Page 2 of .2 KODIAK ISLAND BOROUGH Assembly Regular Meeting December 1, 2011 A regular meeting of the Kodiak Island Borough Assembly was held on Thursday, December 1, 2011, in the Assembly Chambers of the Kodiak Island Borough Building, 710 Mill Bay Road. The meeting was called to order at 7:30 p.m. Mayor Selby led the Pledge of Allegiance. Present were Mayor Jerome Selby, Assembly Members Carol Austerman, Tuck Bonney, Dave Kaplan, Chris Lynch, Mel Stephens, and Louise Stutes. Staff members present were Administrative Official Bud Cassidy, Finance Director Karl Short, Deputy Clerk Marylynn McFarland, and Assistant Clerk Jessica Kilborn. KAPLAN moved to excuse Assembly member Friend who was absent due to personal leave. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY. APPROVAL OF AGENDA AND CONSENT AGENDA KAPLAN moved to approve the agenda and consent agenda. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY. APPROVAL OF MINUTES A. Regular Meeting Minutes of October 20, 2011, were approved under the consent agenda. AWARDS AND PRESENTATIONS Mayor Selby presented the Student of the Month Awards for November 2011 to Kimberly Boskofsky, a senior at Ouzinkie School and for December 2011 to Danielle Nero, a senior at Kodiak High School. CITIZENS' COMMENTS Judy Fulp, Rick Length, and Charlie Powers spoke in favor of the Baranof Park Improvement project. COMMITTEE REPORTS Assembly member Stutes reported on the Kodiak Fisheries Advisory Council meeting held on November 29, 2011. Assembly member Kaplan reported on the Kodiak College Council meeting held on November 4, 2011. Mayor Selby reported on the Fisheries and Oceanic Research Board meeting held on November 30, 2011. Kodiak Island Borough Assembly Minutes December 1, 2011 Page 1 of 8 PUBLIC HEARING 1. Ordinance No. FY2012 -11 Amending Title 3 Revenue and Finance Chapter 3.55 Transient Accommodations Tax Section 3.55.025 Allocation of Sales Tax Proceeds. AUSTERMAN moved to adopt Ordinance No. FY2012 -11. This ordinance was a clean -up ordinance to correct an error in KIBC 3.55.025 to reflect that there was only one village in Kodiak which was the Village of Karluk and five second class cities which were the Cities of Akhiok, Larsen Bay, Port Lions, Old Harbor, and Ouzinkie Mayor Selby opened the public hearing. Seeing and hearing none, Mayor Selby closed the public hearing. ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Bonney, Kaplan, Lynch, Stephens, Stutes, and Austerman. 2. Ordinance No. FY2012 -12 Repealing Sections of Ordinance No. FY2007 -09 Authorizing an Amendment to the Borough's Participation Agreement With the Public Employees Retirement System (PERS) of Alaska and to Change the Borough Code of Ordinances to Exclude Participation of Elected Officials. STUTES moved to adopt Ordinance No. FY2012 -12. Ordinance No. FY2007 -09 was adopted by the Borough Assembly on October 5, 2006, which allowed sitting assembly members to continue participation in the PERS system but did not allow newly elected officials to join the program. As written, Ordinance No. FY2007 -09 was not acceptable to the State of Alaska PERS system because the Borough had to allow all elected officials to participate in PERS or exclude all elected officials from participation. This repeal would allow elected officials to participate in the State PERS program subject to PERS Regulations. Sections 3 and 4 of Ordinance No. FY2007 -09 which dealt with Assembly members being able to participate in the Borough health and life insurance plan would remain in the Kodiak Island Borough Code of Ordinances. Based on discussion held at the regular Assembly meeting of November 3, 2011, staff was in the process of discussing the proposed ordinance with the Borough Attorney and the State of Alaska PERS and as a determination could not be provided, it was recommended to postpone Ordinance No. FY2012 -12 to the next regular meeting of the Assembly. STUTES moved to postpone Ordinance No. FY2012 -12 to public hearing at the next regular meeting of the Assembly. Ordinance No. FY2012 -13 Rezoning Certain Lots Along Spruce Cape Road From R1- Single Family Residential To R2 -Two Family Residential (P &Z Case 12 -002). KAPLAN moved to adopt Ordinance No. FY2012 -13 in first reading to advance to public hearing at the next regular meeting of the Assembly. A petition for the rezone of a single lot came as a request before the Planning and Zoning Commission. The Commission voted to expand the area to be considered for rezoning from one lot to a compact area containing nine parcels. Public hearing notices were sent out to the neighbors, utility companies, and other agencies. The request was affirmed with the Commission's recommendation that the Borough Assembly approve the rezone request. Ordinance No. FY2012 -01A Amending Ordinance No. 2012 -01 Fiscal Year 2012 Budget By Amending Budgets to Account for Various Revenues that Are Over Budget, Provide for Additional Expenditures, Budget New Projects, Accept Grants, and Move Funds Between Projects. AUSTERMAN moved to adopt Ordinance No. FY2012 -01A in first reading to advance to public hearing at the next regular meeting of the Assembly. This ordinance: • Budgeted for 50% of the cost of the fisheries consultant from the City of Kodiak; • Increased the Kodiak High School Asbestos Removal and Floor Covering project by $83,044 to comply with the State budget; • Combined the Kodiak High School VocEd /Pool Reclamations project, Kodiak High School Old Pool Roof and HVAC Renovations project, and the Kodiak High School Master