FY2008-21 Approval of Lease for the Storage of Bayside Fire Station’s Engine 11 ~ttLLI ~C()? -.;)/ LEASE AGREEMENT This lease agreement is made this hi day of November, 2007, by and between Ralph Bors of PO Box 3549, Kodiak, Alaska 99615 ("Landlord"), and the Kodiak Island Borough of71O Mill Bay Road, Kodiak, Alaska 99615 ("Tenant") For and in consideration of their respective promises, and upon the following terms and conditions, the parties agree as follows: 1. Premises. Landlord hereby leases to Tenant a portion of the improved real estate located at 3751 East Rezanof Drive in the Kodiak Recording District, State of Alaska, more particularly described as follows: A 700 sq. ft. area on the west end of the 36 foot by 68 foot building cross hatched on Exhibit A. 2. Term of lease. The term of lease shall be for one year commencing on the 15- day of October, 2007. For a period of up to six months after that time, the lease may be extended on a month to month basis by the tenant. 3. Rental Rate. Tenant shall pay to the Landlord for the use and occupancy of the leased premises the sum of one thousand dollars ($1000.00) per month. Rent is due on the first of each month, to be paid by mail or bank transfer to TNN Mini Warehouse. 4. Utilities. a. Landlord shall provide electricity to the premises. b. Tenant shall provide at his expense all other utilities and services used at the leased premises, including, but not limited to, the following: . (1 ) Telephone ~' ft-"-c- (2) Heating Fuel (3) Garbage Collection c. Interruption of Services. Landlord shall not be liable for any loss or damage caused by or resulting from any variation, interruption, or failure or such utilities or services. 5. Alteration of premises. Tenant shall not make any alternations, additions, or improvements in or to the leased premises without prior consent of landlord. 1 6. Hazardous Substances. Tenant shall not discharge any waste oil or other petroleum products or any other substances which are defined as hazardous substances under state or federal law on or about the leased premises. 7. Maintenance and Repairs. a. Landlord's maintenance. Landlord, at its cost, shall maintain in good condition the following: (1) The structural parts of the building including, roof, walls, doors. (2) Electrical System. (3) Access and egress from both doors. This would include a reasonable amount of snow removal and sanding. b. Tenant's maintenance. At the commencement of the lease, Landlord shall provide the heating system and light fixtures in good condition. Thereafter, Tenant at its cost, shall maintain the interior of the premises, including, but not limited to the heating system and lights. 8. Insurance a. Landlord shall have a policy of insurance covering loss or damage to the premises only. There is no obligation of Landlord to insure property of Tenant. b. Tenant must make available proof of insurance on any fire trucks to be stored on the premises. (1) Tenant is liable for any damages incurred to their fire truck. (2) Tenant is liable for any damages to premises caused by the operation of fire truck. 9. Conclusion of term. SUMMARY: Kodiak Island Borough Code 18.40.020 Negotiated leases requires approval by the Assembly of specific leases. Two quotes were obtained for a heated storage unit, one from Bruce McNeil at 2147 Three Sisters and the other from Ralph Bors at 3751 Rezanof Dr. The lowest bid was from Mr. Bors. The amount being charged of $1,000 per month has been discussed and approved by the Fire Protection Areas NO.1 Board Members at their October 16, 2007 meeting. The term for the lease is for one year and may be extended for an additional six months on a month-to-month basis. Facility must be secure 24 hours a day, seven days a week (24/7). 2. Facility must be kept at a minimum of 55 degrees Fahrenheit. 3. Facility must maintain safe entry and egress 24/7. Snow and other debris must be removed and entry and egress doors must be ice free or salted/sanded to provide safe entry and egress 24/7. 4. Facility must be accessible by all fire department personal 24/7. 5. LEASE TERMS Bruce and Cheryl McNeil agree to lease to Bayside Volunteer Fire Department approximately 1,200 square feet of heated, secure storage space at a rate of $ 1,500 per month, prepaid, for a period of eighteen (18) months. Monthly rent includes cost to heat the storage space. Access will be made available 24 hours a day, seven days a week. Lessor will require Bayside Volunteer Fire Department and Kodiak Island Borough to include "hold harmless" language in the written agreement.
