9 A RESOLUTION OF THE ASSEMBLY ADOPTING
10 A NEW KODIAK ISLAND BOROUGH URBAN ZONING MAP

12 WHEREAS, a new zoning map of the Kodiak urban area is being adopted due to a major
13 change of map making technology now employed by the Borough; and
14
15 WHEREAS, the borough code that regulates the official zoning map was written at a time
16 when maps were manually drafted in the Community Development Department and zoning
17 districts were distinguished using various patterns cut from 8 "x11" adhesive sheets and with
18 AutoCAD; and
19
20 WHEREAS, the zoning maps are now produced in the Information Technology
21 Department using property data from the Assessing Department; and
22
23 WHEREAS, KIB 17.30.040 states that in the event the official zoning map is damaged,
24 destroyed, or becomes difficult to interpret due to a large number of changes or additions,
25 the commission may, by resolution of the assembly, adopt a new official zoning map which
26 supersedes all prior versions of the map; and

28 WHEREAS, this code section was written when a certified copy of the map was to be kept
29 in the clerk's office and in the office of the community development department; and

31 WHEREAS, there is no intention to change the zoning of any parcel with this action: and
32
33 WHEREAS, should there be a future zoning conflict or mapping error, the newly adopted
34 zoning map will prevail and any change in zoning will be adjudicated by the commission and
35 the assembly as a regular zoning change case.

37 NOW, THEREFORE BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
38 BOROUGH that a new zoning map dated September 8, 2010, is the official urban zoning
39 map for the Kodiak Island Borough.
