Assembly Regular Meeting
November 3, 2011
A regular meeting of the Kodiak Island Borough Assembly was held on Thursday, November 3, 2011,
in the Assembly Chambers of the Kodiak Island Borough Building, 710 Mill Bay Road. The meeting
was called to order at 7:30 p.m.
The invocation was given by Major John Quinn of the Salvation Army. Mayor Selby led the Pledge of
Allegiance.
Present were Mayor Jerome Selby, Assembly members Carol Austerman, Tuck Bonney, Jerrol
Friend, Dave Kaplan, Chris Lynch, Mel Stephens, and Louise Stutes. Staff members present were
Manager Rick Gifford, Finance Director Karl Short, Borough Clerk Nova Javier, and Deputy Clerk
Marylynn McFarland.
APPROVAL OF AGENDA AND CONSENT AGENDA
FRIEND moved to approve the agenda and consent agenda.
VOICE VOTE ON MOTION CARRIED UNANIMOUSLY.
APPROVAL OF MINUTES
None.
AWARDS AND PRESENTATIONS
Manager Gifford presented the Employee of the Quarter Award to Jessica Basuel, Interpretive
Specialist at the Kodiak Fisheries Research Center.
CITIZENS' COMMENTS
None.
COMMITTEE REPORTS
Assembly member Kaplan reported that the Kodiak College Council would meet at the Kodiak
College on Friday, November 4, 2011 at 7 a.m.
PUBLIC HEARING
None.
BOROUGH MANAGER'S REPORT
Reported on the following:
• Legislative information from Federal Lobbyist Brad Gilman which included an update of the
PILT and Secure Rural School Program.
• Alaska Department of Transportation and Public Facilities released its 2011 Economic
Impacts of Alaska Airports which included the Kodiak Airport.
• The Finance Department reported that the value of fish reported on several tax forms for the
third quarter of 2011 had increased approximately $12 million, an increase of 23 %.
• The date confirmed for the Legislative Reception in Juneau was Wednesday, March 21, 2012.
• Out of town November 6 -11 to attend the Alaska Municipal Managers Association Meeting
and the Alaska Municipal League Conference in Fairbanks.

MESSAGES FROM THE BOROUGH MAYOR
Mayor Selby provided the following information:
• Requested the Assembly to review the draft solicitation letter requesting donations and
contributions for the Legislative Reception.
• Recognized Ruth Brechan as an Alaska Pioneer and sent condolences to the family on her
recent passing.
• Met with co- directors from the Kodiak Fisheries Industrial Technology Center under its new
name, and reviewed the change -over.
• Encouraged the community to share and recognize those in need during the upcoming
holiday season.

Reorganization of the Kodiak Island Borough Assembly
1. Election of the Deputy Presiding Officer.
Mayor Selby opened the nominations.
BONNEY moved to nominate Assembly member Friend as Deputy Presiding Officer.
STUTES moved to close the nominations.
VOICE VOTE ON MOTION CARRIED UNANIMOUSLY.
STUTES moved to cast a unanimous ballot for Assembly member Friend as Deputy Presiding
Officer.
ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Austerman, Bonney, Friend, Kaplan,
Lynch, Stephens, and Stutes.

Ordinances for Introduction
1. Ordinance No. FY2012 -11 Amending Title 3 Revenue and Finance Chapter 3.55 Transient
Accommodations Tax Section 3.55.025 Allocation of Sales Tax Proceeds.
AUSTERMAN moved to adopt Ordinance No. FY2012 -11 in first reading to advance to public hearing
at the next regular meeting of the Assembly.
The ordinance was a clean -up ordinance to correct an error in KIBC 3.55.025 to reflect that there was
only one village in Kodiak which was the Village of Karluk and five second class cities which were the
Cities of Akhiok, Larsen Bay, Port Lions, Old Harbor, and Ouzinkie.

