Dear Rick:
Re:ZoningComptiancePermitsforThresholdRecycleContainers
I have been asked if there is a need to acquire a zoning compliance permit (zcP) for Threshold's
coveredshedsthatarebeingplacedinroadrightsofway,puuticlandoronprivatelandto
enco'rage residents to r."yIl". These,*y.lrbi; items-inciude: cardboard,_newsprint, white and
color paper, aluminum, piirti., a1d othernon putrescible-items. Your organization's efforts to
make recycling more convenient for residents are applauded' Convenience is one of the ways to
change the culture orno* waste is disposed of around Kodiak, and your wooden "containers"
make that convenience Possible'
SpecificallY, our power to collect garbage, rubbish and other solid waste is set up to operate as a
municipal utility as regulated by KIBC E.ZO' fnut power gives the Borough control over the
collection and disposaT of solid waste on the road system' That is' not just anyone can decide to
collect garbageor operate a landfi, on their own. In fact, the code prohibits that from occurring'
It states that ..no person may transport rubbish or trash to any locatio.n.off-site for the purposes of
disposal (e.g. burning, land filling, "tc'ii-
That is a duty and responsibility reserved to the
Borough Assembly and who they-choose to wotk with- The Assembly has made a conscious
decision to work *itt fn .rhold Services, Inc' on promoling recycling' As you know' the
Assembly has funded your organirution in an effort to effeclively remove certain classes of items
fromthewaste.tr.u,n,therebysavingvaluablelandfillspace'
Therefore, I view these recycle sheds as a "container" to deposit the types of rubbish that can be
recycled. Their purpose is similar," "
Jr*p*r. Thediffe..n". is that dumpsters are generaily
containers where pl.*"rui. material is coilected while your containers collect those non-
futrescible materials that can be recycled'
Based on the above, your recycle sheds will not require a zoningcompliance permit under Title
17, but are viewed as a solid waste contairer under Title 8 of thi Borough code' This decision
does not have any bearing on the ,..J io u"quire any building permits that may be needed'

Kodi€rk, Ak. 99615 Re: PIan Review of Senior Center
Dear John:
This letter is to follow up our telephone conversation regarding
the City of Kodiak's polJ.ey on review of the Seqior Center Plans.
It is my understanding that Mr. PauI Selberg sent a set of plans
(lf40) to your offices on May 17, 1984. I was una!{are that the
plans needed to be sent to fCBO for review prlor to the CIty
lssuing a bulldlng permlt for construction. I do see a problem
with the month turn around for the review. Further, you noted
that the cost of this review was S2r300.OO. You mentioned that
the City might waiv'e other fees for a construction project
of our type, but this expense would need to be borne by our
projeet. It is our intention and mentioned in the plans that
the contraotor would be responsible for the cost of the building
permit. Perhaps we can agree on some mechanism to handle the
distri.bution of costs.
At this time I would like to foriually request that the city
review the plans for code conpiionce in anticipation of our
request for a building permit. Md.rtionally, I would urge
your office'to e:<pedite our request as much as possible.
ft is our intent to oPen bids on the project on June 13
with award of the contract on June 2O and construction to
ccmJnencc on or about Ju1-y 1. I reccgnize it is the
contruction season, and Irm sure your office is very busy.
It is most important for us, however, that the project
not be delayed. Taking advantage of the summer weather
witl greatly help the quality and cost effectiveness of
our project.
K
Thank you for your attention to this matter. If there are
any special fees for timely consideration of our requestr
I would be haPpy to discuss them with you. Aga.i.n, our
desLre is to be ready for the contractor to start construction
on or about JuIy 1.

