FY1998-20 Karluk Economic ProgramKIB CONTRACT NO. 98-20 KARLUK I.R.A. TRIBAL COUNCIL RESOLUTION NO. QB—D.L COOPERATIVE AGREEMENT An agreement by and between the Kodiak Island Borough and the Karluk IRA Tribal Council. WITNESSETH: WHEREAS, the Kodiak Island Borough and the Karluk IRA Tribal Council have identified need in the Karluk community to expand economic opportunities and improve service in the community; and WHEREAS, the Kodiak Island Borough contemplates submitting on behalf of Karluk IRA Tribal Council an application for CDBG Grant Funds from the Department of Community and Regional Affairs for the purpose of meeting such needs; and WHEREAS, the Kodiak Island Borough and Karluk IRA Tribal Council desire, and are required to, enter into a written cooperative agreement with each other to participate in such CDBG program; and WHEREAS, the Kodiak Island Borough and the Karluk IRA Tribal Council understand that the Kodiak Island Borough will act as the applicant and will have the ultimate responsibility to assume all obligations under terms of the grant including assuring compliance with all applicable laws and program regulations and performance of all work in accordance with the contract. Further, Jerome M. Selby, Kodiak Island Borough Mayor, will be the contact person for this project; and WHEREAS, it is understood that the Kodiak Island Borough and DCRA have access to all participants' grant records and authority to monitor all activities; and WHEREAS, it is understood that the Karluk IRA Tribal Council will be responsible for and will provide all maintenance and upkeep on an annual basis on the public health facility building proposed for funding. NOW, THEREFORE, it is mutually agreed between the Kodiak Island Borough and the Karluk IRA Tribal Council as follows: 1. The Kodiak Island Borough and the Karluk IRA Tribal Council must assure that the Karluk IRA Tribal Council will receive some specific benefit (i.e. usefulness, advantage, return) for the residents of the rural community for a specified period of time. Karluk IRA Tribal Council Resolution No. _ Page 1 of 2 2. The Kodiak Island Borough and the Karluk IRA Tribal Council agree to cooperate in the submission of an application for such CDBG grant funds, and agree to cooperate in implementation of the submitted CDBG program, as approved by the Department of Community and Regional Affairs. Nothing contained in this agreement shall deprive any municipality of any power or zoning, development control, or other lawful authority which it presently possesses.