Plan project; • Increased the Learning Center Remodel project by $171,918; • Accepted and budgeted a grant in the amount of $466,000 for the Kodiak High School Renovation and Additions project and decreases the amount of the General Obligation bonds to be issued by the same amount; • Accepted and budgeted a grant in the amount of $2,000,000 for the Anton Larsen Bay Boat Ramp project; • Accepted and budgeted grants received for the Karluk Village, Chiniak, Akhiok, Ouzinkie, and Larsen Bay warning sirens; • Accepted and budgeted a grant in the amount of $1,025,000 for the Womens Bay Tsunami Shelter; • Accepted and budgeted a grant in the amount of $1,190,853 for the Old Harbor, Karluk, and Port Lions emergency generators; • Budgeted for the Long Term Care Center Design project in Fund 495; • Accepted and budgeted a grant in the amount of $435,147 for the East Elementary School emergency generator; • Accepted and budgeted a grant in the amount of $1,275,000 for the design and planning of the Long Term Care Center; and • Budgeted for the Borough's contribution to the Providence Kodiak Island Medical Center by $150,000. BONNEY moved to amend the corrected version of Ordinance No. FY2012 -01A by adding back into the ordinance, Whereas, the first phase of renovating Baranof Park is estimated to cost $3,000,000 with funding by a state contribution of $2,000,000, a City of Kodiak contribution $500,000, and a Borough contribution of $500,000 ", and add a Section 10 (page 2 of 2) to read, "The Borough appropriates $500,000 from the receipts in the Renewal and Replacement Fund to the Baranof Park Renovation Project to be released to the City of Kodiak after Borough Assembly approval of an agreement with the City." It was the Assembly's duty to approve the meeting schedule for the upcoming year. The recommended meeting schedule was created based on KIBC 2.30.030 Types of meetings. 2. State of Alaska Alcoholic Beverage Control Board Request for Renewal of Liquor License Applications Within the Kodiak Island Borough. This item was approved under the consent agenda. The Clerk's office conducted a routine investigation per KIBC 5.01.020 within the Kodiak Island Borough jurisdiction and recommended non - protest to the renewals. Assembly Approval of a Partial Vacation of the Right of Way of Perenosa Drive (P &ZC Case S12- 005). KAPLAN moved to approve a partial vacation of Perenosa Drive Road right of way subject to the conditions of approval and findings of fact in the Planning and Zoning case packet (Case S12 -005) dated October 2, 2011. Kodiak Island Borough Assembly Minutes December 1, 2011 Page 5 of 8 This request was made to reduce the width of the Perenosa Drive Right of Way from 60 feet to 30 feet. The reduction would occur by taking away 15 feet from of each side of the right of way, and would leave 30 feet in the middle of the right of way. This area would be retained as public lands and was the location of existing city utilitilies and a future pedestrian and bikeway. This pathway would lead residents to the intersection of Sitkinak Drive and Rezanof Drive and to a safe location to cross Rezanof Drive to recreational fields, the Kodiak Area Native Association facility, Safeway, and Walmart. Confirmation of the Assembly Appointment to the Kodiak Workforce Regional Advisory Council. BONNEY moved to confirm the Assembly appointment of Mr. Jared Griffin to the Kodiak Workforce Regional Advisory Council Arts and Communications seat for a term to expire December 2013. On August 22, 2011, the Clerk's office received an application from Mr. Jared Griffin for the Arts and Communications seat on the Kodiak Workforce Regional Advisory Council. Mr. Griffin's application was provided to the Council and at its regular meeting of September 28, 2011, the Council recommended the appointment of Mr. Griffin to the Arts and Communications seat for a term to expire December 2013. ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Lynch, Stephens, Stutes, Austerman, Bonney, Friend, and Kaplan. 5. Appointments to the Providence Kodiak Island Service Area Board. AUSTERMAN moved to voice non - objection to the appointments of Pat Branson, Ken Knowles, and Steve Honnold to the Providence Kodiak Island Service Area Board. The Providence Kodiak Island Service Area Board recommended the appointments of Pat Branson, Ken Knowles, and Steve Honnold to fill Service Area Board vacancies as of January 2012. A letter from Providence regarding the appointments dated November 8, 2011, was provided. ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Stephens, Stutes, Austerman, Bonney, Kaplan, and Lynch. EXECUTIVE SESSION 1. Cutler vs. Kodiak Island Borough KAPLAN moved to convene into executive session to discuss Cutler vs. Kodiak Island Borough which qualifies for executive session under confidential attorney - client communications made for the purpose of facilitating the rendition of professional legal services to the borough. Kodiak Island Borough Assembly Minutes December 1, 2011 Page 6 of 8 Assembly member Stephens declared a conflict of interest due to his past representation as Mr. Cutler's attorney. Mayor Selby ruled the declaration in order. ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Stutes, Austerman, Bonney, Kaplan, and Lynch. The Borough Assembly, Administrative Official, Finance Director, and Clerk's Office Staff were invited into the executive session. The Borough Attorney and the AML /JIA Attorney attended the executive session via teleconference. After the vote, Mayor Selby recessed the regular meeting at 8:27 p.m. and convened the executive session. Upon returning from the executive session, Mayor Selby reconvened the regular meeting at 8:50 p.m. and announced no action was to be taken as a result of the executive session. CITIZENS' COMMENTS None. ASSEMBLY MEMBER COMMENTS Assembly members congratulated the Student of the Month award recipients. Assembly member Stephens spoke in support of a legal opinion on the $500,000 appropriation for the Baranof Park Improvement project under Ordinance No. FY2012 -01A and voiced concern on the process of the appropriations. He spoke in support of an open public forum for the special work session regarding the Kodiak High School Renovation project on December 13, 2011. Assembly member Stephens spoke on the home rule unified municipality option. Assembly member Stutes spoke in support of the Fisheries Analyst Consultant position. She voiced questions regarding a letter addressed to the Assembly concerning drainage issues in the Bay View Road Service Area and inquired about the status of the project manager for the Kodiak High School Renovation project. Assembly member Bonney spoke on the Kodiak Hospital project from sixteen years before, the advantages and benefits to the community that had stemmed from that project, and compared it to the current Kodiak High School Renovation project as an asset to the community. He spoke against comments he had received regarding using the Facilities Fund to pay off specific debts, spoke to the reasons for the amendment he offered on Ordinance No. FY2012 -01A, and encouraged the public to voice their opinions to Assembly members. Announcements Mayor Selby announced the Kodiak Island Borough would be hosting the Kodiak Island Mayor's Conference on Thursday, December 8 at 11 a.m. in the Borough Conference Room. The next regular meeting was scheduled on Thursday, December 15, 2011, at 7:30 p.m. in the Borough Assembly Chambers. The following is the reason- ing that helped the Planning and Zoning Commission recommend approval of the zoning change. In a letter addressed to me from Mr. Martin Lydick, Associate Planner- Enforcement, Mr. Lydick makes a curious statement. He states ... "Due to past controversies surrounding this property, i.e., unpermitted excavation and export of rock resources ... this department, by way of this correspondence, intends to make absolutely certain that you are aware of the allowable uses of the property, before you make any additional sizable investment." This is a curious statement because it targets Mr. Wandersee in a rather harsh manner for the KIB's Planning and Zoning Enforcement's failure to do their job years before 1 purchased this piece of property. It is no wonder that the residents in the area around the property in question were upset and petitioned the P &Z to not allow this rezone to take place. In the time period this unpermitted excavation took place, the noise and industrial vehicles must have created a serious annoyance to the residents. These are fair and reasonable individuals who signed the petition, some who lived well outside the 700 -foot area around the property. However, my business is as different from the unpermitted excavation of rock as house building is from fish- ing. Comprehensive Plans for Planning and Zoning are realities across America. So also are requests for rezoning, denials, appeals and approvals. In a letter to me from Mr. Cassidy dated March 20, 2008, Mr. Cassidy states ... "A request to change the zoning of a parcel is certainly not an auto- matic thing." Mr. Cassidy goes on to state, "If rezoning a parcel was automatic, we would have helter skelter development spread throughout town — anywhere anyone wanted it. To prevent that, a comprehensive planning process is conducted ... a consultant is hired ...The plan was then reviewed and adopted after a public meeting of the Commission." However, in a memorandum Staff Report dated Dec. 1, 2009, this statement is made, "Compre- hensive plans typically project future land use proposals for a 10 -, 15- or 20 -year period. The Commission and Assembly are not obligated to implement such recommendations in the plan if the overall condition and context of the community are not ready for such change." One of the purpose of the land use regulation is to 'Provide for orderly development.' In another Staff Report dated Dec. 16, 2009, under the heading Zoning /Use, it states, "The gen- eral area is characterized as a mixed use area. The area to the east is utilized as relatively low - impact public use, i.e., the Bayside Fire Station and Training Facility, and single - family residen- tial uses. The area to the north is utilized as relatively low- impact storage uses (rezoned to B- Business Zoning District by Ordinance 86 -51, December 1986). Abutting and adjacent uses to the south and west are low- impact residential uses. It should be noted here that a request to rezone was made, for a property adjacent to the property Mr. Wandersee now owns, it was discussed and in that case passed." In the next section of the Dec. 16, 2009 document under the heading Land Suitability it states "The parcel subject to the rezone request is arguably now more amenable to a business use than a permitted use under the current zoning designation. During the years 1990 through 2007, the property had been mined for the rock resource without the required public review or permitting." So, in conclusion, it appears there is heartache from some fair and reasonable nearby residents who endured an