I don't believe that the comments, late though they are, should impact DGC's action with regard to these projects. 1. COE# R- 710039 St. Paul Harbor Improvements - Modification. I sent you comments when you originally put this project out for the 15 -day comment period. We do not believe that the modification identified warrants further ACMP (or KIBCMP) review, and we have no additional substantive comments. The Kodiak Island Borough fully supports this project, in its entirety. 2. COE #D- 920699 (Lake Catherine) Fill in Swampy Acres. I've searched our files, and I haven't been able to find the one for the original project proposed in this location in 1992/93. My recollection is that we (the Kodiak island Borough) generally had no objection to the proposal, but that since it included a landfill regulated by ADEC, it was likely going to require some additional review and approvals from the Borough. I also recall that ADFG had some concerns with the "original" project proposal. I believe that the project, as currently designed eliminates aspects of the project that were of concern to ADFG. The property was actually rezoned from C- Conservation to B- Business in early 1991, and filling (with clean fill) is commonly done on business lots in the Kodiak urban area. In addition, there are numerous other, larger, and likely more valuable, wetlands in the vicinity. We have no objection to the proposal. However, if possible, we would like to advise the applicant that this project will likely require a grading permit issued by the City of Kodiak building department, on behalf of the Kodiak Island Borough. Since engineered drawings of the project are already completed, this permit process should be relatively simple. Thank you for the opportunity to comment on these two project proposals. I was out of state for two weeks and I just got back to the office yesterday This comment is more for your files than anything else. The Kodiak Island Borough offers these comments on the City of Kodiak's project to reconstruct St. Paul Harbor: While the proposed modifications are significant from a user and operational standpoint, they are insignificant from an impact and effect standpoint. The repairs and modifications are long over due and will only enhance the Tong -term operation of the harbor. This harbor has been a feature of the community for many years - much pre- dating the ACMP. There is no need to conduct an ACMP review of this project. The project is supported by the entire community, and is being funded with a deferred maintenance capital grant from the State of Alaska. Both the DOT and Corps are working with the city as they proceed with this project. We are unaware of any federal or state permits that are necessary for the project to proceed. The St. Herman Improvernonts are thc follow on to the project that was anticipated and permitted under U.S. Corps #M-930425 and State of Alaska ID #AK9408-I9AA, For this project, a consensus was not arrived at for the final design until just recently and our submittal depicts the City of Kodiak's-Port and 'Harbors Advisory Council decision on how to proceed. It is our belief that both of these projects fall within a modification to existing pemiits. but we defer to your review and thoughts on the matter. NUMBER AK 9505-48AA The Division of Governmental Coordination (DGC) has completed coordinating the State's review of your project for consistency with the Alaska Coastal Management Program (ACMP). On July 27, 1995 you were issued a proposed consistency determination for your project. The project location is the northeast corner of the St. Paul Harbor, the City of Kodiak's small boat harbor. The proposed work would remove approximately 3,000 cubic yards of hydrocarbon-contaminated sediments and discharge it behind two timber retaining walls -- one 20 feet long by 110 feet wide; the other 20 feet wide by 400 feet long. A membrane will be placed around the dredge spoils and a perforated collector pipe installed at the bottom of the fill to capture possible contaminant leachate. - Approximately 700 cubic_ yards of course rock base material will be discharged along the front of the two retaining walls. The total area filled below the high-tide line would be approximately 0.23 acres. The usable uplands created along Shelikof Avenue would be used for marine-related activities. Based on modifications to your project that represent a consensus between you and the State, as provided for under 6 AAC 50.070(k), the State concurs with your certification that the project is consistent with the ACMP. These modifications will appear as stipulations on the State permits noted: 1. _ Material such as sorbent pads or booms shall be available on -site to contain and cleanup any fief spilled or exposed as a result of this activity; 2. During the dredging of material from the harbor, a silt curtain must be installed and maintained on the seaward side of the dredging area to prevent dredging area water from mixing with the marine waters prior to the settling of silts; 3. The wooden portions of the dock will not be treated with any preservative containing pentachlorophenol. If treated with creosote, the creosote must be applied via a pressure treatment, not painted or soaked into the wood; 4. Dredging activities shall be conducted only between July 1 and April 14. These modifications are necessary to protect important habitat from the accidental discharge of a toxic material or the spreading of suspended fine particulates from the dredging site into the marine environment (modifications 1 and 2). Early life stages of aquatic biota are protected from leachate from toxic substances with the third