FY2012 -12 9 10 A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH 11 RATIFYING AND CERTIFYING THE RESULTS 12 OF THE MUNICIPAL ELECTION HELD OCTOBER 4, 2011 13 14 WHEREAS, the Kodiak Island Borough held a Regular Election on October 4, 2011, at 15 which time candidates for the following offices were voted on: 16 17 Borough Assembly Three Seats, Three Year Terms 18 School Board Two Seats, Three Year Terms 19 One Seat, One Year Term 20 Fire Protection Area No. 1 Board Two Seats, Three Year Terms 21 Service Area No. 1 Board Three Seats, Three Year Terms 22 Bay View Road Service Area Board One Seat, Three Year Term 23 Monashka Bay Road Service Area Board One Seat, Three Year Term 24 Womens Bay Service Area Board Three Seats, Three Year Terms 25 26 WHEREAS, the following propositions were submitted to the qualified voters in the Kodiak 27 Island Borough; and 28 Initiative Proposition No.1 - Term Limits 29 Shall Initiative Ordinance No. FY2011 -01 limiting terms of office for the Kodiak Island 30 Borough Assembly, Borough Mayor, and School Board Members to two (2) consecutive 31 terms from serving on the Assembly, or as Borough Mayor, or School Board Members until 32 a period of six (6) years has passed since the end of that person's second consecutive term 33 be approved? A term includes a regular three year term or a term that is less than three (3) 34 years due to a change in composition, membership structure, districting or apportionment. 35 36 Proposition No. 1 - Sales Tax 37 Shall the Kodiak Island Borough levy, assess, and collect a sales tax not to exceed one 38 percent (1 %) of sales, rents, and services in the Borough on a year round basis? Griffin were elected to three -year terms, having received the 82 highest vote tallies. 83 84 Section 3: In the Borough -wide election for Borough School Board, Peggy Rauwolf was 85 elected to a one -year term, having received the highest vote tally. 86 87 Section 4: In the Fire Protection Area No. 1, Richard Carstens was elected to a three - 88 year term having received the highest vote tallies. Andrew Devries and Mike 89 Dolph were both elected to a three -year term, having received the highest 90 write -in vote tallies. 91 92 Per KIBC 7.40.010 (D) Canvass of returns. If there is a failure to elect 93 because of a tie, the election shall be determined fairly by lot from among the 94 candidates tying in a meeting of the assembly and under its direction. 95 96 *Mr. Dolph noted that he did not want to assume the seat if he were selected 97 by lot. 98 99 Section 5: In the Service Area No. 1, Scott Arndt and Gary Turk Martin were elected 100 to three -year terms having received the highest vote tallies and Kevin Arndt 101 was elected to a three -year term having received the highest write -in vote 102 tally. 103 104 Section 6: In the Bay View Road Service Area, Reed Oswalt was elected to a three - 105 year term, having received the highest write -in vote tally. 106 107 Section 7: In the Monashka Bay Road Service Area, Dave Sundberg was elected to a 108 three -year term, having received the highest write -in vote tally. Greg Egle and Dennis Hilsinger were both elected to three -year 113 terms, having received the highest write -in vote tallies. 114 115 Per KIBC 7.40.010 (D) Canvass of returns. If there is a failure to elect 116 because of a tie, the election shall be determined fairly by lot from among the 117 candidates tying in a meeting of the assembly and under its direction. 118 119 "At the October 13, 2011 Assembly work session, Mr. Greg Egle was picked 120 by lot by the Assembly. He contacted the Clerk noting his declination to 121 assume the seat.