unpermitted excavation and export of rock resources operation the KIB's En- forcement arm failed to curtail. This is not any fault of mine. I intend to run a business in no way similar to the unpermitted excavation of the past. I understand RR -1 current zoning of this property. Following a very familiar process which takes place in communities around America every day, I petitioned local government to reconsider a portion of a Comprehensive Plan. The reason for the request to rezone this property to B- Business is to provide an income derived from a small business, which will benefit the KIB and employ others who then contribute to the overall economic success of this area. Therefore, I request that you disregard any association of me relative the unpermitted excava- tion of this property in the past. My simple request is that you consider the rezone of this prop- erty simply to run a small business, develop the property so as not to be an eyesore, employ individuals with the skill sets necessary for this type of work, and contribute to the economic success of this community. Request a review of Parks & Recreation Committee recommendations and other communications, according to KIBC 2.120.030.D, for the Draft Kodiak Road System Trails Master Plan prior to review and adoption of the plan by the Kodiak Island Borough Assembly. The Planning & Zoning Commission will render its own recommendation within 30 days or the plan will be deemed to be approved and forwarded to the assembly on that basis; and A review, according to KIBC 2.105.030.A & 1, of the Draft Kodiak Road System Trails Master Plan, as a proposed new element of the Kodiak Island Borough Comprehensive Plan once adopted by the assembly. The applicant is the Parks & Recreation Committee. The location and zoning varies. Cassidy reported this plan has been a vision for about 10 years with the bulk of the work being done in the past 2 years. A lot of effort has gone into it. You postponed it last month to offer the public another opportunity to testify. Since then several folks have come in to show where corrections needed to be made. Those corrections have been made and after this meeting there will be a fresh plan with the corrections made to give to the Assembly. Adopting this plan will allow us to receive trail grants. This will give the community to prioritize and improve the trails. The plan also identifies "Safe Routes to Schools" which is critical routes where kids can walk safely. It also creates a trails network to link neighborhoods to schools. Cassidy said once the plan is adopted we will have a map that the public can use to identify where the trails are. COMMISSIONER SCHMITT MOVED to recommend to the Borough Assembly to review and approve the Kodiak Road System Trails Master Plan, September 2011 by the Kodiak Island Borough Parks and Recreation Committee and Alta Planning and Design and that it be adopted as a component to the Kodiak Island Borough Comprehensive Plan Update and to adopt the findings in the staff memo dated October 4, 2011, as "Findings of Fact" for Case 12 - 015. The Lot in this case is across the street from long term sites used for commercial use; Bayside Fire Department across Rezanof Dr and Kodiak Electric Company storage lot across Otmeloi Dr. A.2.K Current use fits the rezone request A.3.K Adjacent properties are Business / Industrial 17.205.020 B. B.1.V The Comprehensive Plan proposed future land use map identifies this Lot as Rural Residential. The B- Business Zoning District is established for the purposes of protecting and encouraging the development of community business core areas that function efficiently as centers of retail business and retail service activities (italics added] For the business zoning district, in promoting the general purposes of this title, the specific intentions of this chapter are: A. To encourage the continued use and development of land for retail purposes; B. To discourage the use of business district lands for other than retail purposes; C. To prohibit the use of business district lands for manufacturing and industrial purposes; and D. To encourage the discontinuance of existing uses that are not permitted under the provisions of this chapter KIBC 17.72.030 Manner of initiation. Changes in this title may be initiated in the following manner: C. By petition of one (1) or more owners of property within an area proposed to be rezoned. A petition shall be in the form of an application for a change in the boundary of a district, shall be filed in the community development department, be accompanied by the required fee and such data and information as may be necessary to assure the fullest practicable presentation of facts and shall set forth reasons and justification for proposing such change 1 a 1 ro dd e d KIBC 17.72.055 Submission to assembly. A. Within thirty days after the planning commission has acted favorably upon a proposed zoning change in accordance with the above provisions, a report with recommendations shall be submitted to the assembly together with the proposed ordinance. Such recommendations of the planning commission shall be advisory only and shall not be binding upon the assembly. When an ordinance has been forwarded to the borough assembly, the assembly shall act in accordance with this chapter and notice shall be issued as provided in Section 17.72.070, by the borough clerk. B. If the planning commission recommends denial of any proposed amendment, its action shall be final unless the initiating party, within ten days, files a