Board of Directors,
as you lorcnr, I feel the R-3 height restriction of 35 feet is
reasonable ard should rsnain a restriction on building heightfor your lot. Itris is nV on1y problen wittr yor:r rezoning atterqt.
I*!r. lthr:ray stated that al-r o<isting pJans stro.r a building heightof 35 feel, qE_leqs. ff r,,e could use ttre contract zonilf prd

reluctance to agreeto contract zoni::g, wtr-ich uould restrict,
building height to 35 feet, r,rculd fuply int€nt to build cnzer 35feet, v*rich we rryould oppose. Ttrere are rnEuly reasons for pro-
tecti:ng ttre established rights, including vierr, of property c,$mersr
I{e believe that allcwing ttre zoning to ciunge ard prcnride forta1l buildings near tlre water at tJ:e e:q)ense of residents ftrrtlrer
aray r"nuld not senre ttre public interest and would not be a
reasonable aetion for the borough assonbly to rnake.
The argl.:nent of, "rot giving any concessions rrntil you have to"
seems i-nappropriate for this situation. It assr.rnes you have the
rezoni::g assured.
Tlo agree to a stitrxrlation ttrat has no effect on ycur pIans, past

trould also give'the surzor:rding property crv, rners a ccnrnitmentthat even if ottrer zoning restrictions such as setbacks, parking,
business activity, etc., are rella<ed, at leas{: tJ:e really
iJlportant one of btrildi-rlg height would be retajned. [Io,v rrrould
1ou like to buy a piece of vierr prolErty, pay the vieur properQrprice, and expect a 35 foot height restriction, then have the
Bonough ctnnge ttre nr.Les for one party that vpuld affect thequality of liJe for all ttre residtnts uphill frcnr tlre proje,,ct.
Ihat is like a person at the st-art of a stream dr-urping his
garbage into tlre str@m. It is soon not his poblsn at all.ft is, hor, rever, a real problon for his neigtrlcors dqlnstrearn. We
