FY2016-14 <br /> 14 <br /> 15 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH <br /> 16 REPEALING ORDINANCE NO. 98-06 RESERVING CERTAIN BOROUGH <br /> 17 LANDS AS A VEGETATIVE SCREEN, AND RESERVING AN AMENDED <br /> 18 GREENBELT BUFFER ALONG THE COMMON BOUNDARY OF THE <br /> 19 MONASHKA BAY ROAD SERVICE AREA AND THE KODIAK ISLAND <br /> 20 BOROUGH BALERILANDFILL <br /> 21 <br /> 22 WHEREAS, the Monashka Bay Road Service Area shares a common boundary with the <br /> 23 Kodiak Island Borough Landfill site; and <br /> 24 <br /> 25 WHEREAS, the Monashka Bay Road Service Area requested the Kodiak Island Borough to <br /> 26 restrict activities along a two hundred (200) foot common boundary of the service area and Lot 2 <br /> 27 of the Kodiak Island Borough Landfill Subdivision; and <br /> 28 <br /> 29 WHEREAS, the Kodiak Island Borough assembly has adopted prior Ordinances No. 87-15-0 <br /> 30 and No. 98-06, reserving certain Borough lands as a vegetative screen, greenbelt and buffer <br /> 31 area; and <br /> 32 <br /> 33 WHEREAS, the Monashka Bay Road Service Asea borough approved a request to build a <br /> 34 new wastewater treatment facility that effectively improves upon and effectively replaces the <br /> 35 former bioremediation pond and swale that were included within the reserved vegetative screen, <br /> 36 greenbelt and buffer area; and <br /> 37 <br /> 38 WHEREAS, the operation of the wastewater treatment facility is an industrial land use in a re- <br /> 39 platted portion of the landfill that is now zoned for industrial land uses, which makes it <br /> 40 appropriate to adjust the boundary of the reserved vegetative screen, greenbelt and buffer area <br /> 41 to exclude this facility going forward; and <br /> 42 <br /> 43 WHEREAS, the zoning of Lot 2, Kodiak Island Borough Landfill Subdivision is now NU- <br /> 44 Natural Use which encourages the passive recreation use of land and prohibits the motorized <br /> 45 use of trails and which may also suggest some further changes to the characterization of the <br /> 46 reserved area in the context of prior greenbelt buffer ordinances; <br /> 47 <br /> 48 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND <br /> 49 BOROUGH THAT: <br /> 50 <br /> 51 Section 1: This ordinance is of a general and permanent nature and shall not become a part <br /> 52 of the Kodiak Island Borough Code of Ordinances; <br /> 53 <br /> Kodiak Island Borough, Alaska Ordinance No, FY2016-14 <br /> Page 1 of 2 <br />
