FY2011 -08 9 10 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH 11 DETERMINING THE DISPOSITION OF TAX FORECLOSED PROPERTIES 12 FROM 2008 AND PRIOR TAX YEARS, ESTABLISHING INTENTION TO SURPLUS 13 AND SELL THE SAME, FINDING THAT A PUBLIC NEED DOES NOT EXIST 14 FOR THESE PROPERTIES, AND AUTHORIZING LAND SALE 15 NUMBER SEVENTEEN TERMS AND CONDITIONS 16 17 WHEREAS, the Kodiak Island Borough has acquired real properties as a result of the tax 18 foreclosure procedure from 2008 and prior tax years; and 19 WHEREAS, AS 29.45.460 Disposition and sale of foreclosed property states: 20 (a) The municipality shall determine by ordinance whether foreclosed property deeded 21 to the municipality shall be retained for a public purpose. The ordinance must 22 contain the legal description of the property, the address or a general description of 23 the property sufficient to provide the public with notice tice of its location, and the name 24 of the last record owner of the property as the name appears on the assessment 25 rolls. 26 (b) Tax - foreclosed property conveyed to a municipality by tax foreclosure and not 27 required for a public purpose may be sold. Before the sale of tax - foreclosed 28 property held for public purpose, the municipality, by ordinance, shall determine 29 that a public need does not exist; and 30 WHEREAS, the Kodiak Island Borough Planning and Zoning Commission has .reviewed 31 the list of 2008 and prior tax years for foreclosed properties as required by KIBC 18.10.030, 32 has conducted a public hearing on the disposition of the subject parcels, and has made a 33 formal recommendation on the parcel's disposition to the Assembly that the parcels 34 identified have been reviewed by staff and the Commission and that the properties not be 35 retained for public purpose; and 36 WHEREAS, the Kodiak Island Borough Manager has reviewed the Commission's action, 37 as required by KIBC 18.10.030; and 38 WHEREAS, the Kodiak Island Borough Manager has recommended the tax - foreclosed 39 parcels listed below are declared not to be of "public need" and be offered at a future KIB 40 land sale: 41 Kodiak Island Borough Ordinance No. FY2011 -08 Page 1 of 2 LEGAL DESCRIPTION PROPERTY ID # LAST OWNER LOCATION ZONING USE T39S R29W SM, TL 3006 R5302903006 BEECHING, DORTHY LARSEN BAY CONS. VAC 42 43 NOW, THEREFORE BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND 44 BOROUGH that: 45 Section 1: This ordinance is not of a general and permanent nature and shall not become 46 a part of the Kodiak Island Borough Code of Ordinances. 47 Section 2: The preceding properties have been acquired by the Kodiak Island Borough by 48 clerk's deed pursuant to tax foreclosure and have been determined that a 49 public need does not exist and will be sold at the next Kodiak Island Borough 50 Land sale. 51 Section 3: A sealed bid auction will be conducted in the Spring of 2011. The highest 52 bidder will take ownership. 53 Section 4: The terms to be approved by the assembly are: Bidder is to enclose a 10% 54 deposit based on the minimum bid amount shown in the bid packet.