written statement with the clerk requesting that the commission's action be taken up by the borough assembly. CONFORMANCE WITH THE COMPREHENSIVE PLAN: The request is inconsistent with the recently adopted Kodiak Island Borough 2008 Comprehensive Plan. The future development of the proposed rezone area will be subject to a far greater list of permitted uses, and potential conditional uses, than envisioned in past or present requests. The area to the east is utilized as relatively low- impact public use, i.e., the Bayside Fire Station and Training Facility, and single - family residential uses. The area to the north is utilized as relatively low- impact storage uses (rezoned to B - Business Zoning District by Ordinance 86 -51, December 1986). Abutting and adjacent uses to the south and west are low- impact residential uses. LAND SUITABILITY: The parcel subject to this rezone request is arguably now more amenable to a business use than a permitted use under the current zoning designation. During the years 1990 through 2007, the property had been mined for the rock resource without the required public review or permitting. Pre - construction development had resulted in a "ready- to -go" state with little or no additional site work required. Access to public water and sewer utilities is readily available. RECENT DEVELOPMENT TRENDS IN THE AREA: The recent development trend in the immediate area has been a continuing reliance upon the establishment of single family residences, and the evolution of the Bayside Fire Station into a multi - purpose complex serving the community's emergency responder needs, and providing meeting rooms and training facilities serving the needs of a variety of organizations representing a much wider community. The trend of residential development in the neighborhood continues evidenced by the filing of two' residential re -plats since the December 2009 decision of the Commission. And, the residential trend is underscored by the applicant's own residential development on the subject property Outside of the immediate area, but still within the sphere of influence, the most noticeable development trend has been the establishment of the North Star Elementary School. Located approximately 1,700 feet to the west on Otmeloi Way, this community facility exhibits all the indicators of continuing expansion and increasing intensity of use. TRAFFIC IMPACTS: The B- Business Zoning District is established for the purposes of protecting and encouraging the development of community business core areas that function efficiently as centers of retail business and retail service activities. Because the district presumes a significant retail characteristic of use, the location of the property on the extreme periphery of the urban area mandates reliance upon passenger car transport. Because the specific use of the property following a rezone cannot be limited to anything less than the listed permitted uses allowable in the B - Business Zoning District, the actual number of vehicle movements into, and out of, the property on any given day is an unanswerable question. A poorly designed intersection and restricted lines -of- sight at the obvious point of ingress and egress, Otmeloi Way, portend conflicts between vehicle traffic and pedestrian traffic. This concern cannot be understated as Otmeloi Way is a primary access route to and from North Star Elementary School. COMMENTS Per Kodiak Island Borough Code 17.205.030 C the rezone application should contain the "data and information as may be necessary to assure the fullest practicable presentation of facts ", and "set forth reasons and justification for proposing such change ". The application narrative fails to supply any supporting data, and does not provide any reason or justification for the request. Due to this deficit, staff will rely upon the guidance provided by the applicable comprehensive plan, and the characteristics of the proposed zoning district, in order to evaluate the proposal. The applicable comprehensive plan provides "in assessing the need and most appropriate locations for new industrial [Business] land, consider the following factors ". © The need to support potential economic growth sectors. The level of need should be based on an assessment of trends in population growth and in specific economic sectors, including a realistic assessment of their potential within the KIB. Despite the most optimistic projections, the local population trend is flat to declining, and there does not appear to be any impetus for a reversal of this trend in the foreseeable future The identified business activity has not been identified as a growth sector per se. Although construction related activity will continue to be a significant portion of the local economy, the applicant has failed to identify any particular niche that is currently under - served to any appreciable degree. The same observation is relevant to the applicant's stated intent to offer services supporting the local fishing industry. NI Proximity to adequate public facilities, including roads, water and air transport facilities, as well as water and wastewater treatment facilities. As related earlier in this report, the subject parcel is located with paved road frontage, and public water and sewer utilities are readily available. o Potential conflicts with adjacent land uses, particularly residential uses and sensitive natural resources. Because of the long list of permitted uses within the B - Business Zoning District, the potential for conflict with abutting and adjacent uses is significant. Characterized as a mixed use area, the predominate use in the area is residential. El Parcel size, topography and other site characteristics as they relate to the requirements of businesses in anticipated growth industries. 