Ivan: The City of 1Codiak's rezoning request on the above referenced property was considered by the P & Z Commission during their regular meeting held on October 19, 1977. In that meeting the Commission tabled action on your request until the third regular meeting following the adoption of the New Regional Comprehensive Planabut no later than the P & Z Commission regular meeting in April of 1978, whichever comes first. In the interim, however, the Commission expressed a desire to get together with'the City Council in a work session or sessions to discuss the above application in depth for the purpose of determining the best future use of the property The Commission feels that they did not have sufficient information to base a decision on as required under Section 17.72.030 of the Kodiak Island Borough Zoning Code. That section of the code in part states that an application for a change in the boundary of a district be accompanied by such data and inform- ation as may be necessary to, assure the fullest practicable presentation of facts and shall set forth reasons and justification for proposing such changes. The P & Z Commission has proposed the date of November 17, 1977, at 7:30 p.m. for a joint work session between the two government agencies. If this date is acceptable to the Council, please let us know as soon as possible so we can plan accordingly. Vacation of a construction easement along Lots 1, 2, and 3, Block 1 Mountain View Subdivision (Zinn, Sluman & Killen). Staff reported the petitioner's are requesting a vacation of a 20' construction easement on Lots 1, 2, and 3; the easement is located on the north side of Three Sisters Way, off Otmeloi Point Road. This area is very steep adjacent to the road right of way. The purpose of the easement is to provide a road shoulder slope stabilization easement when the road is fully completed. Staff recommended the requested vacation be denied as a public purpose still exists. Chairman Busch closed the regular meeting and opened the public hearing. IN FAVOR DAN OGG: Stated he had the understanding that the road meets Borough standards. TED ZINN: Stated he wants to construct a garage and needs the extra footage. SUSAN KILLEN: Stated she wants to put in a well within the easement area. THERESA SLUMEN: Stated the road needs improvement. OPPOSED - None Chairman Busch closed the Public Hearing. Following some discussion Mr. Ball moved to approve the vacation of a construction easement along Lots 1,2, &3,,Block 1 Mountain View Subdivision (Zinn, Sluman and Killen). Mr. Pugh seconded the motion. Motion failed 4 -2 with Mr. Pugh and Mr. Busch casting NO votes. B. Rezone a portion o ISS 2537 B. (Harbormaster Building and parking lot area), from Service Recreational to Business, City of Kodiak. Mr. Milligan reported although the property is located immediately adjacent-to the Kodiak R -19 Renewal Project it is outside the project boundary. The reason for this rezoning request is that an illegal business use is being conducted in the Harbormaster Building and while this rezoning would have no effect on other existing uses of the land as all such uses are allowed in Service Recreational and Business Districts.. The change could open the door to pressures for additional business use of the land which might result in reducing the existing parking lots. This application does not come under the moratorium. Staff recommends a work session with the Kodiak City Council and City Manager for determining the best future use of the property. The Chairman opened the Public Hearing. IN FAVOR IVAN WIDOM, City Manager, would like to rezone the block where the Harbormaster Building and parking lot is located. The City of Kodiak owns the entire block. Although the City is aware of being in violation of the KIB Zoning Code by allowing a business in the Harbormaster Building, they have renewed the lease for an additional 2 years. CAROL LECHNER: Councilwoman, stated that the City Counci is willing to meet with the P & Z Commission for a work session. OPPOSED PAT HOLMES stated he is not opposed to the present use of the building; feels that a special exception is the route to go. JEANNE PAINTER: She was in agreeance with Pat Holmes. SUE PAINTER: Stated she was opposed. The Chairman closed the Public Hearing. Mr. Pugh moved to table the request to rezone a portion of USS 2537 B (Harbormaster Building and parking lot area) from Service Recreational to Business (City of Kodiak), until the third regular meeting following the adoption of the New Regional Comprehensive Plan, but no later than the regular meeting of the P & Z Commission in-April of 1978. Mr. Ball seconded the motion. Motion passed by unanimous vote. KODIAK ISLAND BOROUGH MEMORA,NDUM TO: P & Z Commission FROM: Planning Department SUBJECT: Request for rezoning RE: Rezoning from Service Recreation to Business, a portion of USS 2537 B The City of Kodiak has requested that the property adjacent to the Small Boat Harbor, where the Harbormaster's office and parking lots are located, be rezoned from Service Recreational to Business. This entire block under consideration is owned by the City of Kodiak. While this property is located immediately adjacent to the Kodiak R-19 Renewal Project it is outside the project boundary. This request was prompted by action of the City of Kodiak City Council when they were advised that a tenant occupants use within the Harbormasters Office Building was not permitted in the Service Recreation District. In renewing that lease they have requested this rezoning. This rezoning would have no effect on the other existing uses of the land as all such uses are allowed in both the Service Recreational District and the Business District. However, this change could open the door to pressures for additional Business use of the land which might result in reducing the existing parking lots. At this time Staff feels it is critical to the community to preserve the low profile of development which has occurred on this land and to maintain the open space which it provides. The parking is vital to the continued growth of the downtown area, without which growth will stop or shift to other locations. Page 2 Staff recommends action on this request be-postponed following, the public hearing-until after completion of the Comprehensive Plan. This will offer an opportunity for the City's tenant to continue doing business at this location pending Plan completion. It will also offer the City an opportunity to work closely with, the Commission in developing the best possible plan .for ultimate use of this property. When I leased the upstairs in the Harbor Master Building, I was under the impression that I would be leaseing it for several years. Due to zoneing laws I was told that Kodiak Kobblers would have to move out at the end of my years lease. I am not asking to change the zoneing law, only that I be granted an 90 day extension. I am having to move at the hight of my season which could be disastrous. Also in three months I will have a new building to move my business into.