2. Ordinance No. FY2012 -12 Repealing Sections of Ordinance No. FY2007 -09 Authorizing an
Amendment to the Borough's Participation Agreement With the Public Employees Retirement
System (PERS) of Alaska and to Change the Borough Code of Ordinances to Exclude
Participation of Elected Officials.
STUTES moved to adopt Ordinance No. FY2012 -12 in first reading to advance to public hearing at
the next regular meeting of the Assembly.
Ordinance No. FY2007 -09 was adopted by the Kodiak Island Assembly on October 5, 2006, which
allowed sitting assembly members to continue participation in the PERS system but would not allow
newly elected officials to join the program.
As written, Ordinance No. FY2007 -09, was not acceptable to the State of Alaska PERS system
because the Borough had to let all elected officials participate in PERS or exclude all elected officials
from participation. This repeal allowed elected officials to participate in the State PERS program
subject to PERS Regulations.
Sections 3 and 4 of Ordinance No. FY2007 -09 dealing with Assembly members being able to
participate in the borough health and life insurance plan would remain in the Kodiak Island Borough
Code of Ordinances.
Assembly member Stephens spoke against Ordinance No. FY2012 -12 and suggested postponing
the ordinance.
ROLL CALL VOTE ON MOTION CARRIED SIX TO ONE: Friend, Kaplan, Lynch, Stutes, Austerman,
and Bonney (Ayes); Stephens (No).
Other Items
1. Declared a Seat on the Monashka Bay Road Service Area Board Vacant. This item was
approved under the consent agenda.
Mr. Dave Sundberg was elected as a write -in during the regular election of October 4, 2011. Mr.
Sundberg declined to assume the duties as a board member of the Monashka Bay Road Service
Area board. The Assembly accepted the declination notice provided by Mr. Sundberg for the seat
term to expire October 2014 on the Monashka Bay Road Service Area Board, declared the seat
vacant, and directed the Borough Clerk to advertise the vacancy per Borough code.
2. Declared a Seat on the Solid Waste Advisory Board Vacant. This item was approved under the
consent agenda.
On Monday, October 17, 2011, Ms. Sandra West submitted a notice of resignation from the Solid
Waste Advisory Board for a term to expire December 2013. The Assembly accepted, with regret, the
resignation of Ms. West from the Solid Waste Advisory Board for a term to expire December 2013,
and directed the Borough Clerk to advertise the vacancy per Borough Code.
3. Declared a Seat on the Kodiak Workforce Regional Advisory Council Vacant. This item was
approved under the consent agenda.
Prior to being elected to the Borough Assembly on October 4, 2011, Mr. Tuck Bonney served on the
Kodiak Workforce Regional Advisory Council (KWRAC) as the Agriculture and Natural Resources
designated representative. Per Borough Code, Assembly members may serve on boards,
commissions, etc. as ex- officio members only; therefore, requiring that the seat currently held by Mr.
Bonney be vacated. The Assembly declared the Agriculture and Natural Resources seat on the

Kodiak Workforce Regional Advisory Council vacant and directed the Borough Clerk to advertise the
vacancy per Borough Code.
4. Mayoral Appointments of Assembly Member Representatives to Boards and Committees.
FRIEND moved to confirm the mayoral appointments of assembly member representatives to
Boards, Committees, Commissions, and Councils.

CITIZENS' COMMENT
None.
ASSEMBLY MEMBER COMMENTS
Assembly member Stephens asked that the Assembly not cancel regular meetings for the
convenience of the public. He reported that a primary goal of his for the next two to three years was
to try and see that the Kodiak High School Remodeling and Renovation Project be completed within
the budget and on time.
Assembly member Stutes requested a meeting with those involved in the Kodiak High School
Remodeling and Renovation Project for an update.
Assembly member Bonney thanked the Kodiak community for its support on his recent election to the
Borough Assembly.
Assembly member Friend wished the community a Happy Thanksgiving and asked everyone to drive
carefully.
Assembly members Kaplan, Lynch, and Austerman congratulated Employee of the Quarter Award
recipient Jessica Basuel.
Assembly Austerman expressed her condolences to the Brechan family.

Announcements
Mayor Selby announced that the Borough Clerk's Office would be closed November 8 and 9, and
would reopen for business on Thursday, November 10, at 8 a.m.
The Mayor and members of the Assembly would be traveling to Fairbanks November 7 -11 to attend
the Alaska Municipal League Conference.
The Assembly work session scheduled for Thursday, November 10, 2011, and the regular meeting
scheduled for Thursday, November 17, 2011, had been cancelled.
The Assembly, Planning and Zoning Commission, and the Project Advisory Committee would meet in
a Special Work Session on Thursday, November 17, 2011, at 7:30 p.m. in the Borough Assembly
Chambers.
The Borough offices would be closed Friday, November 11, 2011, in observance of Veteran's Day,
and Thursday, November 24 and Friday, November 25, in observance of the Thanksgiving holiday.
The next Assembly work session would be held on Tuesday, November 29, 2011, at 7:30 p.m. in the
Borough Conference Room. The next regular meeting was scheduled on Thursday, December 1,
2011, at 7:30 p.m. in the Borough Assembly Chambers.

STUTES moved to adjourn the meeting.
