FY2016-03 <br /> 9 <br /> 10 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND <br /> 11 BOROUGH AMENDING KODIAK ISLAND BOROUGH CODE OF <br /> 12 ORDINANCES TITLE 17 ZONING, CHAPTER 17.50 C- <br /> 13 CONSERVATION AND CHAPTER 17.130 PL- PUBLIC USE LANDS <br /> 14 DISTRICT TO ALLOW THE TEMPORARY STORAGE OF MOBILE <br /> 15 HOMES DISPLACED UNDER ALASKA STATUTES 34.03.225 TO BE <br /> 16 STORED ON SITES ZONED C-CONSERVATION OR PL-PUBLIC USE <br /> 17' LANDS <br /> 18 <br /> 19 WHEREAS, as a second class Borough, the Kodiak Island Borough excercises <br /> 20 planning, platting, and land use regulations on an area wide basis pursuant to Alaska <br /> 21 Statutes (AS) Chapter 29.40; and <br /> 22 <br /> 23 WHEREAS, in accordance with AS 29.40, the Borough adopted Ordinance No. FY2008- <br /> 24 10 Kodiak Island Borough 2008 Comprehensive Plan Update on December 6, 2007 <br /> 25 replacing the 1968 Comprehensive Plan; and <br /> 26 <br /> 27 WHEREAS, the Borough has adopted KIBC Title 17 Zoning in accordance with AS <br /> 28 29.40 to implement the Kodiak Island Borough Comprehensive Plan; and <br /> 29 <br /> 30 WHEREAS, KIBC 17.205.010 provides that "Whenever the public necessity, <br /> 31 convenience, general welfare or good zoning practice requires, the assembly may, by <br /> 32 ordinance and after report thereon by the Commission and public hearing as required by <br /> 33 law, amend, supplement, modify, repeal or otherwise change these regulations and the <br /> 34 boundaries of the districts;" and <br /> 35 <br /> 36 WHEREAS, the recent announced closure of Jackson's Mobile Home Park pursuant to <br /> 37 AS 34.03.225 (a)(4) will result in nearly 100 families being forced to relocate; and <br /> 38 <br /> 39 WHEREAS, many of the mobile homes in question may not be able to be moved due to <br /> 40 age, structural condition, or modifications over time; and <br /> 41 <br /> 42 WHEREAS, recent public comments noted that some mobile home owners may need a <br /> 43 temporary location to store their mobile homes until a permanent location is found; and <br /> 44 <br /> 45 WHEREAS, there may be space available on C-Conservation zoned land or publicly <br /> 46 owned land that is zoned PL-Public Use Lands to accommodate temporary storage of <br /> 47 mobile homes if the Conservation or Public Use Lands zoning regulations permitted such <br /> 48 storage; and <br /> 49 <br /> Kodiak Island Borough, Alaska Ordinance No. FY2016-03 <br /> Page 1 of 9 <br />