'Appendix pages 7 & 8, Census Data. The applicable zoning district, KIBC 17.21, provides "The B- Business Zoning District is established for the purposes of protecting and encouraging the development of community business core areas that function efficiently as centers of retail business and retail service activities (italics added] . For the business zoning district, in promoting the general purposes of this title, the specific intentions of this chapter are: A. To encourage the continued use and development of land for retail purposes; The Kodiak Island Borough 2008 Comprehensive Plan states that there is currently 444 acres of Business zoned lands within the borough. A recently completed review of the urban area has tallied a total of 387 parcels of business zoned land within the immediate urban area. The 387 parcels have a combined land area of 200 acres (rounded). Those parcels with a coding of "VAC" contain a total of 45 acres of land area. The business zoned vacant land area is 23% (rounded) of the total business zoned land within the immediate urban area. This percentage of existing under - utilization is hardly a sustainable argument for more business zoned land. 8. To discourage the use of business district lands for other than retail purposes; The applicant's proposed use of the parcel does not contain a retail component. To reiterate, a rezone to business would allow the property owner, present or future, to develop the property with any of the permitted, or potential conditional uses listed in the business zoning district. 4 The linear development pattern of business zoned lands is illustrated on page 9 of the Appendix. The auto - dependency of linear development is especially pernicious in light of ever rising fuel costs. The illustration clearly indicates a need to return to the policies of the comprehensive plan and refocus upon the goal of "core areas ". It was . disheartening that the legislature and governor were unable to reach agreement on a viable program extension. The consequence of that failure was the termination of a program that had operated successfully in our state for more than three decades. We are now the only maritime state without a coastal management program, even though our 34,000 - mile shoreline constitutes roughly 38 percent of that of the entire nation. This is unacceptable. On October 7th, 2011, an application for an initiative petition "establishing the Alaska Coastal Management Program" was delivered to Lieutenant Governor Mead Treadwell for approval -- the first step in putting an initiative on the ballot. The initiative is intended to encourage our state leadership to redouble their efforts to create a credible coastal management program during the 2012 legislative session. Landfill Wastewater Treatment 30 Total estimated cost of the project: $13,650,000 31 Funding Sources: Kodiak Island Borough revenue bonds, State of Alaska $3,650,000 32 Federal Funding Request: $10,000,000 33 34 The Kodiak Island Borough's landfill is estimated to reach the limits of its permitted 35 capacity within two years. The most practical solution to address this problem is to 36 construct new cells adjacent to the existing landfill. Current Alaska Department of 37 Environmental Conservation regulations implementing the federal Clean Water Act 38 require the new cells to be fully lined to capture all leachate or fluids produced by the 39 waste. The captured leachate will be processed either in a newly constructed treatment 40 facility on -site, or transported several miles to the waste water treatment plant through 41 a newly constructed pressurized pipeline. This treatment represents an unfunded 42 federal mandate. Federal assistance to communities to comply with this federal 43 mandate has been available in the past through EPA's State and Tribal Assistance 44 Grant Program (the "STAG" Program). This pathway will complement Kodiak's road 56 system by providing safe bike and pedestrian access from the northern most end of the 57 road system, at White Sands Beach, to the Bells Flats community south of the City of 58 Kodiak. This phase of the project addresses a segment of the pathway, Phase 1B, 59 which will extend from the Kodiak City boundary (Deadman's Curve) and a well -used 60 scenic overlook to the entrance of the U. S. Coast Guard Base. Other phases of the 61 project, outside the City of Kodiak, are: Phase II from the U. S. Coast Guard Base 62 entrance to Panamarof Creek (Bells Flats community) and Phase III from Otmeloi Way 63 to White Sands beach. Each of these phases is a significant component of an 64 integrated, community friendly pathway system. A planning level scoping document 65 has already been completed to support this project. The lack of highway lighting is a significant safety concern along this section of 81 heavily traveled road. The federal High Risk Rural Road Program provides funding 82 through the Federal Highway Trust Fund to correct or improve hazardous road 83 locations in rural areas through construction or operational improvements. This in turn would create tax 96 revenues for the. PILT was enacted by Congress to help offset the loss of revenues to 97 municipal entities caused by federal land withdrawals within local government 98 boundaries. The Borough uses these funds to provide basic social services, including 99 medical care, emergency fire and rescue services, roads, and schools. The PILT 100 Program will expire at the end of Fiscal Year 2012. The Kodiak Island Borough is 101 seeking the Delegation's assistance in extending the PILT Program for another five 102 years. 