The assembly shall elect from among its members a deputy presiding officer, as specified in KIBC 2.30.040(A), to act as the chair in the absence of the mayor to conduct the meetings and see that the rules are observed. If the deputy presiding officer is not present or disqualifies himself, the senior assembly member present shall act as the chair. When a member of the assembly is acting as the chair, the member retains all privileges otherwise held as a member of the assembly. 2.30.040 Organization and deputy presiding officer. A. Organization. The assembly shall annually, at the November meeting, elect from its members a deputy presiding officer to serve at the assembly's pleasure. B. Election of the deputy presiding officer of the assembly shall be in the following manner: t 1. As the first order of new business, nominations for deputy presiding officer shall be opened. 2. Nominations may be made by any member of the assembly. 3. At the close of nominations, a ballot shall be taken. The clerk shall distribute, collect, and with the assistance of one other person, tally the ballots. The clerk shall announce the results. 4. A majority vote of the assembly shall be required for election. 5. If no majority is cast for any candidate, the candidate with the fewest ballots shall be dropped from the list of candidates until there are two remaining and balloting shall continue until one candidate is elected. C. Deputy Presiding Officer. The deputy presiding officer shall preside as the chair at assembly meetings in the absence of the mayor. If at any meeting the deputy presiding officer is not present, or is unable to act, the senior assembly member present shall preside as the chair. Since Ordinance No. FY2007 -09 was passed, the PERS retirement system has gone through several changes. One modification to the program is from a single employer system to a multiple employer system. By doing this, all participants in the PERS system share increases and decreases in cost. Without doing a study, it is hard to predict exactly what the impact of this ordinance will have on the PERS system and how it will affect rates. At the current time the Borough only pays 22% of our retirement costs and the State pays the difference. As written, Ordinance No. FY2007 -09, is not acceptable to the State of Alaska PERS system because the Borough had to let all elected officials participate in PERS or exclude all elected officials from participation. This repeal would allow elected officials to participate in the State PERS program subject to PERS Regulations. Sections 3 and 4 of Ordinance No. FY2007 -09 dealing with Assembly members being able to participate in the borough health and life insurance plan will remain in the Kodiak Island Borough Code of Ordinances. NOW, THEREFORE, BE IT ORDINAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: Classification. Sections 3 and 4 of this ordinance are of a general and permanent nature and shall become a part of the Code of Ordinances of the Kodiak Island Borough. The remainder shall not be codified. Section 6: This ordinance applies to all persons elected after July 1, 2007. Its intent is only to exclude the time that a person may serve as an elected official — not to exclude any time that the person may be otherwise employed by the borough. The Kodiak Island Borough's participation agreement with the PERS includes elected officials. Elected Official may elect to waive participation in the PERS at any time by completing and submitting the "Elected Official Participation/Waiver" form. With the implementation of the Defined Contribution Retirement Plan, effective July 1, 2006, statutory language was added to the PERS that required newly elected officials to earn a minimum of $2001 each month to be eligible to participate in the PERS. The division was advising employers that this new language affected all newly elected officials regardless of tier status. This included Tier I, If, and III members of the Defined Benefit (DB) plan and Tier IV members of the Defined Contribution Retirement (DCR) plan. Senate Bill 123 was finalized on June 6, 2007. The purpose of this bill was to clean up some of the language and missing statutory changes due to the implementation of the Tier IV DCR plan. Upon consultation of the divisions legal counsel, an opinion was issued January 31, 2011, that clarified how we are to treat newly elected officials in the DB and DCR plans in relation to the $2001 per month compensation requirement. The clarification is as follows. If the employer includes elected officials in their participation agreement prior to June 6, 2007, enrollment of newly elected officials is dependent upon the tier of benefits under which the new incumbent of the office is eligible. Defined Benefit Elected Officials (PERS Tier I, II, III). Newly elected officials who are already members of the PERS defined benefits plan (first entered the PERS prior to July 1, 2006) can be enrolled in PERS as long as they are compensated for their services. Defined Benefit elected officials with a participating employer who included elected officials prior to June 6, 2007 do not have to meet the $2001 monthly compensation requirement to remain in PERS. Defined Contribution Elected Officials (PERS Tier IV). Newly elected officials who have not previously been members of the PERS or who are defined contribution PERS members with an employer who did not include elected officials in its defined contribution plan prior to June 6, 2007, must be compensated at a rate of $2001 per month to be eligible for PERS participation. In a discussion with your finance Officer, Dria Bray- Holloway, there are three elected officials