RECOMMENDATION:
Move to advance Ordinance No. FY2026-19 to public hearing at the next regular meeting of
the Assembly.
DISCUSSION:
This change is meant to improve the borough's budgeting process. Under the current
timeline, service area budgets are due to the Clerks just one day before the full budget is due
to the Assembly, while the school district's funding request is not submitted to the Borough
until 30 days after the manager must present the overall budget to the Assembly. These
misaligned deadlines make it difficult for staff to accurately incorporate all required information
and present a compete budget on time.
The proposed update revises the staff submission deadline to the Assembly and removes the
requirement to include the school district's funding request in the borough budget and budget
message. This will give staff additional time and flexibility to prepare a more complete,
accurate, and workable operating budget and capital plan.

WHEREAS, it is desirable to incorporate the proposed budgets of the service areas — due on
or before March 31 pursuant to Borough code 4.20.030 — into the borough budget; and
WHEREAS, the current April 1 submission deadline to the Assembly may not provide sufficient
time for staff to incorporate the service area budgets into the proposed budget and capital
program; and
WHEREAS, current code requires the school district funding request be submitted to the
borough by April 30 for incorporation into the borough budget and message, which is later than
the budget submission deadline to the Assembly; and
WHEREAS, the requirement to include the school district funding request in the borough budget
and budget message is proposed to be removed.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that:
Section 1: This ordinance is of a general and permanent nature and shall become a part of the
Kodiak Island Borough Code of Ordinances.
Section 2: Kodiak Island Borough Code of Ordinances Section 3.15.030 Budget and Capital
Program is hereby amended as follows:
3.15.030 Budget and Capital program

3.15.030 Budget and capital program.
A. On or before the first of April of each year, the manager shall submit the budget and capital program to the

4.20.030 Authority and duties of boards.
A. On or before March 31 st of each year, each board shall adopt a service area work program for the next
borough fiscal year. The work program shall be a detailed statement of the level of services desired by the service
area, and the service area's priorities for operating and capital expenditures.
B. Concurrently with the adoption of the service area work program, each board shall adopt a service area
operating budget and capital budget for the next borough fiscal year. The budgets shall be consistent with the
service area work program and shall be in a form compatible with the borough operating budget and capital
budget, respectively. The service area budgets shall be incorporated in the borough budget for submission to the
assembly.
C. A board shall participate in the administration of services in its service area in accordance with procedures
adopted under KIBC 4.20.020(D) and shall advise the manager and assembly regarding the execution of the work

Move to approve the letter of support for the recertification of Prince William Sound Regional
Citizens' Advisory Council.
DISCUSSION:
This letter is in support of the recertification submitted by the Prince William Sound Regional
Citizen's Advisory Council (PWSRCAC).
The Coast Guard seeks comments on the application for recertification submitted by the
Prince William Sound Regional Citizen's Advisory Council (PWSRCAC) from March 1, 2025,
through February 28, 2026. Under the Oil Pollution Act of 1990 (OPA 90), the Coast Guard
may certify on an annual basis, the PWSRCAC. This advisory group monitors the activities of
terminal facilities and crude oil tankers under the Prince William Sound program established
by the statute. The current certification for the PWSRCAC will expire February 28, 2026.
The Kodiak Island Borough has previously endorsed the same initiative in the past

The Kodiak Island Borough supports recertification of the Prince William Sound Regional Citizens'
Advisory Council (PWSRCAC). The council is seeking recertification as the voluntary advisory
group for Prince William Sound, Alaska, under the Oil Terminal and Oil Tanker Environmental
Oversight and Monitoring Act of 1990. The PWSRCAC was established after the Exxon Valdez
oil spill and has worked diligently for the past 35 years to fulfill its mission: citizens promoting the
environmentally safe operation of the Alyeska terminal and associated tankers.
We support recertification of the PWSRCAC as the citizens' advisory group for Prince William
Sound. The Kodiak Island Borough has found the Council, as required by the act, to be very
responsive and competent in carrying out its duties and responsibilities like the ones enumerated
below:
Monitoring Weather in Prince William Sound: The Council maintains two weather
buoys in Port Valdez, which have been collecting data for six years: one near the Valdez
Marine Terminal, the other near the Valdez Duck Flats. The Valdez Duck Flats weather
buoy was pushed off station by ice in February 2025, and plans are under way to relocate
it. These buoys improve understanding of weather conditions in Port Valdez that could
affect marine vessel safety and movement of spilled oil, as well as help with decisions
regarding the timing of protecting environmentally sensitive sites in the area. The Council
works with the Alaska Ocean Observing System and the National Oceanic and
Atmospheric Administration's PORTS° (Physical Oceanographic Real Time System) to
share the data collected by these buoys.
Marine Weather and Ocean Observing for Tanker Safety and Spill Readiness. Marine
weather and ocean observing are foundational to both spill prevention and response
readiness. PWSRCAC maintains two Port Valdez weather buoys (one near the Valdez
Marine Terminal and one near the Valdez Duck Flats) that have been collecting data for
six years; after ice pushed the Duck Flats buoy off -station in February 2025, the Council
has been working to relocate it and restore coverage. Data from these buoys, shared
through the Alaska Ocean Observing System and NOAA's PORTS@ (Physical
Oceanographic Real Time System), improves real-time understanding of conditions that
affect tanker safety, the likely movement of spilled oil, and the timing of protecting
environmentally sensitive sites. At the Gulf of Alaska scale, the Council has also