103 104 2. Refuge Revenue Sharing: The National Wildlife Refuge Fund is a critical source of 105 replacement revenue to communities like ours who have the presence of a large 106 Federal wildlife refuge within their boundaries. That presence removes substantial 107 amounts of property from the local property tax base. The share we receive from the 108 Fund is based on a formula that partially compensates us for our tax losses due to the 109 existence of the Kodiak National Wildlife Refuge. The Refuge is over 1.9 million acres 110 in size and therefore has permanently removed from private ownership, development 111 and taxation over half the property on the island. The current Administration 112 recommended no funding for this important program. The Kodiak Island Borough is 113 seeking the Alaska Delegation's assistance in providing level funding for this program 114 in Fiscal Year 2013. 115 116 3. Bypass Mail Program: Congress is currently working on legislation to reform the U.S. 117 Postal System in an effort to stem the financial losses currently being incurred by the 118 U.S. Postal Service. A number of Members of Congress have used this legislative 119 initiative to advocate for the curtailment or elimination of the postal rate subsidies for 120 rural Alaska. Postal service is a fundamental right guaranteed to all Americans under 121 the U.S. Constitution. Universal service is a cornerstone of our current Postal System. 122 The existing Bypass Mail Program is the mechanism used by the U.S. Postal Service 123 to guarantee the benefits of universal service to Americans living in the rural areas of 124 Alaska. The elimination of Bypass Mail will discriminate against Alaskans by depriving 125 them of the uniform postal rates available to all other Americans. The Kodiak Island 126 Borough recommends that the Alaska Delegation vigorously oppose any efforts to 127 terminate or undermine the Bypass Mail Program. 128 129 4. Essential Air Service (EAS) Program: The EAS Program was created as a legislative 130 compromise during Airline Deregulation to assure that rural communities around the 131 nation would not lose passenger air service. The Borough villages currently receive 132 EAS subsidy. Air service links the residents of these villages to Kodiak and the rest of 133 the United States. EAS guarantees that these residents will have scheduled air service Kodiak Island Borough Resolution No. FY2012 -17 Page 3 of 5 134 at reasonable rates. The EAS Program survived repeated amendments to repeal it 135 earlier this year, including one attempt in the appropriations process to severely cut 136 back on the annual funding. We anticipate these challenges to the program to continue 137 in 2012. Loss of the EAS subsidy could result in the cessation of scheduled air service 138 and a dramatic increase in the costs of tickets to rural residents. The Kodiak Island 139 Borough is recommending that the Alaska Delegation continue to vigorously defend the 140 EAS Program. 141 142 5. Groundfish Surveys: The North Pacific Fishery Management Council has raised 143 concerns with the National Oceanic and Atmospheric Administration about what 144 appears to be slippage in the winter and summer groundfish surveys for the Gulf of 145 Alaska. The diminution in these surveys will eventually come back to haunt Kodiak 146 fishermen and processors should the North Pacific Fishery Management Council turn 147 precautionary in the establishment of annual groundfish quotas due to insufficient stock 148 assessment data. A reduction in federal groundfish quotas for pollock, cod, and 149 rockfish would result in lost economic opportunities for Kodiak residents and lower raw 150 fish tax receipts over time. The Kodiak Island Borough recommends that the Alaska 151 Delegation add the groundfish surveys to the list of programs to be protected during the 152 Fiscal Year 2013 budget process. 153 154 6. Economic Development Administration (EDA): The EDA provides grants to 155 communities nationwide to help develop public infrastructure in areas with chronic 156 unemployment. Alaska receives an annual allocation of EDA grant funds. These funds 157 are used by EDA to help with projects being financed by state grants and local 158 matching funds. EDA's rural development grant program has been targeted for 159 elimination by some Members of Congress. The Borough and its communities must 160 continue to have access to a combination of local, state, and federal funding sources to 161 overcome the high cost of public infrastructure projects within the Borough boundaries. 162 The Kodiak Island Borough recommends that the Alaska Delegation identify the EDA 163 grant program as a priority for continued funding in Fiscal Year 2013. 164 165 7. Denali Commission: Congress has been providing the Denali Commission with 166 regional funding to assist communities and villages for the construction of local roads, 167 public health facilities, energy sufficiency projects, bulk fuel storage, and dock projects. 