FY2012 -14 6 7 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH 8 REZONING A PARCEL OF LAND AT THE INTERSECTION OF REZANOF DRIVE AND 9 OTMELOI WAY FROM RR1- RURAL RESIDENTIAL ONE ZONING DISTRICT TO B- 10 BUSINESS ZONING DISTRICT (P&Z CASE 12 -014) 11 12 WHEREAS, the Planning and Zoning Commission received a request to rezone a single 13 lot located at the intersection of Rezanof Drive and Otmeloi Way; and 14 15 WHEREAS, the Commission voted to recommend to the Borough Assembly that this 16 parcel be rezoned, finding that the public necessity, convenience and general welfare, and 17 good zoning practice would be forwarded by such action; and 18 19 WHEREAS, the Commission hereby recommends that this rezone request be reviewed 20 and approved by the Borough Assembly. 21 22 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND 23 BOROUGH THAT: 24 25 Section 1: This ordinance is not of a general and permanent nature and shall not 26 become a part of the Kodiak Island Borough Code of Ordinances. 27 28 Section 2: Lot 4, Block 5, Miller Point Alaska Subdivision be rezoned from RR1- Rural 29 Residential One to B- Business. 30 31 Section 3: The findings of the Kodiak Island Borough Planning and Zoning Commission 32 are hereby confirmed as follows: 33 34 17.205.020A. Findings as the Need and Justification for a Change or 35 Amendment. 36 A.1. As stated in the KIB Comprehensive Plan: To regulate and manage 37 land uses to balance the rights of private property owners with 38 community values and objectives. The need for a change is to 39 maximize compatibility of adjacent land uses. The Lot in this case is 40 across the street from long term sites used for commercial use; 41 Bayside Fire Department across Rezanof Dr and Kodiak Electric • 42 Company storage lot across Otmeloi Dr. 43 A.2. Current use fits the rezone request. 44 A.3. Adjacent properties are Business / Industrial. 45 46 • 47 48 49 Kodiak Island Borough Ordinance No. FY2012 -14 Page 1 of 2 50 17.205.020B. Findings as to the Effect a Change or Amendment would 51 have on the Objectives of the Comprehensive Plan. 52 B.1. The Comprehensive Plan proposed future land use map identifies this 53 Lot as Rural Residential. The change in zoning from Rural Residential 54 to Commercial would be consistent with land use across Otmeloi Dr 55 and Rezanof Dr. The change enhances the operation of an existing 56 local business while not disrupting adjacent neighborhoods. Public 57 Hearing Notices (30) were mailed on September 14th, 2011 and 2 58 responses were received by the Borough in support of the change. 59 60 17.205.020 C. Recommendations as to the approval or disapproval of 61 the change or amendment. 62 C.1.
