AGREEMENT
The Alaska Department of Community and Regional Affairs, Rural Development Division
(hereafter "division') and Kodiak Island Borough, (hereafter 'grantee') agree as set forth.
Section I. The department shall pay the grantee for the performance of the project work
under the terms outlined in this agreement. The amount of the payment is based upon
project expenses incurred which are authorized under this agreement. In no event shall the
payment exceed $205,631.
Section U. The grantee shall perform all of the work required by this agreement,
AS44.47.250--AS 44.47.310,19 AAC 65.011-19AAC 65.521, and 45CFR256.
Section III. The work performed under this agreement shall begin on July 1, 1990 and shall be
completed no later than June 30,1991.
Section IV. The agreement consists of this page, the Alaska Statutes and Administrative code,
applicable federal law, and the following:

ATTACHMENT A. DCAP & TCCB GENERAL PROVISIONS
ARTICLE 1. GRANTEE CERTIFICATION. The grantee certifies that it possesses
lawful authority to accept grant funds from the State of Alaska and to execute the
work described in this document by its signature on the grant agreement.
ARTICLE 2. GRANTEE NOT OFFICER, EMPLOYEE, AGENT OF THE STATE.
The grantee and any agents and employees of the grantee are not officers or
employees or agents of the state in the performance of this grant agreement.
ARTICLE 3. EQUAL EMPLOYMENT OPPORTUNITY (EEO). The grantee may not
discriminate against any employee or applicant for employment because of race,
religion, color, national origin, age, physical handicap, sex, marital status, changes
in marital status, pregnancy or parenthood. The grantee shall post in a conspicuous
place, available to employees and appplicants for employment, a notice setting out
the provisions of this paragraph. A grantee shall state, in all solicitations or
advertisements for employees to work on state funded pro),ects, that it is an equal
opportunity employer and that all qualified applicants will receive consideration
for employment without regard to those issues in this paragraph.
The grantee shall include the provisions of this EEO article in every contract
relating to this grant agreement so that those provisions will be binding upon each
subcontractor.
ARTICLE 4. EQUAL PROGRAM ACCESS. Thegrantee may not discriminate
against any program applicant or client because of race, religion, color, national
origin, age, physical handicap, sex, marital status, changes in marital status,
pregnancy or parenthood.
ARTICLE 5. JURISDICTION; WAIVER OF IMMUNITY. A grantee agrees that the
state has jurisdiction over itpertaining to the administration and litigation of this

grant agreement, aexpressly waives any immunity claims it may have.
ARTICLE 6. CONFIDENTIALITY The grantee is responsible for maintaining
confidentiality in accordance with the requirements of 19 AAC 65.391 and
7 AAC 37.010 -- 7 AAC 37.130.
ARTICLE 7. CLOSEOUT. The grantee shall have requested all subsidy and
administrative payment under this grant by the 45th day after the termination date
of the grant agreement, at which time the division may initiate closeout procedures.
H. CONDMONS OF AWARD
a. The grantee shall submit complete and timely statistical reports, and
requests for grant subsidy and administrative costs within 21 days
following the end of the reporting calendar month.
b. The grantee shall provide the Day Care Assistance Program and
transitional child care benefits to participating parents within the
corporate boundaries of the Kodiak Island Borough. The grantee shall
provide transitional child care benefits (TCCB) to a participating parent in
a geographic area not served by a DCAP/TCCB grant, at the request of the
division.
c. The grantee shall pay transitional child care benefits (TCCB) subsidy for a
participatingparent for a period of time not to exceed 12 consecutive
calendar months.
d. The grantee shall provide a miuumum of 10 calendar days' notice to a
participating TCCB parent before reducing that parent's amount of
subsidy.
e. The grantee shall notify the division of a participating TCCB parent's
ineligibility within 24 hours of the discovery of that ineligibility, defined as
nonpayment to the provider or failure to arrange payment as described in
19 AAC 65.471, loss of employment, and/or return to AFDC benefits.
f. The division will make monthly subsidy and administrative payments
contingent upon the conditions in a. above, in accordance with the other
provisions of this grant agreement, and with state and federal laws and
regulations.
g. Travel and per diem may be used only for transportation and per diem
cost directly incurred for attendance at the Department of Community &
Regional Affairs' annual local administrator's conference (State maximum
per diem rate of $80.00 applies).