advocated for adequate funding for NOAA's National Data Buoy Center to reduce outages
at critical stations such as Seal Rocks (Station 46061), whose wind and wave data are the
primary inputs the U.S. Coast Guard uses for navigation -safety decisions for outbound
laden oil tankers. Council staff supported and provided testimony for an Alaska Legislature
joint resolution, passed in spring 2025, urging Congress and NOAA to address persistent
buoy outages; as of June 2025, the Seal Rocks buoy and others in the region had been
repaired or replaced and were operating properly.
• Protecting Alyeska Contracted Fishing Vessel Response Program: The Council
participated in a workgroup that helped develop a legislative solution to allow the current
fleet of vessels contracted by Alyeska's Ship Escort Response Vessel System, or SERVS,
to remain in their spill prevention and response system. This legislative solution was
included in the new National Defense Authorization Act (NDAA) passed by Congress in
2025. For context, in 2023, the U.S. Coast Guard issued a Work Instruction requiring
Certificates of Inspection for vessels that tow boom and other response equipment during
oil spill drills and actual incidents. This Work Instruction was issued in response to a
provision in the 2023 NDAA. Unfortunately, the Work Instruction applied to the fleet of
uninspected vessels contracted by SERVS. Most of these vessels were built for purposes
other than oil spill response, such as commercial fishing. If implemented, these
inspections would pose significant challenges, potentially delaying a response.
Additionally, many of the vessels have not been subject to this type of inspection before
and the modifications needed to be issued a Certificate of Inspection would likely exclude
many from the SERVS program altogether.
One of the most important lessons from the Exxon Valdez oil spill was that local fishing
crews not only help with a quick response but also provide important local knowledge and
skills. The SERVS contracted fishing vessel program forms the backbone of the oil spill
response system in Prince William Sound. If another real event were to occur, Alaska's
fishing crews are ready to respond.
• Ensuring the Adequacy of Secondary Containment Liners: The crude oil storage
tanks at the Valdez Marine Terminal are required to maintain secondary containment
systems to protect ground and surface water from contamination in the event of an oil spill.
Part of those systems is a liner that is supposed to hold spilled oil until it can be detected
and cleaned up. Investigations from 2014-2017 showed that there were cracks and holes
in the liner, indicating it may not prevent ground and surface water contamination if a spill
occurred from one of the large crude tanks. The Alaska Department of Environmental
Conservation (ADEC) recently requested that Alyeska select a method to test the integrity
of the liner. In early 2025, the Council released a report summarizing the findings from
and providing recommendations on a liner testing pilot study Alyeska conducted in July
2024. Subsequently, in August 2025, Alyeska announced they were changing to a new
testing method. The Council has enlisted technical experts to review this new information
and continues to coordinate with Alyeska and the City of Valdez as part of the ADEC's
established confer process as this issue moves forward.
• Monitoring of Cleanup Drills and Spill Response: PWSRCAC devotes considerable
effort to monitoring drills, exercises, and training events, as well as the responses to actual
incidents, which fortunately are relatively rare in Prince William Sound. Staff often
participate as members of drill planning teams along with ADEC, USCG, and industry. Drill
monitoring reports are prepared by staff and contractors. When significant spills occur,

Council staff, Board members, and volunteers work with Alyeska staff to understand why
they occurred and how Alyeska would prevent similar incidents in the future.
PWSRCAC works with industry and regulators to ensure response readiness, evaluate risks, and
propose solutions. We hope you will recertify PWSRCAC as the citizens' advisory group for Prince

Move to confirm the appointments of Dave Johnson to the Cook Inlet Regional Citizens
Advisory Council (CIRCAC), Jared Griffin to the Southwest Alaska Municipal Council
(SWAMC), and Manager Aimee Williams to the Prince William Sound Regional Citizens
Advisory Council (PWS RCAC).
DISCUSSION:
The terms for the current board members of CIRCAC and SWAMC are scheduled to end in
March 2026. Meanwhile, the PWS RCAC seat will conclude in May 2026. The proposed
motion outlines the appointments to the three boards.

KIBC 2.100.030 Mayoral Appointments
A. Members of boards, committees, and commissions, except for members of the board of
adjustment, members of the board of equalization, and elected service area board members,
are appointed by the mayor and confirmed by the assembly unless otherwise specifically
provided elsewhere in this code.
B. An appointment not confirmed by the assembly shall not become effective. The mayor
shall appoint a new applicant until an appointment is confirmed by the assembly. The mayor
may not appoint again the same person whose confirmation was failed by the assembly for
the same board, committee, or commission until the next annual appointment process unless
authorized by the assembly.
C. Except as specifically provided in a borough ordinance or resolution, borough employees
may not be appointed to, and are prohibited from serving on, nonelected boards, committees,
or commissions in the Kodiak Island Borough including boards, committees, and commissions
that were jointly established with the city of Kodiak. Borough employees may continue to
serve as ex officio members as provided in KIBC 2.100.170.

Kodiak is a class 1 member and is authorized to designate one individual representative for election to the Board as a voting director.

RECOMMENDATION:
Move to confirm the mayoral appointment to the Architectural and Engineering Review Board
of Daniel Rohrer for a term to expire on December 31, 2026 and Scott Arndt for a term to
expire on December 31, 2028.
DISCUSSION:
There are currently three at -large seats vacant on the Architectural and Engineering Review
Board. These appointments will assign Mr. Rohrer for a seat to expire on December 31, 2026
and Mr. Arndt for a seat to expire on December 31, 2028.