168 The Denali Commission generally uses its available funding as the final contribution to 169 projects which already have the majority of funds set aside from local, state, and other 170 federal sources. The elimination of Bypass Mail will discriminate against Alaskans by depriving 125 them of the uniform postal rates available to all other Americans. The Kodiak Island 126 Borough recommends that the Alaska Delegation vigorously oppose any efforts to 127 terminate or undermine the Bypass Mail Program. 128 129 4. Essential Air Service (EAS) Program: The EAS Program was created as a legislative 130 compromise during Airline Deregulation to assure that rural communities around the 131 nation would not lose passenger air service. The Borough villages currently receive 132 EAS subsidy. Air service links the residents of these villages to Kodiak and the rest of 133 the United States. EAS guarantees that these residents will have scheduled air service Kodiak Island Borough Resolution No. FY2012 -17 Page 3 of 5 134 at reasonable rates. The EAS Program survived repeated amendments to repeal it 135 earlier this year, including one attempt in the appropriations process to severely cut 136 back on the annual funding. We anticipate these challenges to the program to continue 137 in 2012. Loss of the EAS subsidy could result in the cessation of scheduled air service 138 and a dramatic increase in the costs of tickets to rural residents. The Kodiak Island 139 Borough is recommending that the Alaska Delegation continue to vigorously defend the 140 EAS Program. 141 142 5. Groundfish Surveys: The North Pacific Fishery Management Council has raised 143 concerns with the National Oceanic and Atmospheric Administration about what 144 appears to be slippage in the winter and summer groundfish surveys for the Gulf of 145 Alaska. The diminution in these surveys will eventually come back to haunt Kodiak 146 fishermen and processors should the North Pacific Fishery Management Council turn 147 precautionary in the establishment of annual groundfish quotas due to insufficient stock 148 assessment data. A reduction in federal groundfish quotas for pollock, cod, and 149 rockfish would result in lost economic opportunities for Kodiak residents and lower raw 150 fish tax receipts over time. The Kodiak Island Borough recommends that the Alaska 151 Delegation add the groundfish surveys to the list of programs to be protected during the 152 Fiscal Year 2013 budget process. 153 154 6. Economic Development Administration (EDA): The EDA provides grants to 155 communities nationwide to help develop public infrastructure in areas with chronic 156 unemployment. Alaska receives an annual allocation of EDA grant funds. These funds 157 are used by EDA to help with projects being financed by state grants and local 158 matching funds. EDA's rural development grant program has been targeted for 159 elimination by some Members of Congress. The Borough and its communities must 160 continue to have access to a combination of local, state, and federal funding sources to 161 overcome the high cost of public infrastructure projects within the Borough boundaries. 162 The Kodiak Island Borough recommends that the Alaska Delegation identify the EDA 163 grant program as a priority for continued funding in Fiscal Year 2013. 164 165 7. Denali Commission: Congress has been providing the Denali Commission with 166 regional funding to assist communities and villages for the construction of local roads, 167 public health facilities, energy sufficiency projects, bulk fuel storage, and dock projects. 168 The Denali Commission generally uses its available funding as the final contribution to 169 projects which already have the majority of funds set aside from local, state, and other 170 federal sources. Kodiak's trails are to be used and enjoyed. Urban and Road System trails are identified in the plan in an effort to make them part of a permanent trails network as well as part of an part of the community's transportation infrastructure. A network that should be considered, preserved and expanded as the community grows, subdivides and develops. Urban trails are used heavily on a daily basis providing a safe route for children to walk and bike to schools and to travel to recreational facilities. They also provide a direct route to shopping areas and other retail services as well as routes to work by folks walking back and forth from their homes. Rural trails are for recreation and provide us with some tremendous vistas and access to many of the road systems resources. This Parks and Recreation Committee effort documents more than 350 miles of existing trail and provides an in- depth look at their condition. While some are capable of heavy use others are located on sensitive lands not capable of sustained use. Each of the trails is named and a physical description of each (width, length, grade and surface type) is provided. But at the same time the plan identifies short comings to this trail system by identifying the need for parking lots, signage, restrooms and items like Information Kiosks to keep the public posted on important items. The plan also talks about what it takes to be good stewards of the land and to respect adjacent private lands. These items are future goals and objectives that will be achieved as we move into a future and when grants or other funding is acquired to construct trail improvements.. Stand on the corner of Rezanof and Marine Way on Friday night or on the weekends and you will notice a large number of residents heading out the road to recreate in some form. They will be hunting, fishing, camping and hiking, four wheeling, bear viewing rafting, berry picking, mountain climbing, skiing, snow showing or just site seeing.
