9 A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY
10 AUTHORIZING THE KODIAK ISLAND BOROUGH TO SUBMIT AN APPLICATION
11 FOR A LOAN FROM THE ALASKA CLEAN WATER FUND FOR THE LANDFILL LATERAL
12 EXPANSION PROJECT, PHASE III

14 WHEREAS, the Kodiak Island Borough seeks to obtain financial assistance to construct a
15 landfill expansion with on -site leachate treatment; and
16
17 WHEREAS, regulations for the landfill expansion require lined cells and that the leachate be
18 captured and treated to meet certain Alaska Clean Water Act standards; and
19
20 WHEREAS, the State of Alaska, Department of Environmental Conservation is able to offer
21 funding through the Alaska Clean Water Fund; and
22
23 WHEREAS, the Kodiak Island Borough submitted a Non -Point Source Loan Questionnaire
24 which placed this project on 'the Fiscal Year 2013 Alaska Clean Water Fund Non -Point Source
25 Funding Priority List making the project eligible for an Alaska Clean Water Fund loan; and
26
27 WHEREAS, the Kodiak Island Borough wishes to apply for a loan from the Alaska Clean
28 Water Fund in an amount up to $5,818,548 for a term of up to 20 years at an interest rate of
29 1.5 %;

31 NOW, THEREFORE BE IT RESOLVED, BY THE ASSEMBLY OF THE KODIAK ISLAND
32 BOROUGH that the Kodiak Island Borough is authorized to apply to the Department of
33 Environmental Conservation for a loan from the Alaska Clean Water Fund for the construction
34 of the landfill expansion and on -site leachate treatment facility.

36 BE IT FURTHER RESOLVED that if the loan is approved by the Department of Environmental
37 Conservation, the Borough Manager is authorized to execute any and all documents that may
38 be required by the Department of Environmental Conservation to reflect the indebtedness, the
39 terms of its repayment, and any security therefore, including but not limited to an agreement for
40 the loan and a promissory note.

42 BE IT FURTHER RESOLVED that this resolution locks in the terms of the loan, and prior to the
43 drawing down of these funds, a borough ordinance to utilize this funding shall be approved.