modification and impacts to vulnerable life stages of king crab and pink salmon are minimized with the fourth modification. These modifications ensure consistency with the statewide habitat standard (6 AAC 80.130) and water - quality standard (6 AAC 80.140) and policies -of -the KIB, Coastal Management - Program, - specifically., Industrial Development policies 2, Natural Features, and 5, Facility Design, and Air and Water Quality policies 2, State -of -the -Art Technology, and 3, Wastewater Discharge. A copy of the relevant ACMP statewide standards and district policies is enclosed. As provided under 15 CFR 930.64(c), federal authorization of your project will be made with the full understanding that your original project proposal has been modified as described above. (c) In addition to the standard contained in (b) of this section, the following standards apply to the management of the following habitats; (1) offshore areas must be managed as a fisheries conservation zone so as to maintain or enhance the state's sport, commercial, and - _subsistence fishery; (2) estuaries must be managed so as to assure adequate water flow, natural circulation patterns, nutrients, and oxygen levels, and avoid the discharge of toxic wastes, silt, and destruction of productive habitat; (3) wetlands and tideflats must be managed so as to assure adequate water flow, nutrients, and oxygen levels and avoid adverse effects on natural drainage patterns, the destruction of important habitat, and the discharge of toxic substances; (4) rocky islands and seacliffs must be managed so as to avoid the harassment of wildlife, destruction of important habitat, and the introduction of competing or destructive species and predators: (5) barrier islands and lagoons must be managed so as to maintain adequate flows of sediments, detritus, and water, avoid the alteration or redirection of wave energy which would lead to the filling in of lagoons or the erosion of barrier islands, and discourage activities which would decrease the use of barrier islands by coastal species, including polar bears and nesting birds; (6) high energy coasts must be managed by assuring the adequate mix and transport-of-sediments and nutrients and avoiding :redirection of transport processes and wave energy; and (7) rivers, streams, and lakes must be managed to protect natural vegetation, water quality, important fish or wildlife habitat and natural water flow. (d) Uses and activities in the coastal area which will not conform to the standards contained in (b) and (c) of this section may be allowed by the district or appropriate state agency if the following are established: (1) there is a significant public need for the proposed use or activity; (2) there is no feasible prudent alternative to meet the pubic need for the proposed use or activity which would conform to the standards contained in (b) and (c) of this section: and (3) all feasible and prudent steps to maximize conformance with the standards contained in (b) and (c) of this section will be taken. Natural Features Dredge and fill, excavation, shoreline alteration, and disturbance of anadromous streams, tideflats, and wetlands shall be minimized when constructing and operating port, harbor, dock, industrial and energy facilities - if permitted under applicable regulations. 3. Views and Access Development shall be conducted in a manner that mitigates adverse impacts upon the Kodiak Archipelago; developers are encouraged to provide opportunities for public access to the shoreline and scenic views, whenever feasible and safe. . 4. Dredge spoil may be utilized in shoreland landfills if permitted under applicable regulations for the purpose of creating usable waterfront land. Facility Design Developments in or over the water, such as piers, docks, and protective structures shall be located, designed, and maintained in a manner that prevents adverse impacts upon water quality, fish, wildlife, and vegetative resources, and minimizes interruption of water circulation patterns, coastal processes and navigation. 6. Buffer Zones Buffer zones should be established between industrial areas and major public transportation routes and between industrial development and adjacent, non - industrial properties in order to minimize conflicts between land uses. 7. Accessory Development Accessory development that does not require a shoreline location in order to carry out its support functions shall be sited away from the shoreline whenever there is a feasible and prudent inland alternative. This category includes parking, warehousing, open air storage, waste storage, treatment or storm runoff control facilities, and utilities. 8. Wetlands Filling and drainage of water bodies, floodways, backshores, or natural wetlands shall be consistent with ACMP Standards 6 AAC 80.070 (Energy Facilities) and 6 AAC 80.130 (Habitats). Upland habitats shall be managed to retain natural drainage patterns, prevent excessive runoff and erosion, surface water quality, and natural ground -water recharge areas. Hart= Harbor, small boat harbor, and marina designs should include facilities for proper handling of sewage and refuse. Water channels should be interconnected to aid in maintaining water flushing action. Siting The Kodiak Island Borough shall work with proposals for large -scale industrial facilities to evaluate emission and effluent dispersion, and assist in siting the facilities. 