9 A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY APPOINTING A
10 MEMBER TO THE KODIAK FISHERIES DEVELOPMENT ASSOCIATION

12 WHEREAS, the North Pacific Fishery Management Council adopted the Bering
13 Sea /Aleutian Islands Crab Rationalization Program as Amendments 18 and 19 to the
14 Fishery Management Plan for Bering Sea /Aleutian Islands King and Tanner Crabs; and
15
16 WHEREAS, under the Program, Kodiak was designated as an eligible crab
17 community (ECC) and in connection with such designation the Kodiak Island Borough
18 and the City of Kodiak have the authority to jointly exercise certain rights of first refusal
19 (ROFR) with respect to processor quota shares (PQS) allocated under the Program; and
20
21 WHEREAS, to exercise the ECC ROFR the Kodiak Island Borough and the City of
22 Kodiak have jointly designated the Kodiak Fisheries Development Association (KFDA)
23 as the region's eligible crab community entity (ECCE) having the authority to do so on their
24 behalf; and
25
26 WHEREAS, the bylaws of the Kodiak Fisheries Development Association provide for
27 appointment of Directors to the Board of the KFDA by the Kodiak Island Borough
28 Assembly and the Kodiak City Council; and
29
30 WHEREAS, the bylaws of the KFDA state, in part, that Directors shall serve until
31 their successors are appointed and qualified; and
32
33 WHEREAS, two of the three joint KFDA Director seats' terms have expired; and
34
35 WHEREAS, Mr. Albert Tyler Schmeil has indicated his desire to be reappointed to
36 the joint seat on the KFDA Board of Directors.

38 NOW, THEREFORE BE IT RESOLVED, THAT THE ASSEMBLY OF THE KODIAK
39 ISLAND BOROUGH THAT the following individual are appointed as Directors of the
40 Kodiak Fisheries Development Association, with the noted terms:
