FY2012-08 <br />AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH <br />REZONING LOT 1, BLOCK 4, U.S. SURVEY 4926 FROM RNC- RURAL <br />NEIGHBORHOOD COMMERCIAL IQ PL- PUBLIC USE LANDS <br />WHEREAS, this rezone request is for a site that is the location of two public facilities: the Akhiok <br />Community Building owned by the City of Akhiok and the residential housing unit provided for <br />Akhiok's teaching staff owned by the Kodiak Island Borough; and <br />WHEREAS, this lot has recently been subdivided creating two parcels: one parcel includes <br />the teacherage and generator shed and the other parcel includes the Akhiok community building <br />and former BIA fuel tanks; and; and <br />WHEREAS, it is the intent to transfer ownership of the parcel that the Akhiok teacherage sits <br />upon to the Kodiak Island Borough; and <br />WHEREAS, the 2008 Kodiak Island Borough Comprehensive Plan Update has identified this <br />area for public uses; and <br />WHEREAS, the commission held a properly noticed public hearing on this request and is <br />recommending that the Assembly approve the rezone of the above described parcel from RNC - <br />Rural Neighborhood Commercial to PL -Public Use Lands. <br />NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND <br />BOROUGH THAT: <br />Section 1: This ordinance is NOT of permanent nature and shall NOT become a part of the <br />Kodiak Island Borough Code of Ordinances. <br />Section 2: Lot 1, Block 4, U.S. Survey 4926 is rezoned from RNC- Rural Neighborhood <br />Commercial to PL- Public Use lands; <br />Section 3: The findings of the Kodiak Island Borough Planning and Zoning Commission are <br />hereby confirmed as follows: <br />17.72.020 A. Findings as to the Need and Justification for a Change or <br />Amendment. <br />The rezone of Lot 1, Block 4, U.S. Survey 4926, Akhiok Townsite from RNC Rural <br />Neighborhood Commercial to PL -Public Use Zoning District will eliminate <br />nonconformity while more appropriately supporting the public use of the existing <br />facilities on the property. <br />Kodiak Island Borough, Alaska Ordinance No. FY2012-0 <br />Page 1 of 2 <br />
