FY2016-07 <br /> 8 <br /> 9 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND <br /> 10 BOROUGH AMENDING CHAPTERS 17.25 KIBC (DEFINITIONS), <br /> 11 17.165 KIBC (RECREATIONAL VEHICLE PARKS), AND RELATED <br /> 12 CHAPTERS OF TITLE 17, ZONING TO REVISE AND UPDATE THE <br /> 13 STANDARDS FOR RECREATIONAL VEHICLE PARKS IN THE <br /> 14 BOROUGH AND TO SPECIFICALLY LIST RECREATIONAL VEHICLE <br /> 15 PARKS AS A CONDITIONAL OR PROHIBITED LAND USE <br /> 16 <br /> 17 WHEREAS, as a second class Borough, the Kodiak Island Borough excercises <br /> 18 planning, platting, and land use regulations on an area wide basis pursuant to Chapter <br /> 19 29.40 Alaska Statutes; and <br /> 20 <br /> 21 WHEREAS, in accordance with AS 29.40, the Kodiak Island Borough adopted the 2008 <br /> 22 Comprehensive Plan update on December 6, 2007 (Ordinance No. FY2008-10) to replace <br /> 23 the 1968 Comprehensive Plan; and <br /> 24 <br /> 25 WHEREAS, the Kodiak Island Borough has adopted KIBC Title 17 (Zoning) in <br /> 26 accordance with AS 29.40 to implement the Kodiak Island Borough Comprehensive Plan; <br /> 27 and <br /> 28 <br /> 29 WHEREAS, KIBC 17.205.010 provides that "Whenever the public necessity, <br /> 30 convenience, general welfare or good zoning practice requires, the assembly may, by <br /> 31 ordinance and after report thereon by the commission and public hearing as required by <br /> 32 law, amend, supplement, modify, repeal or otherwise change these regulations and the <br /> 33 boundaries of the districts;" and <br /> 34 <br /> 35 WHEREAS, there is a growing awareness of the need for additional affordable and <br /> 36 workforce housing options in Kodiak; and <br /> 37 <br /> 38 WHEREAS, the use of recreational vehicles as temporary housing may be one part of a <br /> 39 regulatory solution to address this multi-faceted issue; and <br /> 40 <br /> 41 WHEREAS, some of the existing regulatory requirements for recreational vehicle parks <br /> 42 have been noted as a disincentive for new recreational vehicle parks to be established; <br /> 43 and <br /> 44 <br /> 45 WHEREAS, the public necessity and general welfare of the community may be better <br /> 46 served by amending the code to reduce or eliminate some zoning requirements for new or <br /> 47 expanded recreational vehicle parks rather than requiring strict adherence to existing <br /> 48 zoning requirements for these parks; and <br /> 49 <br /> Kodiak Island Borough, Alaska Ordinance No. FY2016-07 <br /> Page 1 of 12 <br />
