DEPUTY CLERK FLEXIBLE TIME AGREEMENT
THIS AGREEMENT is made this _4� day of August, 1992,
between JUDI NIELSEN, the Deputy Clerk for the Kodiak Island
Borough, and the KODIAK ISLAND BOROUGH, a municipal corporation.
The parties acknowledge that Nielsen is subject to the
provisions of the Personnel Rules and Regulations of the Kodiak
Island Borough, and specifically the provisions of Personnel Rule
411 with respect to overtime payment. In addition, the Deputy
Clerk is frequently required to participate in meetings of the
Kodiak Island Borough Assembly, regularly held on Thursday
evenings, which may last for up to three to four hours. The
purpose of this agreement is to provide for a flexible work
schedule for Nielsen so that she will not be required to work any
unnecessary overtime and so that the borough will not be required
to pay for any unnecessary overtime.
Accordingly, the parties agree as follows:
1. Donna Smith, the Clerk of the Kodiak Island Borough,
will keep Nielsen informed of the schedule for meetings of the
Kodiak Island Borough Assembly and any other boards and commissions
at which Nielsen's attendance is required. After consultation with
Nielsen, Smith will assign a flexible work schedule for any meeting
dates which will include a shorter work period for Nielsen prior to
5:00 o'clock p.m. to compensate for the estimated time she will
work during evening meetings. This schedule will be provided to
Nielsen no later than the day prior to any scheduled meeting.
2. Notwithstanding the foregoing, Nielsen will be paid
for the actual hours which she works, including time and one-half
overtime for hours in excess of eight hours in one day as provided
in Personnel Rule 411.1.
3. This agreement is the complete agreement between the
parties with respect to this flexible work schedule but is not
intended to modify any other provisions of Nielsen's employment by
the borough.
