough Landfill Subdivision. During the packet review, the Commission noted that the existing landfill scales and a 40' x 45' accessory building (storage building) also encroached into the required 50' front yard setback. The Commission requested that staff investigate amending the staff report recommendation and appropriate motion to include approval of variances for the scale and accessory building encroachments. Staff provides the following analysis in response to the Commission's request: LANDFILL SCALES Staff has determined that the scales are equipment (not a structure) that is incidental and subordinate to the existing landfill use per the following Borough code: 1 7.1 50.030 Eouipment - Outdoor storaoe and minor structural development proiections. A. EquipmenUOutdoor Storage and Minor Structural Developments Generally. 1. "EquipmenUoutdoor storage" means items that are customarily subordinate and incidental to the use of the land. EquipmenUoutdoor storage can be freestanding or attached to a structure. Examples of equipmenUoutdoor storage that is specifically permitted to project into required setbacks are identified in Table 1 of KIBC 17.150.040. Although Table 1 of KIBC 17.150.040 does not specifically list scales under examples of equipment that can project into the front yard setback, it does state that other similar equipment items are conditionally allowed to project into a required front yard setback. On December '19, 2012, the Commission approved a Conditional Use Permit for the expansion of the landfill (subjectto a rezoneto l-lndustrial laterapproved by KIB Ordinance No. FY2013- 13). The site plan for that Conditional Use Permit showed the landfill scales in their current location. Accordingly, staff has determined that approval of that Conditional Use Permit constitutes the conditional approval required to allow the scales to project into the required front yard setback per Table 1 of KIBC 17.150.040. For the industrial zone, in promoting the general purpose of this title, the specific intentions of this chapter are: A. To encourage the construction of and the continued use of the land for business and industrial purposes; B. To prohibit all residential uses of the land not associated with industries and any other land use which would substantially interfere with the development, continuation or expansion of industry in the zone; C. To concentrate the industrial and business uses within designated areas to protect residential districts from noxious or noisy operations; and D. To encourage the discontinuance of existing uses that would not be permitted as new uses under the provisions of this chapter. 1 7. 1 05.040 Yards (l-lndustrial District). A. Front Yards. 1. The commission shall review and act upon applications for variances. Variances are provided for by this chapter for the purpose of relaxing zoning district requirements in special circumstances. A. Approval. lf it is the finding of the commission, after consideration of the investigator's report and receipt of testimony at the public hearing, that the use proposed in the application, or under appropriate conditions or restrictions, meets all of the following, the variance shall be granted: 1. That there are exceptional physical circumstances or conditions applicable to the property or to its intended use or development which do not apply generally to other properties in the same land use district; 2. Denial. lf the commission finds, after consideration of the investigator's report and receipt of testimony at the public hearing, that it cannot make all of the required findings in subsection A of this section it shall deny the variance. STAFF ANALYSIS This is a request for a variance to allow a new 8' x 20' Kodiak lsland Borough Landfill customer service and support building (accessory building) to encroach into the required front yard setback. The request is an effort by the Borough to improve landfill customer safety and service. The existing customer service building is located next to the bailer building and the scales are situated near the front property line across from the bailer building. That configuration requires customers to walk through, drive through, or park in the landfill's heaviest traffic flow area (between the scales and the entrance to the bailer building). ln an effort to reduce such activities in that high traffic flow area, the Borough is requesting a variance that will allow the new building, which will contain updated software and cameras, to be placed next to the scales. This will allow customers to drive onto the scales for a loaded weight, drive from the scales to the appropriate landfill section to unload, drive back onto the scales for an unloaded weight, receive their bill, and exit the landfill in their vehicle. This new operational flow will significantly reduce pedestrian and stop and go vehicle traffic in the congested area, resulting in improved public safety, general welfare, and customer service. To assist the Commission in their decision on this case, the below listing of the variance approval criteria followed by the applicant's response and staff analysis is provided. VARTANCE APPROVAL CRTTERTA (KrBC 17.195.050.A.1-6) 1. That there are exceptional physical circumstances or conditions applicable to the property or to its intended use or development which do not apply generally to other properties in the same land use districl. Apolicant Response The longstanding location of the existing bailer building, scales, and traffic flow for landfill operations require that the scale office building be placed near the scale to provide optimal public customer service in a safe efficient manner. Placement of the building near the scales will result in a 34' encroachment into the required 50' front yard setback for l- lndustrial zoned properties that face a State highway. Staff Staff concurs. The exceptional physical circumstances and conditions are directly related to the long standing configuration of existing buildings and traffic flow related to landfill operations. That configuration does not offer conforming ahernatives that will position the building in a manner that maximizes public benefit. Placing the building to meet setback requirements would negatively impact public safety by increasing customer pedestrian traffic in a high heavy vehicle traffic flor area. Staff Analvsis Staff concurs. The strict application of the l-lndustrial zoning district 50' front yard setback requirement would not allow the building to be placed a manner that would maximize public benefit. 