6. The project includes the dredging of approximately 3,000 cubic yards of hydrocarbon- contaminated sediments from the St. Paul Harbor and discharge of the material behind two timber retaining walls -- one 20 feet wide by 110 feet long; the other 20 feet wide by 400 feet long. A liner will be placed around the dredged spoils and a collector pipe installed to capture any possible contaminated leachate. Approximately 700 cubic yards of coarse rock will be discharged along the front of the two retaining walls. The total area filled below the high tideline is approximately .23 acre. After the area has been allowed to settle, the resulting uplands created by the fill will provide needed area for marine-related activities. This project will accomplish many positive objectives for the community. It will remove the contaminated sediments from the harbor area, while at the same time eliminating a grounding problem for vessels in this area of the Harbor. PURPOSE: Remove accumulated sediments from .the small boat harbor to maintain navigation, dispose of hydrocarbon contaminated sediments and create usable uplands along Shelikof Avenue. ADDITIONAL INFORMATION: The applicant has indicated that the surface material of the accumulated sediments to be dredged is contaminated with hydrocarbon residuals from a storm event that washed material into the harbor through the storm drain system. The fill area would be capped with coarse material and paved. A membrane would be placed around the dredge spoils and a perforated collector pipe installed at the bottom of the fill to capture possible contaminant leachate. The Alaska Department of Environmental Conservation (DEC), Kodiak Office has indicated that the proposed disposal and containment method would be acceptable. WATER OUALITY CERTIFICATION: A permit for the described work will not be issued until a certification or waiver of certification as required under Section 401 of the Clean Water Act (Public Law 95-217), has been received from the DEC. COASTAL ZONE MANAGEMENT ACT CERTIFICATION: Section 307(c) (3) of the Coastal Zone Management Act of 1972, as amended by 16 U.S.C. 1456(c) (3), requires the applicant to certify that the described activity affecting land or water uses in the coastal Zone complies with the Alaska Coastal Management Program. A permit will not be issued until the Office of Management and Budget, Division of Governmental Coordination has concurred with the applicant's certification. PUBLIC HEARING: Any person may request, in writing, within the comment period specified ill this notice, that a public hearing be held to consider this application. Requests for public hearings shall state, with particularity the reasons for holding a public hearing. CULTURAL RESOURCES: The latest published version of the Alaska Heritage Resources Survey (AHRS) has been consulted for the presence or absence of historic properties, including those listed in or eligible for inclusion in the National Register of Historic Places. FLOOD PLAIN MANAGEMENT: Evaluation of the described activity will include conformance with appropriate State or local flood plain standards; consideration of alternative sites and methods of accomplishment; and weighing of the positive, concentrated and dispersed, and short and long-term impacts on the flood plain. -2- SPECIAL AREA DESIGNATION: EVALUATION: The decision whether to issue a permit will be based on an evaluation of the probable impacts including cumulative impacts of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so, the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, floodplain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities,involving 404 discharges, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agency's 404(b) (1) guidelines. ' (Reverse of ENG. FORM 4345) •U./` iemment Printing Office: 1991- 526 - 235140301 4a ACTIVITY In 1991 a long duration rain fall created slides in the downtown region of Kodiak. In a short period of time, materials from those slides including fuel oil from ruptured tanks, washed into the City of Kodak's storm drain system. Thousands of yards of sands & silts were deposited into St. Paul Harbor via a culvert which daylighted into the harbor. The lighter material was carried throughout the harbor, however the majority of material deposited within 300 feet of the culvert. The City of Kodiak received an emergency grant to complete the required dredging. The City began the project by taking soil samples in the area to be dredged. The findings indicated that the surface sediments were contaminated with hydrocarbons. The A.D.E.C. was contacted and a series of meetings were held. The construction activity for which we are submitting this permit was the result of these meetings. Because there are no available upland sites for storage of contaminated soils in Kodiak, and since contamination was near background levels, the concept to contain the dredge spoils within a shoreline bulkhead was developed. The A.D.E.C. local representative in Kodiak suggested this was the most acceptable option available to the City. Our plan will be to construct the geotextile wall bulkheads along the harbor slopes leaving a void between the wall and the natural harbor slopes. Dredging will be by clam or suction and material will be transported to the void where it will be deposited. After a period of time, when all settling has occurred the spoils will be capped and an asphalt concrete pavement will be applied. 