AGREEMENT BETWEEN OWNER AND FUEL OIL DELIVERY CONTRACTOR
THIS AGREEMENT, made this 6th day of August, 1990, by and
between the Kodiak Island Borough, hereinafter called the
"Borough", acting herein through its Borough Mayor, and a
corporation/partnership/an individual doing business as Thompson
Transfer, Inc. of Kodiak, State of Alaska, hereinafter called the
"Contractor".
WITNESSETH: That for and in consideration of the payments
and agreements hereinafter mentioned, to be made and performed by
the Borough, the Contractor hereby agrees with the Borough to
commence Fuel Oil Delivery as described in the following:
Kodiak Island Borough Fuel Oil Delivery Performance Requirements
hereinafter called the "Fuel Oil Delivery Service Contract" for
the amount specified in Attachments A and B.
The terms of this agreement shall be from August 6, 1990,
through June 30, 1991.
IN WITNESS WHEREOF, the parties of these presents have
executed this contract in three (3) counterparts, each of which
shall be deemed to be an original, in the year and date first
above mentioned.

KODIAK ISLAND BOROUGH
FUEL OIL DELIVERY
PERFORMANCE REQUIREMENTS
The Kodiak Island Borough is requesting bids from qualified fuel
delivery firms for the supply and delivery of Number One (1) and Two
(2) heating fuel to various Municipal Facilities. A contract will be
awarded to the lowest responsive bidder for a period commencing
August 6, 1990 and ending June 30, 1991. Award will be made by
the Kodiak Island Borough Assembly during the regular scheduled
Assembly Meeting of August 2, 1990. Bids must be submitted on the
enclosed bid schedule. Bid evaluation will be based on the unit price
quoted times the estimated quantity resulting in an overall estimated
cost with award recommendation of the overall lowest estimated cost.
Actual price paid will be the unit cost times gallons delivered
substantiated by invoice. Price fluctuations throughout the contract
period will vary in direct proportion to suppliers actual fuel cost (i.e., If
suppliers cost rose or declined two cents per gallon, the price increase
or decrease to the Kodiak Island Borough would be two cents per
gallon without any other mark-up). Price variations must be
substantiated by adequate documentation. The supplier's delivery
system will insure adequate fuel levels be maintained in the Kodiak
Island Borough Facility tanks at all times. Cost associated with
deliveries made outside of normal working hours to fulfill this
performance requirement are to be borne by the successful bidder.
Estimated annual quantities noted are for bid comparison purposes only
and are not to be interpreted as guaranteed deliverable quantities.
Actual quantities delivered during the term of this contract will vary
depending on use required.
Before a contract is executed, the successful bidder will provide copies
of business licenses and insurance coverage required by Federal, State
and Local law.
Sealed bids will be received until 3:00 P.M. local time July 23, 1990
by the Kodiak Island Borough, Mayor's Office, 710 Mill Bay Road,
Kodiak, Alaska 99615.