3. That the granting of the variance will not result in material damage or prejudice to other properties in the vicinity nor be detrimentalto the public's health, safety or generalwelfare. Aoolicant Resoonse Granting of the variance will not result in material damage or prejudice to other properties in the vicinity. Granting the variance will improve public safety and general welfare by allowing the building to be placed in a manner that will reduce customer pedestrian traffic in an area that experiences high levels of heavy vehicle traffic in support of landfill operations. Staff Analvsis Staff concurs. Placing the building within the setback will have a minimal impact on site aesthetics. That minimal impact is more than compensated for by the resultant improvements to public safety, general welfare, and customer service. 4. That the granting of the variance will not be contrary to the objectives of the comprehensive plan. Aoolicant Resoonse Granting of the variance would not be contrary to the objeclives of the adopted Comprehensive Plan. Staff Analvsis Staff concurs. Granting this variance will not negatively impact the rights of the surrounding property owners. This, combined with the public benefits gained by placing the building within the required setback, is consistent with the following Comprehensive Plan land use goal: . @3! Regulate and manage land uses to balance the rights of pivate property owners with community values and objectives. Granting the variance will allow the building to be placed in a manner that will enhance landfill operations. Aoolicant Resoonse The special conditions from which relief is being sought are caused by the longstanding location of the existing bailer building, scales, and traffic flow for landfill operations. Staff Analvsis Staff cpncurs. The bailer building was constructed in 1986. Although that building meets setback requirements, the placcment of the building, combined with landfill operations and traffic flow, does not accommodate a conforming alternative that maximizes public benefit. 6. That granting the variance will not permit a prohibited land use in the districl involved. Aoolicant Response Granting of the variance will allow placement of an acoessory building that supports the existing permitted sanitary landfill use. Staff Analvsis Accessory buildings are listed as a permitted use in l-lndustrial zoning. Therefore, the granting of this variance will not permit a prohibited use. CONCLUSION Staff has determined that this request meets all the conditions necessary, as refleded in the findings of fac{, for a variance to be approved under Chapter 17.1 95 (Variances) of the Borough Code. The longstanding location of the existing bailer building, scales, and traffic flow for landfill operations require that the landfill customer service and support building be placed near the scales to provide optimal public customer service in a safe efficient manner. 2. The strict application of the l-lndustrial zoning district 50' front yard setback requirement would not allow the building to be placed a manner that would maximize public benefit. 3. Granting of the variance will not result in material damage or prejudice to other properties in the vicinity. Placing the building within the setback will have a minimal impact on site aesthetics. That minimal impact is more than compensated for by the resultant improvements to public safety, general welfare, and customer service. 4. Granting of the variance is consistent with various objectives of the adopted Comprehensive Plan. 5. The special conditions ftom which relief is being sought are caused by the longstanding location of the existing bailer building, scales, and traffic flow for landfill operations, not the applicant 6. The granting of this variance will allow construction of an accessory building on an l- lndustrial zoned parcel. Accessory Buildings are listed as a permitted use in that zoning district. Conex OfFrce / Scale Shack to be allowed within the required fifty foot setback for industrial zoned property. The KIB has purchased and installed new scale software to replace the antiquated software. This new sofiware allows for the use of video carneras to capture images of the vehicle license plate and the load inside any open vehicle. Once set up with regular custorners it will remove the requirrnrent for the custorrcr to leave the vehicle and walk acn ss the parking srca to the current scale shack location. For non-regular commercial customers, the customer will be able to stay in their vehicle and speak to the scale attendant for the initiation of an invoice or be directed to the correct location to place their municipal wasle. This will reduce the safety hazards from heavy equipnrent and vehicle traffic as well reduce the wait tinre for the customers. The proposed location of the scale shack is 16 feet to the North West of the state property line for Monashka Bay Road. This request is being made to place a converted 20ft. x 8ft. conex within the set back to allow for the previously described customer interface. The conex will be placed and secured to engineered concrete foundation block. Future plans will construct a sleel deck to allow customers to enter the conex office dircctly from the scale.