4b. PURPOSE The 3,000 cubic yards of sediment has filled one corner of the harbor causing severe problems for vessels using the harbor in this area. During periods of low water the floats go aground rendering them useless. The impacted area serves as the only transient dock for smaller vessels in the harbor. The dredging will eliminate this problem. The bulkhead will be constructed of timber and geotextiles which will create a stable and cost effective method to contain the dredge spoils. Approximately 230 vessels are registered in St. Paul Boat Harbor which is located in the heart of downtown Kodiak. Upland area for marine-related activities adjacent to the harbor is in critically short supply. The bulkhead will create that additional space so severely needed along Shelikof Avenue- a major thoroughfare fronting the boat harbor which serves as one of only two points of entry to the harbor. Changes to stipulations can be based only on the ACMP standards (6 AAC 80) or 1 enforceable district policies; a change to department's policies or guidance, which are not incorporated in the ACMP, are irrelevant to the review of modifications. If the applicant does not agree to the modified consistency determination the project is subject to 6 AAC 50 elevation procedures. DGC has set the comment deadline for this 15 -day project alteration policy review as 11/25/94. At this time, reviewers are to comment whether you believe the project modification has: a) insignificant effects and the previous conclusive finding is still complete and valid; b) minor effects that don't warrant a longer consistency review, but stipulations must be modified, added or deleted to ensure the project remains consistent with the ACMP (reviewers must request the specific change and provide the ACMP rationale); or c) significant effects that warrant a 30- or 50 -day review (reviewer's comments must include an explanation of the significant effects that are different from the original project and a rationale as to why the project would no longer be consistent under the previous consistency determination). The average sheetpile bulkhead fill width would extend approximately 100' waterward to a depth of -25' mean lower low water. 3,000 cy of armor stone protection (approximately 4' thick, 50'-60' wide, and 100' in length) would be placed around the bulkhead ends. Total amount of intertidal and subtidal areas proposed to be filled is 1.3 acres, for the two-phase project (0.61 acre previously authorized). The bulkhead will require 15,250 c.y. of new fill placed below HTL, which will be protected by 3,000 c.y. of armor stone increasing the subtidal footprint by 0.09 acres. It is our belief that a "win-win" solution can be developed to: 1) Preserve the integrity of residential community around Pearson Cove. 2) Provide alternatives to the proposed industrial dock construction on tidelands parcel P-19. 3) Enhance and protect the integrity of Pearson Park. 4) Provide "mitigation" for loss of intertidal habitat on Near Island. We would, propose that tideland parcel P-19 be purchased from the current owners and be made a part of the Pearson Cove Park in exchange for our assistance in "mitigation". This would allow the owners the option to relocate on another piece of property that could more easily be developed for their project. Pearson Cove is a similar shallow nearshore habitat to the area filled on Near Island and is located in near proximity. Pearson Cove is the closest shoreline to three schools and has been used for field trips for many years. The tide pools and associated intertidal organisms have instilled a sense of wonder to generations of Kodiak school children. The cove is frequented by many sea birds and marine mammals including, but not limited to, seven species of "federal concern": harlequin ducks, stellar's eiders, stellar sea lions, harbor seal, sea otters, and occasionally killer whales (who have been observed to kill and eat sea lions near by). Bald eagles also perch on nearby trees and feed on gulls and ducks in and near the cove in the late winter when other food sources are not available. Pearson Cove is also used for sport and subsistence fishing and food harvest. Biologists in our neighborhood have observed both adult and juvenile king crab as well as other species of crustaceans in the cove. Before the fill was placed behind the sewer line nearly all species of crab larvae were observed within the giant tidal pond. We would propose to enhance the educational opportunities by: 1) Creating a marine education interpretive kiosk; laminated posters including: intertidal organisms, marine mammals, and marine birds. 2) Improving the tide pools on the adjacent point. 3) Improving access to the beach. We would propose to eTihmrIce the habitat for king crab larvae and other species: 1) Create enhanced habitat for king crab (and other species) larvae settlement and rearing. 2) Enhance habitat for marine water fowl, and juvenile fish. This could be done with either biodegradable substrate such as weighted christmas trees or ,.2\Creating an artificial reef (not causing a navigational hazard) • -;.),;with.king crab pots filled with netting. Nylon netting attracts ' hydroids and other organisms which, provide a highly desirable settling habitat for crab larvae and ' veniles as well as other juveniles marine species. The pot frames would provide attachment for algae • which in turn would provide habitat for juvenile fishes such as rock bass and greenling. The artificial reef could provide for additional feeding opportunities for many species of marine life potentially benefiting all federal species of concern which frequent the area to feed and rest. This is not a final proposal but a conceptual framework that would use available skills and fishing vessels of the residents of our community. It would provide a positive solution for all parties while recycling old fishing gear to create habitat enhancement for king crab and other species. This proposal will need to be refined further if it is accepted as a viable concept. We will look forward to further dialogue you and your staff.
