10 A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY ACCEPTING THE
11 RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION APPROVING
12 OF CERTAIN BOROUGH LAND TO BE SOLD AT A FUTURE LAND SALE

14 WHEREAS, Kodiak Island Borough Code (KIBC) 18.20.030 requires each proposed
15 disposal of Borough land to be reviewed by the Planning and Zoning Commission before
16 submission to the Assembly; and

18 WHEREAS, the Planning and Zoning Commission is required under KIBC 18.20.030 to
19 make a recommendation on the disposal(s) by resolution before it is forwarded to the
20 Borough Assembly; and

22 WHEREAS, the principal purpose of the Commission review is to determine if the land
23 identified for disposal is surplus to the Borough's need; and
24
25 WHEREAS, the parcels proposed for disposal by the Borough Resource Management
26 Officer have not previously been considered for disposal by the Borough Assembly; and

28 WHEREAS, the Planning and Zoning Commission has found that the parcels identified
29 below for disposal are surplus to the public's need based on its review; and

31 WHEREAS, the Planning and Zoning Commission held a public hearing on July 18,
32 2012 and is recommending the disposal of the parcels listed. below;

34 NOW, THEREFORE BE IT RESOLVED, THAT THE ASSEMBLY OF THE KODIAK
35 ISLAND BOROUGH THAT:

37 Section 1: The Kodiak Island Borough Planning and Zoning Commission, in
38 accordance with Title 18 of the Kodiak Island Borough Code, recommends
39 disposal of the borough's interest in the following eleven parcels of land
40 comprising 16.05 acres of property described as:

42 A. Parcels 1, 2, 3, 4 and 5, from Tract R1 -A Killarney Hills Subdivision.
43 Disposal of Parcel 4 will specify that future subdivision design will
44 accommodate extension of Murphy Way through Parcel 4 to potentially
45 connect with Rezanof Drive. Roads serving Parcels 4 and 5 will be
46 constructed to City of Kodiak standards and, relative to the intersection
47 with Rezanof Drive, to Alaska Department of Transportation standards.
48 The Assembly acknowledges, as noted in the Planning and Zoning
Kodiak Island Borough Resolution No. FY2013 -08

49 Commission Resolution No. FY2013 -01, that there has been no
50 determination made dedicating the existing ball field to long term use as
51 a ball field.

55 C. Parcels 1, 2 and 3, near the end fo Panamaroff Creek Drive

57 D. Parcel 1, near the end of Middle Bay Drive

59 E. Parcel 1, from Lot 5, Block 1, Chiniak Alaska Subdivision

61 Section 2: The Kodiak Island Borough Planning and Zoning Commission, in
62 accordance with Title 18 of the Kodiak Island Borough Code, has
63 determined after a public hearing on July 18, 2012, that the aforementioned
64 properties are hereby surplus to the public's need.

66 Section 3: The aforementioned lands, some of which may require additional planning,
67 zoning or subdivision in order to be made suitable for disposal, should be
68 offered to the public for disposal in a subsequent borough land sale.