Dear Ms. hli I son:
RE: Request for a finding under Section 17.57.030 (Off Street Parking--

The Planning and Zoning commission, at their April 18, 1984 Regular

LORNA ARNDT, co-owner of lt lots ln the surroundlng area, spoke ln
opposition to the request.
ART BORS was presenE and was not opposed to the present Buslness zoning
of Mr. Arndt t s propercy.
OKEY CHANDLER was present and ques t ioned t,he lack o f park area f or
chlldren and suggested that untll parks are provided, he would like
to see the property rezoned to Residential.
COMMISSIONER PATTERSON questioned I'1r. Arndt on the denslt,y of the pro-
posed apartment complex, and I'1r. Arndt answered that f our of Ehe loEs
would have two elght-plexes, and maybe three four-plexes (cwo bedroom
unlts) over the next few years. Mr. Arndt had no definite plans for the
entire area.
COMI,IISSIONER HILL MOVED TO CONSIDER THE PETITION and the motion was
seconded. The questlon was called and the motlon FAILED by unanLmous
ro11 call vote.
THE COMMISSION STATED REASONS FOR NON-CONSIDERATION:
1. there uras no present need to rezone;
2. lt would be more appropriate if some of the land rdas owned
by people who originated the petitlon;
3. the land could be considered for rezoning 1n the near future,
along wlth publlc land ln the Lakeslde Subdlvlslon;
4. wlth the extenslon of the water and sehrer utilities, some rural
residential land in the area wlll probably be rezoned;
5. although there rras public oppositlon at the public hearing
on the orlginal rezone, the Borough Assembly did have the
opportunity to revlew the case and decided to go along and
rezone the property from Residenttal to Buslness; and
6. as the Assembly dld make the decislon to rezone the area,
the Commlssion felt they should not conslder the petltlon at

Nr
if Proposed Senior
meets Parking Requirements
Dear Ms. Freed:
As you are a\irare, the Senior Citizens of Kodiak, Inc. have received funding
for the construction of a Multi-Purpose Senior Center. In order to
expedite the project I would like to request that your offices review
our proposed project for compliance with present borough codes. fn
particular, I would like you to examine our compliance with the
parking requirements for a building our size.
In a letter dated Eebruary 7, 1983 Mr. Will Walton shared with our
director, Dennis Murray, the code requirements. Specifically, our
project was to address the requirement for 45 off-street parking
spaces. (Please note that there has been some change in the plans
since that date. I am enclosing the appropriate pages of our
most recent set of plans. ) The center intends to comply in the
following manner.
1) Please find attached a lease agreement between the
Senior Citizens of Kodiak, Inc. and Sunset Development
Corporation. You will note that the Senior Citizens
will make improvements to an undeveloped area for
20 parking spaces. In addition, the center will be
able to use existing spaces where there is not a
conflict with the tenants of Bayview Terrace Apartments.
The center anticipates the use of 7-10 spaces in
the existing parking lot. (At present, the center
uses 5-6 spaces for staff parking and center vehicles. )
2) Please find attached a letter from Mr. Rowe Redick of
the Dept. of Transportation and Pr-rblic Facilities.
' At our request, the department has offered the use of
I0 spaces in the Griffin Building Parking Lot.
3) The plans for the center provide for 8 off-street parking
spaces on site.
Adding up the cormnittments for spaces the proposed center does
meet the parking requirements of existing borough code. Further,
it is the center's belief that its daily requirements for
parking will be much less than the 45 spaces. At present, the

center' s activities grenerate B- 10 cars during peak
center will probably generate the most traffic on
and week-ends. This will be due to some center
but will be mostly due to scheduled community uses.
in Mr. Redick's letter, this is also the time when
Griffin Parking Lot will be available for use.
The board and f would appreciate hearing from your
at your earliest convenience. The board will be
regular meeting on Wednesday, April 18.

Bill Hodgins, Zoning offjce r/W
Lot 30, block 1, Kodiak Townsite Alaska Subdivis'i on
USS 25378.
Pursuant to your request for information on the setback require-
ments for a proposed 60' X 100' structure to be located on lot
30, block 1, Kodiak Townsite Alaska, USS 25378, please be advisedof the following:
If the lots owned by Ms. Christoffersen and Mr. Colvaho are
purchased, the total land area available would be 24,475 square
feet.
Please note that the smal'lest parcel owned by Ms. Christoffersenis only 600 square feet and is located at the north-easter'ly
portion of lot 30, and is not contiguous to the other three
parcels under consideration. I have not used this parcel for
figuring the required setbacks, but have used this land areafor fullfilling required off street parking spaces.
The setback requirement for a building in the R-3 multi-family
residential district are:
Front yard: 25 feet minimum unless a ny adjacent structures
are built closer to the front property line, then an average
may be taken to establish the front yard setback required.
Si de yard : 10 % of lot width, in this case, L0% of an
average lot width of 132' gives a side yard of 13.2 feet.
Rear yard : 25% of I of de pth, but need not exceed 25 feet.
The average lot depth for the parcels proposed is 216 feet, the
required setback would be the 25 foot min'imum as 25% of 216
feet is 54 feet.
Your required off street parking for a 6,000 square foot (60'
X 100') structure used for a "senior Citizen Center/Protected
Residential Care Facility" would be one space, 160 square feet
in area (8' wide by 20' feet long) for every room used for
t

