FY2016-06 AMENDING KODIAK ISLAND <br /> 10 BOROUGH CODE TITLE, 17 ZONING; CHAPTERS 17.115 MOBILE <br /> 11 HOME PARKS, 17.80 R2 — TWO-FAMILY RESIDENTIAL DISTRICT, <br /> 12 17.85 R3 — MULTI-FAMILY RESIDENTIAL DISTRICT, AND 17.90 B — <br /> 13 BUSINESS DISTRICT TO REVISE AND UPDATE THE STANDARDS <br /> 14 FOR MOBILE HOME PARKS IN THE BOROUGH <br /> 15 <br /> 16 WHEREAS, as a second class Borough, the Kodiak Island Borough excercises <br /> 17 planning, platting, and land use regulations on an area wide basis pursuant to Chapter <br /> 18 29.40 Alaska Statutes; and <br /> 19 <br /> 20 WHEREAS, in accordance with AS 29.40, the Kodiak Island Borough adopted the 2008 <br /> 21 Comprehensive Plan update on December 6, 2007 (Ordinance No. FY2008-10) to replace <br /> 22 the 1968 Comprehensive Plan; and <br /> 23 <br /> 24 WHEREAS, the Kodiak Island Borough has adopted KIBC Title 17 (Zoning) in <br /> 25 accordance with AS 29.40 to implement the Kodiak island Borough Comprehensive Plan; <br /> 26 and <br /> 27 <br /> 28 WHEREAS, KIBC 17.205.010 provides that "Whenever the public necessity, <br /> 29 convenience, general welfare or good zoning practice requires, the assembly may, by <br /> 30 ordinance and after report thereon by the commission and public hearing as required by <br /> 31 law, amend, supplement, modify, repeal or otherwise change these regulations and the <br /> 32 boundaries of the districts;" and <br /> 33 <br /> 34 WHEREAS, the recent announced closure of Jackson's Mobile Home Park pursuant to <br /> 35 AS 34.03.225(x)(4)will result in nearly 100 families being forced to relocate; and <br /> 36 <br /> 37 WHEREAS, there are a limited number of mobile homes parks in the community where <br /> 38 units may be moved to; and <br /> 39 <br /> 40 WHEREAS, Some of the existing regulatory requirements for mobile homes parks have <br /> 41 been noted as a disincentive for new mobile home parks to be established or expansion of <br /> 42 existing parks; and <br /> 43 <br /> 44 WHEREAS, the public necessity and general welfare of the community may be better <br /> 45 served by amending the code to reduce or eliminate some zoning requirements for new or <br /> 46 expanded mobile home parks rather than requiring strict adherence to existing zoning <br /> 47 requirements for these parks; and <br /> 48 <br /> Kodiak Island Borough, Alaska Ordinance No. FY2016-06 <br /> Page 1 of 10 <br />
