10 A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH
11 DISPOSING BOROUGH OWNED LAND TO THE CITY OF OUZINKIE
12 FOR LESS THAN FAIR MARKET VALUE (P &Z Case 12 -013)
13 WHEREAS, the Borough received Resolution 2011 -05 from the City of Ouzinkie
14 respectfully requesting acquisition of a portion of Tract C, Block 2, U.S. Survey 4871 from the
15 Kodiak Island Borough for community benefit; and
16
17 WHEREAS, KIBC 18.20.030(A), requires review of each disposal of borough real property
18 by the Planning and Zoning Commission; and
19
20 WHEREAS, the Planning and Zoning Commission in Resolution 2012 -02 recommends to
21 the Assembly disposal of the requested property; and
22
23 WHEREAS, KIBC 18.20.100(B) provides for the disposal of KIB real property for less than
24 fair market value to a political subdivision upon a finding that the use of the land will be for a
25 public purpose beneficial to the borough; and
26
27 WHEREAS, the Planning and Zoning Commission, after holding a properly noticed public
28 meeting, adopted Planning and Zoning Resolution 2012 -02 recommending that this parcel be
29 surplus to the Borough's needs and recommends disposal of land.

31 NOW THEREFORE BE IT RESOLVED, THAT THE ASSEMBLY OF THE KODIAK ISLAND
32 BOROUGH affirms the recommendation and findings of fact by the Planning and Zoning
33 Commission to dispose of approximately .7 acres of Borough land in Ouzinkie presently
34 described as a portion of Tract C, Block 2, U.S. Survey 4871, Townsite of the City of Ouzinkie
35 to the City of Ouzinkie for less than fair market value and finds that such a disposal will be of
36 a public purpose beneficial to the borough.

38 BE IT FURTHER RESOLVED THAT the Assembly's action is conditioned upon the
39 completion, approval, and recordation of a plat that segregates the parcel of interest from the
40 remainder of the Ouzinkie school tract.

42 BE IT FURTHER RESOLVED THAT the Assembly authorizes the Manager to sign all
43 paperwork required expediting this disposal to the City of Ouzinkie.