residential purposes.
Pl ease note that recreat'i onal areas and storage faci I i t'ies uri thi n
the building are figured by a different criteria. Each separate
use may or may not have its own parking area requ'irement depend-
ing on the specific use intended.
It is safe to assume one space for each residential roomprovided. Specifics can be determined after the exact usefor each area within the structure is known.
With regards to lots 9,10 and 1.1 in this same area, please
be advised that they are zoned business and contain a total of
51,511 square feet in land area.
tlithin this zoning d'istrict your intended use of the lots is
not expressly permitted as a use, and you would therefore be
required to go before the Planning and Zoning Commission for
and exception to allow residential use of a business zonedlot (s) without also providing a business use concurrently
within the same structure.
Another avenue to pursue would be to apply to rezone'lots 9,
10 and 11. 0r lastly, simply provide for a business use within
the same structure.
Whatever way you go, your required setbacks for a structure onthis lot are as follows:
1. If a business use is not provided within the proposed
structure then the normal resiGfr'tial zoned setbacks are required
(Same requirements to be used as in 'lot 30) and
2. If a business use is provided then the only setback
required wou'ld be that the face of the structure can not be
closer than 35 feet to the centerline of Erskine Avenue.
The off street parking requirements are also determined the
same as in the last example for lot 30.
I hope this has answered your questions, if we can be of any
further assistance to you, please do not hesitate to ask.

City of Kodiak
Proposed Development Plan
A
B
Historical Perspective
7) eontinued....
(responsible for certain housing programs for the elderly) cone
to Kodiak to discuss Kodiakrs various options among the broad
range of possibilities for the provision of services and facilities
to the elderly popul-ation. Those discussions spari, ned the needfor adequate planning rup frontr on rvhatever course of actlon might
be taken by the community. To that end the Senior Citizens of
Kodiak established a Steering Conunittee for the examination of
various houslng/pioneer home/senior center alternatlves or
combinations. That comnittee (mernbership roster is attached) has
met tr^ri.ce, September 18 and December 30. Its focus to date has
been on producing a survey of seniors to determine the need for
housing alternatives. That has been accomplished. The board ofthe Senlor Citizens of Kodiak are now negotiating with Community
and Regional Affairs for a planning grant not to exceed $SO,OOOto study housing/senior center needs including site selection,
etc. L
Proposed Development Plan including Property Acquisition
Priority /11--Acquisition of adequate land and the construction of
a senior center/protected residential care facility.
A. The centerrs first choice for a site is the
adj acent property situated across Erskine Ave.
from Barryiew Terrace Apartments. The present
owners are : Ms . Annie Chri-s tof f ersen ( g parcels )
and a I'1r. Corvaho (1 parcel) . A rough estimate
of the ajoining parcels yields L9 ,259 sq. f t .
The legal description of the property is'Lot 30,
BIk llL, Original Kodiak Townsite. (see attachment)
B. The board would propose to use the planning funds
to explore various combinati-ons of facllities on
this parcel. At this point the board sees a need
for a building, 2 stories, with dimensi-ons of
-
60I X 100 , I There lnould probably be a need f or
15-20 off-street parking spaces.
C. The boardrs second choice for a site would be
Lots 9 , 10, and 11 of the Kodiak Townsite which
are situated on Mission and Erskine next to the
Bayview Terrace Apts. These properties have
a total- square footage of 51r521- sq. ft. (see attachment)
Priority /12--Acquisitlon of property which would accomodate the
construction of moderate l-ncome housing in Kodiak,
and the exl-ploration of sltes and construction of
housing in the outerlying communities
A. There is not much lnformation or knowLedge of the
economic viability of this proposal. The board
would pLan to work with CR&A in using the planning
funds to establish the need and viability of the
proj ects.