after June 6/2007, with the Kodiak Island Borough that will need their files reviewed for possible inclusion in the PERS. Vacancies shall be filled by the candidate(s) receiving the highest number of votes cast for each seat. Each board member shall be qualified to vote within the borough and shall be a resident of the service area. Mr. Dave Sundberg was elected as a write -in during the regular election of October 4, 2011. Mr. Sundberg declined to assume the duties as a board member of the MBSA board. It is necessary for the Assembly to vacate the seat and give direction to the Clerk's Office to advertise the vacancies per Borough Code. RECOMMENDED MOTION: Move to accept the declination notice provided by Mr. Dave Sundberg for the seat expiring 2014 on the Monashka Bay Road Service Area Board, declare the seat vacant, and direct the Borough Clerk to advertise the vacancies per Borough code. Per KIBC 2.100.070 Vacancies. A. Other than by expiration of the member's term, the assembly shall declare a seat vacant when a member: 2. Resigns and the resignation is accepted; D. In the event of a vacancy on a board, committee, or commission for any reason other than normal expiration of a term of office, the clerk shall cause notice thereof to be published at least twice in a newspaper of general circulation within the borough. The notice shall set forth the vacancies and any qualifications of members. The appointing authority shall appoint a new member for the remaining unexpired term in accordance with KIBC 2.100.030. The mayor and members of the Assembly are ex officio members of all boards, commissions, and committees. Prior to being elected to the Borough Assembly on October 4, 2011, Mr. Tuck Bonney served on the Kodiak Workforce Regional Advisory Council (KWRAC) as the Agriculture and Natural Resources designated representative. Per Borough Code, Assembly members may serve on boards, commissions, etc. as ex- officio members only; therefore, requiring that the seat currently held by Mr. Bonney be vacated. BOX 1129 KODIAK, ALASKA 99615 TELEPHONE (907) 486 -3143 MEMORANDUM TO: Assembly and Staff FROM: Mel Stephens ' cs RE: KHS Addition and Remodel Project DATE: November 3, 2011 The primary goal I would like to see achieved while I am on the assembly — above all else — is for the KHS Addition and Remodel Project to be built within budget and on time. I do not take it for granted that this goal will necessarily be achieved if everyone will just sit back and concentrate on other things while the architects, engineers and contractors go about their business. Even if I were not a worrier (and I am) — • This is by far the largest construction project this community has ever attempted, • And we do not have a particularly good track record on building things within a projected budget. I see from the most recent Short Report, for example, that even after passage of the second bond issue which more than doubled the budget for the swimming pool, that project came in at 139% of budgeted Design Costs and 114% of budgeted Construction costs. So, I have being trying to bring myself up to date on the KHS project and, in that context, having been trying to identify not only where we are and what issues have already been raised and decided (and why) but also what issues are currently under consideration and when decisions on them are contemplated. This has been a somewhat time consuming and frustrating process but one which I regard as of the utmost importance. My personal preference would be to sit down in the relatively near future with the people who are responsible for this project and have a fairly detailed Question & Answer session. I am more than willing to review the available documents. Indeed, that is what I have been doing. But that process has answered only some of my questions. It has generated a good many others. I realize there is a very real and legitimate concern about newly elected assembly members needlessly using up staff time trying to educate themselves on Borough affairs. But, at the same Assembly & Staff -2- November 3, 2011 time, this particular project is important enough that I would hope the staff and other assembly members would be understanding and responsive to the need for every one of us to be fully current on it. Since the assembly has not had any formal input into the KHS project since last June, it has also occurred to me that there may assembly members other than myself who might like a Q &A session on this project. Therefore, I offer for consideration the question of whether the assembly as a whole (or any subset of assembly members) might be interested in a Q &A type of meeting or hearing where, after an initial presentation by a panel of those most involved in the KHS project, each of us would get, say, 10 minutes or so to ask questions of that panel. If there's interest in this idea, then I suggest we move forward on it as soon as possible. If not, I will look to other ways of bringing myself up to speed on this very important project. ASSEMBLY MEMBER COMMENTS Announcements — Mayor Selby The Borough Clerk's Office will be closed November 8 and 9, and will reopen for business on Thursday, November 10, at 8 a.m. The Mayor and members of the Assembly will be traveling to Fairbanks November 7 -11 to attend the Alaska Municipal League Conference. The Assembly work session scheduled for Thursday, November 10, 2011, and the regular meeting scheduled for Thursday, November 17, 2011, have been cancelled. The Assembly, Planning and Zoning Commission, and the Project Advisory Committee will meet in a Special Work Session on Thursday, November 17, 2011, at 7:30 p.m. in the Borough Assembly Chambers.
